RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 178 -
HAROLD C. AND WILMA E. HELZER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has approved
Recorded Exemption No. 178 for Harold C. and Wilma E. Helzer
concerning property described as part of Section 11, Township
6 North, Range 64 West of the 6th Principal Meridian, Weld
County, Colorado, and
WHEREAS, Harold C. & Wilma E. Helzer have requested that
Recorded Exemption No. 178 be amended as follows; Lot A 613 . 83
acres and Lot B 14 . 32 acres, and
WHEREAS, the Board of County Commissioners has studied
said request to amend Recorded Exemption No. 178 and deems
it advisable to approve the amendment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that the hereinabove
amendment to Recorded Exemption No. 178 for Harold C. and
Wilma E. Helzer be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day
of October, A. D. , 1981.

RE: Amendment to RE #178
Dear Commissioners :
The attached application, plat, and related items are in reference to a
request from Harold & Wilma Helzer for an amendment to a recorded exemption.
The parcel of land on which this request has been made is described as part
of Section 11, T6N, R64W of the 6th P.M. , Weld County, Colorado. This
property is located 14 miles west and 11/2 North of Barnsville. The property
contains approximately 628 acres of Class II and III irrigated soils. The
request is to split the property into parcels of 613.84 acres and 14.32
acres .
The Helzer's wish to dispose of 4 additional acres which are of no value
or need to their agricultural operations . Based on submitted information
and policies of the County, the Department of Planning Service's staff
recommends the request be approved for the following reasons:
1. The proposed split conforms with Section 9-2 of the Weld
County Subdivision Regulations (intent clause) , Section
31.1 of the Weld County Zoning Resolution (intent clause
of the Agricultural District) and the Weld County Comprehen-
sive Plan. No land is being removed from production and
the overall density of irrigated agricultural land is being
maintained.
2. Agricultural 'uses will continue to be the primary use and
there would appear to be no encroachment of incompatible
uses to the area (considering existing home sites north
of Weld County Road 32) .
3. The request complies with Section 9-4 A. of the Weld County
Subdivision Regulations .

The planning staff feels that Northern Colorado Feeders should apply
for an amendment to their special use permit. The hog operation is
now using the requested additional ground as effluent ponds which do
not appear as part of the original special use permit.

Re: Recorded Exemption #178; Our Project Number 81-371-01
Honorable Commissioners:
In June of 1975 we applied for and received Recorded Exemption #178. The
circumstances of our farming operation and of the hog operation which located
on Lot B of the Exemption have changed. We find now that it is necessary to
amend the Recorded Exemption for the following reasons:
1 . The owners of Lot B need additional land on which to locate a pond or
ponds which will retain runoff from the hog pens. Presently the runoff
is damaging a portion of our pasture land.
2. We need to regain ownership of a small triangle of land in order to assure
safe and efficient operation of our sprinkler system.
Because we presently have two (2) lots which have had legal uses established
on them in Section 11 , T. 6 N. , R. 64 W. of the 6th PM. , as approved by the
RE, there will be no additional need for water or sewer service to either of
the lots.
We trust that you have sufficient information to consider and act on our request.
If that is not the case, please contact Western Technical Services, Inc. , at
352-5780. They will be representing our interests at your hearing. Thank you

the Board of County Commissioners of the County of Weld, State of Colorado,
having heard the testimony and evidence adduced upon said hearing, having
considered the testimony, evidence, remonstrances and recommendations
of the Weld County Planning Commission filed with said Board, and having
carefully weighed the same, now desires to exempt this particular subdivision
of land, pursuant to its authority under CRS 106-2-33 (d) 1963, as amended.

NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by Harold C. Helzer and Wilma E. Helzer,
husband and wife, of Gill, Colorado, be exempt from the terms "subdivision"
and "subdivided lands" as provided for in the New County Subdivision Regu-
lations at Section 2-1, A. , (3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and

Dear Sirs:
This letter is in reference to a request by Harold C. and Wilma E. Helzer
for a Recorded Exemption on property located in Section 11 , T6N, R64W of
the 6th P. M. , Weld County, Colorado. The desire is to split 10 acres
from the 628.15 acres + for use as a hog operation.
Based on the information submitted and Weld County Regulations, the
Planning staff recommends approval for the following reasons:
1 . The proposed split complies with the intent clause, Section 9-2,
of the Weld County Subdivision Regulations for Recorded Exemption
in that it promotes agricultural use, however, is subject to the
Special Use Permit approval .
2. The proposed split would conform to the Comprehensive Plan in
that it is an agri-business and is located on dry-land. Future
plans indicate a center-pivot sprinkler system on the remainder
of the property, however, the corner would still be a dryland
situation.

North Weld County Water District will deliver domestic water from its distribution
system to the North-East 1/4 of Sec ll-T6 - R64 Weld County Colorado including Lots
A & B of attached Recorded Exemption to The Northern Colorado Feeder Pig Co-Op under
the following conditions.
(1 ) Plant investment fee in effect at time of application will be paid for size of
tap purchased. All rules and regulations of District will apply along with
District rates which apply for size of water tap purchased.
(2) Amount of water to be purchased will be based on 1973 and 1974 average used at
existing tap owned by Northern Colorado Feeder Pig Co-Op in Sec 22-T8 - R66 Weld
County Colorado. Price will be at current price set by North Weld County Water District
Board of Directors for Northern Colorado Water Conservancy District water to be 70%
of A.F. unit.
(3) If volume of water used by Northern Colorado Feeder Pig Co-op at any time of
year should effect pressure of existing customers because of peak usage demands
then a storage system will be installed at Colorado Feeder Pig Co-Op expense and
peak volume usage demands will be taken from storage facility.
