BUTCHER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 23rd day of June, 1982, at the hour of 2 : 00 o' clock p.m. , in the Chambers of the Board for the purpose of hearing the application of High Country Turf - John W. Butcher, 7440 I-25 Frontage Road, Erie, Colorado 80516, for a Use by Special Review for a nursery and landscaping business, on the following described real estate, to-wit: Part of the Southwest quarter of Section 26, Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24. 4.4.2 of the Weld County Zoning Ordi- nance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Plan- ning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance; 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4. 2 of the Weld County Zoning Ordinance as follows : a) The proposal is consistent with the Comprehensive Plan in that policies of the plan promote agribusi- nesses so long as they do not create negative impacts on the environment or the County. No such impacts have been identified with this proposal. The uses permitted on this site shall include the nursery and landscaping business as described in the application materials on file in the Weld County Department of Planning Services. 2. Prior to issuing any building permits for new construction, a Geologic Hazard Overlay District permit shall be required. 3. Design standards for Uses by Special Review, Section 24.5 et. seq. of the Weld County Zoning Ordinance shall be complied with. 4. Operations Standards for Uses by Special Review, Section 24.6 et. seq. of the Weld County Zoning Ordinance shall be complied with. 5. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards stated above and all applicable Weld County Regulations. STATEMENT WHICH EXPLAINS THAT THE PROPOSAL IS CONSISTENT WITH THE WELD COUNTY COMPREHENSIVE PLAN The one hundred seventy nine acre parcel involved in this application is classified as irrigated farm land. The ground is currently serviced by a center pivot irrigation system which covers 120 acres. Applicant has expended considerable time and money to develop additional (corner) areas not currently covered by the pivot sprinkler. An underground pipeline system is to service a proposed nursery growing 1 acreage. The amount of irrigated farm land after the granting of the special use will be the same or more than presently exists on this farm. THE PRIME AGRICULTURAL GROUND will not substantially change as [. a result of this proposed special use. This type of special use is not unique to an agricultural zone or district. There are numerous facilities of this type within a ten mile radius of the proposed site. These similar uses are: THE TREE FARM. This facility is on highway 60 east of Milliken (Weld County) I TANAKA FARMS. This facility is located at the intersection of highway 287 and Lookout road (Boulder County) ITEM 1. b. A STATEMENT WHICH EXPLAINS THAT THE PROPOSAL IS CONSISTENT WITH THE INTENT OF THE DISTRICT IN WHICH THE USE I S LOCATED Applicant has operated a Kentucky Blue Grass sod farm on the proposed special use acreage for the past three years. Applicant plans to develop and eventually plant all of the available irrigated acreage to sod and nursery stock. f -2- it�j t SPECIAL USE PERMIT ITEM 1. b. (continued) it This, of course, is compatible with the existing agricultural district. The landscaping and nursery business is generally broader in scope than simply raising home grown products. The majority of present day nurseries supplement their own products with purchased stock which they inventory and sell . The purchase and subsequent sale of the acquired stock either on a wholesale or retail basis thus does not truly fit the agricultural district. This type of activity normally requires a commercial zone. The nursery and landscaping business is seasonal and the work load under normal conditions requires several employees on certain days and no employees on other days. In order to create a consistent and leven work load we have found it desireable and more efficient to establish work projects to utilize the available help during slack work periods. For example, installation of underground sprinkler systems require engineering design, drafting of bids, fabrication of plumbing manifolds, fabrication of valve boxes, and the like. ir The designs and bids can be completed in the office and the materials fabricated in a shop rather than in the field. Additionally, sod farms and nurseries require considerable quantiites of shipping cont- ainers and/or shipping pallets. These containers may be bade from -3- SPECIAL USE PERMIT ( ITEM 1. b. (continued) wood or corrugate paper and the fabrication and/or repair of these related products requires facilities such as a work shop. This type of activity is in the nature of light indursrial rather than agircultural . In summary, the special use permit would be roughly 9CG agricultural ( and carry with it the freedom for limited commercial and light industrial activities. These acitvities would be appurtenent to the allowed present agricultural zone.If The basic concept with this special use is that none of the land currently in production as irrigated farm land would be removed from production. The requested special use will not in any noticeable way change V the present levels of noise, dust, pollution, or errosion. Applicant has conducted a sod farm business on the subject ground for a period Iof three years without a single problem with changing traffic patterns or changing requirements for police protection, for fire protection, for water service, school bus service, telephone service, or any other governmental service. ll The turf farm activities has not, in any way, effected any of 1 the neighbors and/or their respective farms. (continued) The acreage is one and one-half miles west of the town of Frederick and is certainly within the growth pattern of either Frederick or Firestone. The proposed special use is certainly compatible with logical growth and expansion of either of these two communities. It is normal for truck farms, turf farms, nurseries and the like to locate their production as well as their sales facilities near corporate city limits. Under normal growth patterns these farms tend to preserve the ground in the best and highest use of the Iagricultural district until such time as the farms actually become prime development ground. An additional factor in the present case is that a mine existed under a major portion of the farm thus development of the acreage for purposes other than agricultural is not very likely. The special use would not present a conflict with proper develop- ment even if the land formed part of the corporate limits of Frederick or Firestone. LITEM 1 . e. A STATEMENT WHICH EXPLAINS THAT THE APPLICATION COMPLIES WITH THE WELD COUNTY ZONING ORDINANCE, SECTION 50, OVERLAY DISTRICT REGULATIONS IF THE PROPOSAL IS LOCATED WITHIN ANY OVERLAY DISTRICT !- AREA IDENTIFIED BY MAPS OFFICIALLY ADOPTED BY WELD COUNTY. -6- SPECIAL USE PERMIT l ( ITEM 1. e. (continued) (I 1 A substantial portion of the ground involved in the special use permit was at one time encompassed by a relatively shallow coal mine. The use does not require new construction or development of surface or 1 subsurface structures particularly in the areas heretofor mined. The Ispecial use envisions utilizing existing structures and not constructing additional structures The area is not subject to flood hazards. A private airport is located about one mile from the present structures and no high structures are contemplated which would present a conflict or problem with the private airstrip. I ITEM 1. f. The employees will not be exposed to l (v, dangerous working conditions or unhealthy enviornmental conditions. This type of business does not require additional police or fire protection. The area is protected by an existing fire district. The Weld county sheriff provides police protection. The proposed use will not Ichange the existing school service requirements. The surrounding road system will not need additional maintenance. The tri-county ambulance Iwill not need additional funds or equipment to service the area. In summary, adequate provisions currently exist in the area to i adequately protect the health, safety, and welfare of the inhabitants I- of the neighborhood and the county. I li • SPECIAL USE PERMIT ( ITEM 5 DETAILED DESCRIPTION OF THE PROPOSED OPERATION AND USE It The acreage presently under the existing pivot irrigation system will be used to raise sod and nursery stock. Applicant plans to expand and enlarge its turf and sprinkler business to include retail office and showroom facilities to handle (L sales of sod, landscaping services, yard and lawn maintenance services, sales of nursery stock, fencing material , retaining walls, planters, sprinkl rs, plastic pipe, valves, pumps, plumbing manifolds for irriga- tion and sprinkler systems, fertilizers, soils conditioners, and miscellaneous items for lawn, garden, and home improvement. The special use will include business office facilities to handle ( engineering designs, bidding, billing and other necessary facilities such as rest rooms and the like. Shop facilities will be used to repair and build pallets, containers and decorative home improvement items. Applicant does not contemplate the need for large stockpiles, storage areas, or waste areas over and above those presently used in the turf farm activity. Applicant normally removes debris, junk and waste at regular intervals and such material is disposed of at the Longmont or Erie landfills.
