RE: APPROVAL OF KEEMC REPLAT OF LOTS 1 AND 2 , UNION COLONY SUB-
DIVISION
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , a Replat of Lots 1 and 2 , Union Colony Subdivision,
to be known as Keemc Subdivision, located in the SWa SEa , Sec-
tion 10 , Township 5 North, Range 65 West of the 6th P .M. , Weld
County, Colorado, has been submitted to the Board of County Com-
missioners for approval in accordance with the Weld County Sub-
division Regulations , and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, and
WHEREAS , the Board of County Commissioners has studied the
request and the recommendations of the Weld County Planning Com-
mission and finds that said Replat should be approved subject to
the applicants complying with the conditions listed below prior
to recording the Replat:
1 . Revision of the Replat showing a reservation of twenty
(20) feet of additional right-of-way along the north
side of U.S. Highway 34 for a total of fifty (50) feet
from centerline.
2. Revision of the Replat showing a reservation of ten
(10) feet of additional right-of-way along the south
side of East 18th Street for a total of forty (40) feet
from centerline.
3. Construction of a one hour firewall between existing
buildings on Lots 2 and 5 which would meet Weld County
Building Code.
4 . Revision of the Replat showing a twenty (20) foot pri-
vate access easement to U .S. Highway 34 , fifty (50)
feet north of the two existing residences located on
the eastern boundary of Keemc Subdivision.
5. Vacation of all street associated with the Kramme
Subdivision (1955) by the Board of County Commissioners.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the Replat of Lots 1
and 2 , Union Colony Subdivision, to be known as Keemc Subdivision,
located in the SW4 SEa , Section 10 , Township 5 North, Range 65
West of the 6th P.M. , Weld County, Colorado, be, and hereby is,
approved subject to the conditions as set forth above.

POSSIBLE ISSUES SUMMARIZED FROM APPLICATION MATERIALS:
The criteria for review is listed on pages 34, 35 37 and 38 of the
Weld County Subdivision Regulation (see Sections 6-4 C, 6-4 D and 6-3 B) .
Review of a Replat is conducted the same way as a review of a Final Flat.
A copy of the review criteria has been included in your information packet.
The Utility Board Coordinating Committee reviewed and approved the
Replat on June 28, 1984.
The City of Greeley has reviewed the Replat and has made several
suggestions concerning the right-of-way and access points on Highway 34
and East 18th Street, and construction of a one hour firewall between
Lots 2 and 5. Both the City of Greeley and the Weld County Engineering
Department have voiced concern over the access problem for two residences
located east of this proposal.
The Department of Planning Services has received several phone calls
inquiring about this case; no objections have been raised concerning this
proposal.

6-3 Review Procedures - Final Plat
A. When a Final Plat has been received it shall be acted upon by the
Planning Commission at a meeting scheduled for subdivision
review, within sixty (60) days or another mutually agreed upon,
period of time.
•
B. County Planning Commission Review •
(1) The Planning Commission shall review the Final Plat at a
regularly scheduled public meeting. The Planning Commission
may require or recommend changes or modifications to the
Final Plat in the public interest. If the Final Plat and
all supplementary data comply with the applicable
requirements of these regulations, the Planning Commission
shall endorse on the plat in the space provided.

notification of its Review to the Board. Required and
recommended modifications to the Final Plat, if any, shall
be noted on three (3) prints of the plat; one copy to be
transmitted to the Board, one copy to be retained in the
Planning Commission files, and one copy to be transmitted to
the subdivider.
(3) The only basis for rejection of a Final Plat shall be its
nonconformance to adopted rules, regulations and
resolutions currently in force and affecting the land and
its development in the county, its lack of conformance with
approved Preliminary Plan, and changes required in the
public interest.
(4) Notice of the time, date and place of the Planning
Commission Hearing shall he sent to owner(s) of property of
the surface estate within five hundred (500) feet of the
property under consideration. The source of the ownership
information will be from the submitted list required in
Section 6-2 P. Such notification shall he mailed, first
class, not less than ten (10) days before the scheduled
hearing. Such notice is not required by Colorado State
Statute and is provided as a courtesy to surrounding
property owners. Inadvertent errors by the applicant in
supplying such list or in sending such notice shall not
create a jurisdictional defect in the hearing process even
if such error results in the failure of a surrounding
property owner to receive such notification.

(5) Notice of the time, date and place of the Planning
Commission Hearing shall he sent to owners and lessees of
the mineral estate on or under the subject property. The
source of the ownership information will be from the
submitted. list required in Section 6-2 Q. Such notification
•

shall be mailed, registered mail, not less than ten (10)
days before the scheduled hearing.
(6) A dopy of the Final Plat tiled with the Planning Department
shall be available for public viewing. Any affected person
may submit verbal or written comments to the Planning
Commission regarding the Final Plat , stating the reasons for
4 their support or objections to the Final Plat pursuant to
these regulations, on or before the date of the Planning
Commission Hearing.
C. Board Hearing
The Board shall hold a hearing on the final Plat within ten (10)
A days of receipt of transmittal from the Planning Commission at a
regularly scheduled public board meeting. The Board shall also
consider the modifications recommended by the Planning
Commission. If the Board determines that the Final Plat
submission and the recommended modifications complies with the
applicable requirements of these regulations, they shall endorse
j 1 on the Plat in the space provided.
D. The subdivider shall provide the Planner with an adequate number
i of the approved plats or prints marked for modification, together
with the official notification of the action to be distributed by
the Planner as follows:
•
(1) One copy to Planning Commission files
(2) One copy to Board files
(3) One copy to Subdivider ,
1 (4) One copy to Engineer and/or Surveyor of the subdivision
(5) One copy to Colorado Land Use Commission together with
supporting materials submitted pursuant to Section 6-2
'i (6) One copy each to Utility Companies serving the Subdivision
E. Recording Final Plat
(1) The Planner shall record the Final Plat with the County
Clerk and Recorder within five (5) working days of approval
of the Final Plat by the Board.
(2) The County Clerk and Recorder shall furnish the subdivider
with a receipt for the Final Plat upon filing of the Final
Plat.

(b) In the event that a utility easement is affected, the
Department of Planning Services shall first place the •
matter for review on the first available Utilities
Review Advisory Committee meeting before presenting the
request to the Planning Commission.
(c) The Board shall review the request within ten (10) days
of the Planning Commission action. If the Board
determines the request complies with the applicable
requirements of those regulations, they shall endorse
on the plat in the space provided.
(d) The map shall be recorded as provided in Section 6-3E
of these Subdivision Regulations.
G - I C. Requests for resubdivision for the purpose of redesign, addition
of new lots , or vacation of all or portions of a subdivision
to "ub ect to resubdiv isior requir :::ent,s c,=
the 6-4D below. These revisions shall be submitted to the
Planning Commission and Board of County Commissioners tor their
review. The request shall be reviewed in accordance with
Section 6-3 of these regulations.
G - 1 D. The applicant shall submit to the Office of the Department of
Planning Services the following items with the appropriate fee
for a request for a resubdivision or vacation in the
unincorporated area of Weld County, Colorado: •
(1) An application form as prescribed and furnished by the
Department of Planning Services.
(2) A copy of a deed, purchase contract, or other legal
instrument indicating that the applicant has interest in
said property. The deed, purchase contract, or legal •
instrument should include a complete and accurate legal
description of the property.
(3) 12 copies of a plat showing the existing lot divisions and
the proposed lot changes in accordance with the Final Plat
drawing requirements of Section 6. 1 .B. of the Subdivision
Regulations.
(4) A Utility Service Statement with signatures of
representatives of each municipality or utility company
involved to verify that existing and proposed easement
designs are adequate for the respective utilities.
(5) A letter of explanation detailing the situation indicating
the reason(s) why the request for the resubdivision or
vacation has been made. The letter should address the
revisions or vacation being requested as compared to the
previously recorded plat.

(6) One copy of the existing recorded plat of the subdivision
shall be provided for comparison purposes.
(7) A certified list of the names, addresses and the
corresponding Parcel Identification Number assigned by the ,
Weld County Assessor of the owners of property (the surface
estate) within five hundred (500) feet of the property
subject to the application. The source of such list shall
be the records of the Weld County Assessor, or an ownership
update from a title or abstract company or attorney, derived
from such records, or from the records of the Weld County
Clerk and Recorder. If the list was assembled from the
records of the Weld County Assessor, the applicant shall. r
certify that such list was assembled within thirty (30) days
of the application submission date. Such notice is not
required by Colorado State Statute and is provided as a
courtesy to surrounding property owners. Inadvertent errors F
by the applicant in supplying such list in sending such
notice shall not create a jurisdictional detect in the
hearing process even if such error results in the failure of
a surrounding property owner to receive such notification.
(8) A certified list of the names and addresses of mineral
owners and lessees of mineral owners having an interest in
the property which is the subject of the application. The
list shall reflect the names of these owners and lessees as
they appear on the plats or records in the County Clerk and
Recorder's Office and as their most recent addresses may
appear in the telephone directory or other directory of
general use in the area of the property or on the tax
records of the County.
(9) Any other information determined to he necessary by the
Department of Planning Services that will aid in helping the
Planning Commission and. the Board of County Commissioners
make a decision.

COMMENTS:
Subject site is a 3.71 acre triangular parcel which is zoned Commercial-Three (c-3) . It
is bordered on the north by East 18th Street and on the south by Highway 34. This
parcel is 50% developed; the remainder of the site is an open area parking lot.
Improvements on the site include a former motel (now converted to apartment
kitchenettes) , a restaurant, a single family residence, garage, and a mobile home. At
least 3 access points are present off of Highway 34 and 2 access points from East 18th
Street serve this parcel.

The Weld County Planning Commission will conduct a public hearing on

The Greeley Planning Commission at its June 24 , 198'1 , meeting reviewed
the referral on the Keemac Subdivision . The Commission recommended no
objections subject to the following :
1 . Dedication of 20 feet of additional right-of-way along the north
side of U. S. 34 Rusiness and reduction of accesses from three to
two ;
2. Dedication of 10 feet of additional right-of-way along the south
side of Fast 19th Street and consolidation of accesses to two
points along East 18th Street ;
3. Provision of a one hour fire wall on the east side of the
apartments ( motel) and on the west side of the restaurant ; and
4 . Resolution of the access issue by the County for the two existing
residences located immediately east of this subdivision prior to
final plat approval .

Dear Mr. Mullen:
We have reviewed the KEEMC Subdivision Replat and ask for your consideration
of the following comments.
1 . Projected traffic on State Highway 34 indicates the need for a 150-foot
total right of way, 75 feet each side of the highway centerline. We
would normally ask that additional width to meet this need be protected
by setback, reservation, or (preferably) dedication as permitted by
local regulations. This width assumes that highway drainage would
need to be carried in a borrow ditch system.
However, in recognition of the potential urbanization in this area,
a minimum 100-foot right of way, 50 feet each side of the centerline,
would be acceptable. This width is based upon the concept that,
eventually, highway drainage will be carried in a curb and gutter system
rather than a borrow ditch. Additional width to achieve the necessary
50-foot width from the centerline should be provided as above.
2. This subdivision has three existing access points on S.H. 34. We
recommend the reduction of the number of accesses on the highway if
at all possible, preferably through shared use of no more than two
access points. If this will involve the relocation or reconstruction
of any existing driveways, an Access Permit is required. Application
for this permit is made to this office at the above address.
It is our understanding that future commercial development may occur
on Lot 4, which has an existing access that is being used by residential
property to the east. Any change in use or operation of this driveway
will also require an Access Permit.

Subject: Keemac Subdivision (Replat) Referral
We have reviewed the Keemac Subdivision Replat Application and have concerns
about the two homes along the east side of the subdivision. The 1955 plat
of the Kramme Subdivision dedicated a 30' wide road to the public along the
east side of the property ( Kramme Drive) . Two residences have subsequently
been constructed which use this road area for access . The original Kramme
Subdivision was then vacated in 1964. However, we find no record of the
Commissioners vacating the public streets . The owners of the adjacent homes
use this originally dedicated property (Kramme Drive) to this date. The
Proposed replat would force relocation of these access noints , possibly at

Subject: S-235:84:7, Keemac Subdivision
Lots 1 and 5 may have problems siting adequate individual sewage disposal
systems. Absorption fields are subject to 10-foot sitbacks from property
lines and 20-foot separation from buildings. In addition, the fields must
not be under driveways or asphalt.
All septic systems for commercial development are required to include
an engineer's soils evaluation and the systems must meet Weld County
I.5.D.S. regulations.
