WHEREAS, Section 8 . 2 and 8 . 3 of the Weld County Zoning Resolu- tion authorizes the Board of County Couuuissioners to grant a change of zone upon the showing by the petitioner of certain facts, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Plan- ning Commission, and having been fully informed, is satisfied that the request for re-zoning complies with the Weld County Com- prehensive Plan and the conditions set out in Section 8 . 2 and 8. 3 of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the petition of Stanley Bedan for a change of zone from A-Agricultural Zone District to I-Industrial Zone District on the above described tract of land be, and hereby is, granted. BE IT FURTHER RESOLVED by the Board of County Commissioners that the reasons for approval contained in the Weld County Plan- ting Commission recommendations dated June 17 , 1980 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. The parcel of land on which this request has been madeis described as part of the NW4, Section 6, T4N, R65W of the 6th p.m. , Weld County, Colorado. This property is located at 420 South 2nd Street, La Salle, adjacent to the south edge of the town of La Salle. The property contains -approximately 1.04 acres of Class IV nonirrigated soils. The request is to split the property into parcels of 0.37 acres and -0.67 acres. Mr. and Mrs. Bedan have applied for a change of zone request from "A" Agricultural to "I" Industrial in order that they may have a painting shop an the property. They wish to divide the property into two parcels so that they may separate the paint shop from the residence. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the re- quest be approved for the following reasons: 1. The request is in compliance with the policies of the Weld County Comprehensive Plan in that to minimize conflicting land uses, residential development will be encouraged to locate adjacent to existing towns. This parcel of land is located within the comprehensive plan of the town of La Salle. The town of La Salle has no objections to this requestfor a recorded exemption. 2. The request is in compliance with the intent clause of the recorded exemption procedure (Sc ro�1 9-2 of the Weld County Subdivision Regulations) . The -xe 4acrek' " use of this parcel is in compliance with the intent Clause of the recorded exemption procedure because said parcel contains nonproductive agricultural lands located adjacent to an existing town. This site was recently considered for a change -in zoning from agricultural to industrial . Our comments on the zone change primarily addressed the traffic impacts on U.S. Highway 85 and at the service road access to the highway. While this exemption request appears to present less potential for increased traffic movements , any increase in commercial activity will lead to increased left and right turns onto a service road at an intersection which was not built to accommodate high volumes of traffic. We -again would bring to your attention the need to consider the impacts of increased surface runoff which may be directed toward the highway and the need to obtain authorization for any work which affects the service road.
