RESOLUTION
RE : GRANT CHANGE OF ZONE FROM C-1 TO C-3 FOR MIDEXCO
CONSTRUCTION, INC. AND ZIMMERMAN OIL COMPANY
a
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the

affairs of Weld County, Colorado, and
c WHEREAS, the Board of County Commissioners has been
presented with a request from Midexco Construction, Inc. and
Zimmerman Oil Company for a change of zone from C-1 to C-3,
and
WHEREAS, said request is necessary in order for these
two firms to build and make improvements consistent with
their growth, and
WHEREAS, the Board feels it is in the best interests to
amend the official Weld County Zoning from C-1 to C-3 on the
following described property:
LEGAL DESCRIPTION - MIDEXCO CONSTRUCTION, INC.
All that part of Lots 2 , 3 and 4, of the NEa of the
SWa of Section 4 , Township 5 North, Range 65 West of
the 6th P.M. , Weld County, Colorado, according to the
subdivision of lands by the Union Colony of Colorado,
described as follows:
Beginning at a point on the North line of Lot 4 ,
which is South 1°15 ' West 696. 25 feet and South 89°58 '
West 297 feet from the NE corner of the SWa of said
Section 4;
thence South 89°58 ' West 360 feet along the North
line of Lot 4 to the NW corner thereof;
thence North 100 feet along the East line of said
Lot 2 ;
thence South 89°58 ' West 100 feet;

its authority under Section 8. 2. 4 of the Weld County Zoning
Ordinance, determines the C-1 zoning to be faulty.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that the Change of Zone for the above described
parcels, be and hereby is approved.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 16th
day of December, A.D. , 1981.

Dear Mr. Honn:
We, the owners of two parcels of land on East 8th. Street, are
concerned that the zoning as it now exists is inappropriate to our
operation and future plans. (Please see the attached legal descriptions.)
It is our understanding that at this time these properties are included
in the C-1 zoning. The properties are 417 E. 8th. Street, owned by
Midexco Construction, Inc. , a utility excavation firm and 555 East 8th.
Street, owned by Zimmerman Oil Company, doing business as a petroleum
dealer.
This situation came to our attention because Midexco Construction, Inc.
wishes to build a new office building and make other improvements consistent
with the Company' s growth. In addition Zimmerman Oil Company also has
plans to make various improvements to their property. We are requesting
that you give consideration to changing the zoning to C-3 which we feel
will be more suitable to the present and future use of the property. We
respectfully request this change in zone from C-1 to C-3.
