WHEREAS, Section 21 . 6 . 2 of the Weld County Zoning Ordinance provides standards for review of such a Change of Zone, and WHEREAS , the Board of County Commissioners heard all the testimony and statements of those present, has studied the re- quest of the applicants and the recommendations fo the Weld County Planning Commission, and having been fully informed, finds as follows: 1 . The "I-1" (Industrial One) Zoning will be consistent with the future goals and needs of the County as set forth in the Comprehensive Plan. The proposed "I-1 " Zoning will also be consistent with the overall intent of the Weld County Zoning Ordinance. 2 . Adequate access to the proposed property is available via Weld County Road 8 . 3 . The Weld County Health Department indicated, in a letter dated May 12 , 1983 , that the proposed septic tank and leachfield would be adequate. 4 . The applicant is proposing a well water supply source. 5. The property does not exist in a flood plain or geologic hazard overlay district. Morrison Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated June 20, 1983, and duly published an June 23, 1983 and July 14, 1983, in the Lasalle Leader, a public hearing was held for the purpose of considering the request of Joe and Tom Sasaki for a Change of Zone. from A (Agricultural District) to I-1 (Industrial One District) . Lee Morrison, Assistant County Attorney, read this request into the record. Rod Allison, Planning representative, read the favorable recommendation from the Planning Commission into the record. This recommendation for approval is subject to conditions. Burl VanBuskirk, representing the appli- cants, was present. Theresa Davis came forward to voice her objections to this Change of Zone. Also opposed to this Change of Zone were Charles Ocker and Barbara Ocker. They voiced their concerns in allowing industrial uses in this area, they wish this to remain agricultural. The Chairman said that and Industrial One District is very compatible to a Residential District. After further discussion, Commissioner Johnson moved to approve this Change • of Zone for Joe and Tom Sasaki with the conditions as listed. The Planning staff understands that the applicant may have attracted a buyer for the land; however, it is unfortunate that several acres of land exist just north of Fort Lupton and south of Weld County Roan 6, on Highway 85, toward Brighton, that are presently zoned "I-3" and are vacant -waiting for development C. Industrial Zoning within the comprehensive planning area of a town shall be subject to that industry's compliance with the local Comprehensive Plan. The Comprehensive Plans for both Weld County and Port Lupton show that the subject site is located in an area intended to remain an agricultural zone district. The Port Lupton Planning Commission reviewed this Change ofZone request and recommended denial of the"I-3" zoning. The Fort Lupton Planning Commission indicated that the heavy industrial classification conflicts with the kind of development presently occuring in the southern part of Fort Lupton, as well as the growth expected to occur toward the subject site in the future. Residential growth is occurring -now, and intended to occur in the future. Given the type of growth that is occurring in this area, the Fort Lupton Planning Commission and Weld County Planning staff -propose "I-1" (industrial One) for this property. This area is underlain by clay, sand, and gravel deposits of the Platte River and may be affected by seasonally shallow groundwater levels . To adequately design buildings, utilities, and septic systems for these conditions, we recommend that a geotechnical investigation be completed on this site prior to development. Additionally, we recommend that the mineral right owner be advised of the proposed development. If this recommendation is followed, we have no objection to conditional approval of this rezoning.
