WHEREAS, Section 21 . 6 . 2 of the Weld County Zoning Ordinance
provides standards for review of such a Change of Zone, and
WHEREAS , the Board of County Commissioners heard all the
testimony and statements of those present, has studied the re-
quest of the applicants and the recommendations fo the Weld County
Planning Commission, and having been fully informed, finds as
follows:
1 . The "I-1" (Industrial One) Zoning will be consistent with
the future goals and needs of the County as set forth in
the Comprehensive Plan. The proposed "I-1 " Zoning will
also be consistent with the overall intent of the Weld
County Zoning Ordinance.
2 . Adequate access to the proposed property is available via
Weld County Road 8 .
3 . The Weld County Health Department indicated, in a letter
dated May 12 , 1983 , that the proposed septic tank and
leachfield would be adequate.
4 . The applicant is proposing a well water supply source.
5. The property does not exist in a flood plain or geologic
hazard overlay district. Soil conditions are addressed
in the condition listed below.

A public hearing was conducted on Wednesday, July 27 , 1983 at 2:00 P. M. , with
the following present:

Norman Carlson Commissioner
Jacqueline Johnson Commissioner
Also present:
Acting Clerk to the Fnard, Tommie Antuna
Assistant County Attorney, Lee D. Morrison
Planning Department Representative, Rod Allison
The following business was transacted:
I hereby certify that pursuant to a notice dated June 20, 1983, and duly
published an June 23, 1983 and July 14, 1983, in the Lasalle Leader, a public
hearing was held for the purpose of considering the request of Joe and Tom
Sasaki for a Change of Zone. from A (Agricultural District) to I-1 (Industrial
One District) . Lee Morrison, Assistant County Attorney, read this request
into the record. Rod Allison, Planning representative, read the favorable
recommendation from the Planning Commission into the record. This recommendation
for approval is subject to conditions. Burl VanBuskirk, representing the appli-
cants, was present. Theresa Davis came forward to voice her objections to
this Change of Zone. Also opposed to this Change of Zone were Charles Ocker
and Barbara Ocker. They voiced their concerns in allowing industrial uses
in this area, they wish this to remain agricultural. The Chairman said that
and Industrial One District is very compatible to a Residential District.
After further discussion, Commissioner Johnson moved to approve this Change
• of Zone for Joe and Tom Sasaki with the conditions as listed. Commissioner
Brantner seconded the motion and it carried unanimously.

1. The applicant would have to make a request to the Weld County
Planning Commission in order for the proposal to be reviewed for
"I-1" (Industrial One) Zoning.
2. Water supply, sewage disposal and street access would be reviewed
as part of the Site Plan Review process prior to issuance of any
building permit on the subject site for nnindustrial use.
3. The city of Brighton, located approximately two and one-half (2.5)
-miles south of the sits had no objections to the "I-3" (Industrial)
proposal.
4. The city of Fort Lupton -Planning Commission recommended a "C-1"
(Commercial One) designation for the Sasaki property located on the
north side of Weld County Road B. The intent of the "U-1" recommenda-
tion was to further insure the establishment of a buffer zone. It
is the opinion of the Planning staff that the use restrictions of
the "U-1" designation would limit the owners ability to market the
land and that the "I-1" District would accomplish the same intended
buffer zone.
5. Tor comparison purposes the zone districts discussed are listed
below:
Intent. The purpose of the I-3 District is to -provide a zone
to accomodate industrial USES which may create adverse visual
impacts for ADJACENT USES. As a result, such USES may require
locations relatively isolated from other land USE types.
Any USE of a research, repairing, manufacturing, fabricating,
processing, assembling, or storage nature may be conducted in
the I-3 District.
Intent. The purpose of the I-1 District is to provide a zone
to accommodate industrial USES which create minimal negative
visual impacts.
Any USE OF a research, repairing manufacturing, fabricating,
processing, assembling, or storage nature may be conducted in
the I-1 District as long as such IJSE is conducted only within
ENCLOSED BUILDINGS.
Areas for parking passenger vehicles with a gross vehicle
weight less than 6,000 pounds so long as such parking areas
ar-e SCREENED from the PUBLIC rights-of-way or on ADJACENT
properties. UNENCLOBED parking of vehicles with a gross
vehicle weight over 6,-000 pounds is not permitted in the 1-1
District.
Intent of the C-1 Tistri-ct. -o establish and preserve areas
for activities which provide convenience goods and services
primarily for the residents of a specific NEIGHBORHOOD.

THE DEPARTMENT OF PLANNING SERVICE'S STAFF RECOMMENDS THAT THIS REQUEST BE
DENIED FOR THE FOLLOWING REASONS:
L The Change of Zone request is not Consistent with the industrial growth policies
of the Weld County Comprehensive Plan and it As -not consistent with Fort Lupton's
General Plan. The Weld County Comprehensive Flan Industrial Growth Policies are
as follows:
A. Industrial development is encouraged to locate in one of the existing
municipalities where such a facility can be accomodated according to the
local Comprehensive Plan;
B. Zoning for industrial use in areas outside this area -covered by the Comprehen-
sive Plans of the existing municipalities shall be encouraged only for low
employee concentration, agricultural related industries or other industries
that can show they cannot reasonably he accomodated within the areas covered
by the municipalities comprehensive plan.
•
The appli-cant has not submitted any information addressing why
this Change of Zone cannot be accomodat-ed in an area intended for
"I-3" (Industrial Three) development. The Planning staff understands
that the applicant may have attracted a buyer for the land;
however, it is unfortunate that several acres of land exist just
north of Fort Lupton and south of Weld County Roan 6, on Highway
85, toward Brighton, that are presently zoned "I-3" and are
vacant -waiting for development
C. Industrial Zoning within the comprehensive planning area of a town shall be
subject to that industry's compliance with the local Comprehensive Plan.
The Comprehensive Plans for both Weld County and Port Lupton show
that the subject site is located in an area intended to remain an
agricultural zone district. The Port Lupton Planning Commission
reviewed this Change ofZone request and recommended denial of
the"I-3" zoning.
The Fort Lupton Planning Commission indicated that the heavy
industrial classification conflicts with the kind of development
presently occuring in the southern part of Fort Lupton, as well
as the growth expected to occur toward the subject site in the
future.
Residential growth is occurring -now, and intended to occur in
the future. Given the type of growth that is occurring in this
area, the Fort Lupton Planning Commission and Weld County Planning
staff -propose "I-1" (industrial One) for this property. The
lower zone classification would help establish a visual buffer
between the "I-3" zone districts to the south of this site and
the residential and agricultural growth occurring to the north of
Weld County Road 8.
II. Adequate access to the proposed property is available via Weld County Road 8.
III. The Weld County Health Department indicated, in a letter dated May 12, 1983,

Dear Greg :
The Fort Lupton Planning Commission met in regluar session at
7 : 00 P.M. May 24 , 1983 and considered the request for a change
in zoning from "A" Agricultural to "I-3" Industrial .
Staff recommendation was to deny the request for rezoning due
to conflicts with the Fort Lupton Master Plan and the impact
of industrial development in the area thetween northern Brighton
and southern Fort Lupton. After lengthy discussion a motion
was made seconded and the commission approved a recommendtion
to rezone the parcel north of County Road 8 to Light Commercial
(C-1) and to rezone the trait South of County Road 8 to Light
Industrial (I -1) .
The Fort Lupton Planning Commission is concerned about Industrial
growth along the corridor between Brighton and Fort Lupton and its
impacts on traffic, resid-ental housing and future growth. If you

The Change of Zone is supported by Brighton and Fort Lupton. Both town
growth plans indicate that the subject location is in an area intended
for industrial uses. The access to the site from Weld County Road 8
should be located a minimum of one-hundred-fifty (150) feet from Highway
85 to allow for free flow _of traffic onto and off of the highway. Prior
to the issuance of building permits a geotechnical investigation should
be completed (see Geological Survey letter dated May 18, 1983) . The
availability _of well water may or may not be available to this site. It
depends upon the water needs of the future buyer. It is possible to drill
a -deep (1,000 foot) well into the Laramie-Fox Hills Acquifer. Also, a
shallow tributary well is _possible and would require an augmentation
plan. Development Standards can address -this issue.

II . 1. The subject property lies approximately 2
miles south of Fort Lupton along the Four
Lane 85 Highway and on both sides of Road
8. It is in an area of mixed industrial
and agriculture zoning. Weld County Road
8 would be the access from the four lane
highway and access to the property would be
from County Road 8.
There is a demand for industrial zoned
property in t1.e Fort Lupton area . Many
of the oil ,:ompanies and other firms are
looking for locations in this area.
The rezoning is not believed to be incon-
sistent with either the comprehensive plan
of Weld County or the City of Fort Lupton.
2. The subject property is in an area of
mixed industrial and agriculture zoning.
There are other industrial zoned properties
within the same section and in the general
area.
3. The site is outside of either Fort Lupton.
or Brightons pater and sewer district so
it will be necessary to use a well and
septic system. The property is located
in an area where there is a plentiful supply „
of underground water. A well permit will be
obtained from the state when the exact use
of the property is determined. The sewer
will be a county approved septic system.
4. Access from the four lane highway will be
on to Weld County Road 8, which has a turn-
ing lane and good visibility from both dir-
ections access on to both properties will
be from County Road 8.
5. a. The property is not in a flood zone.
ib. The property is not in a Geologic Hazard
area.
D. The property is not in commercial miner-'
al deposit area.
d. Typical soil in the area is approximately
one foot of topsoil and then gravel all
the way down to bedrock. No problems are
believed to exist with building on the
soil .

We have reviewed the Joe and Tom Sasaki zone change request and find
no conflicts with our interests. However, we do recommend that access to
County Road 8 be located as far away from U.S. Highway 85 -as possible to
allow for a free flow of traffic onto and off the highway.

RE: SASAKI REZONING
We have reviewed the plat and attendant information for the
proposed rezoning. This area is underlain by clay, sand, and
gravel deposits of the Platte River and may be affected by
seasonally shallow groundwater levels . To adequately design
buildings, utilities, and septic systems for these conditions,
we recommend that a geotechnical investigation be completed
on this site prior to development. Additionally, we recommend
that the mineral right owner be advised of the proposed
development.
If this recommendation is followed, we have no objection to
conditional approval of this rezoning.
