RE: APPROVAL OF RENEWAL LEASE WITH THE UNION PACIFIC RAILROAD
COMPANY CONCERNING PROPERTY LOCATED AT AULT, COLORADO.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a Renewal Rider between Weld County, Colorado and
the Union Pacific Railroad Company has been presented to the
Board of County Commissioners of Weld County, Colorado, and
WHEREAS, said Renewal Rider concerns the leasing of a site
for the storage and mixing of road repair material, and
WHEREAS , the term of said Renewal Rider is from December 1,
1979 through November 30, 1984 , and
WHEREAS, the rental rate for said site at Ault, Colorado
is $200. 00 per year.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Renewal Rider
between Weld County, Colorado and the Union Pacific Railroad
Company concerning property located in Ault, Colorado be, and
hereby is, approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 28th day of
January, A.D. , 1980 .

RESOLUTION
,' WHEREAS, the UNION PACIFIC RAILROAD COMPANY has
tendered to the COUNTY OF WELD, State of Colorado, an agree-
( ment extending to and including November 30, 1984, the term
; of that certain lease dated December 1 , 1948, as extended ,
whereby the Railroad Company leased to the County of Weld,
;. State of Colorado , a portion of its right of way at Ault,
, Weld County, Colorado, for storage and mixing of road repair
' material ; and

li WHEREAS, the Board of County Commissioners of
Weld County, Colorado has said proposed agree-
ment before it and has, given it careful review and consider-
ation; and
WHEREAS, it is considered that the best interests
of said County of Weld , State of Colorado
iwi1l be subserved by the acceptance of said agreement;
THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF WELD COUNTY , COLORADO:
That the terms of the agreement submitted by Union
Pacific Railroad Company as aforesaid be and the same hereby
are accepted in behalf of Weld County, Colorado

ers of said County hereby is authorized, empowered and I
direc-
ted to execute said agreement on behalf of said County, and
that the County Clerk hereby is authorized and directed to at-

IT IS HEREBY MUTUALLY AGREED by and between the present parties to the above-named agreement
that said agreement. which by this reference is made a art hereo is hereby a ted by said parties as their agree-
ment for a term beginning December 1, , 19 , and extending to and including
November 30. , 19 84 ; and that all the terms and conditions of said agreement, as
heretofore or herein supplemented and/or amended, shall have the same force and effect and be as binding upon the
parties hereto during said term as if the same were repeated herein; said agreement with the supplements and/or
amendments (if any) to be subject to termination prior to the expiration of the term herein named in the same
manner as is provided therein for termination prior to the expiration of the term thereof.
Special Provisions: Effective December 1 , 1979 , the Lessee shall pay to the
Lessor rental at the rate of Two Hundred Dollars ($200.00) per annum,
payable annually in advance, in lieu of the rental heretofore stipulated .

Gentlemen:
This refers to lease L.D. No. M-43465, Audit No.
A-65330, Division No. 9155 in favor of the County of Weld covering
lease of site for storage and mixing of road repair material
at Ault, Colorado which expired by its own terms November 30,
1979 .
Attached herewith is rider designed to extend this
lease for a further term of 5 Years. This rider also provides
for a rental increase to be in line with present-day values
and other leases presently in effect in this area.
Please execute all documents in the space provided
and return both copies to me for similar action on behalf of
the Railroad Company.
