RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 193 - CHARLES KIRBY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has reviewed the
request of Charles Kirby for an exemption from the definitions of
"subdivision" and "subdivided land" in Section 30-28-101 (10) (d) ,
CRS 1973, as amended, and Section 2-1 A. (3) of the Weld County
Subdivision Regulations, and
WHEREAS, the Board of County Commissioners finds that William
Kirby is the owner of a certain parcel of land located in part
of the N4 NE4, Section 17, T6N, R67W of the 6th P.M. , Weld County,
Colorado, and
WHEREAS, Charles Kirby desires to separate a parcel of
ground adjacent to property owned by John Kelly from the remainder
of the property for sale purposes, with said parcels being more
particularly described as follows:

part of the North Half of the Northeast Quar-
ter (N# NE4) of Section Seventeen (17) , Town-

A parcel of land located in the Northeast
Quarter (NE4) of the Northeast Quarter (NE4)

east corner of said Section 17 and proceeding
on an assumed bearing of due South along the
East line of said Section 17, of which all
bearings described herein are relative there-

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the above described
parcels be, and hereby are, declared to be exempt from the defi-
nitions of "subdivision" and "subdivided land" as set forth in
Section 30-28-101 (10) , CRS 1973, as amended, and Section 2-1 A. (3)
of the Weld County Subdivision Regulations.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 10th day of

COMMENTS:
The Kirby property is a combination of a cattle feedlot, irrigated pasture, and

set of corrals, six (6) outbuildings, and silos. The storage of farm equipment is also
included on the property. The land is relatively flat and it has access to Colorado
Highway 257.

Gentlemen:
Attached to this letter please find an Application for a Subdivision
Exemption, check in the amount of $35.00 for your application fee, Plat of
Survey, copy of the Deed showing current ownership, letter concerning water
service, and legal descriptions for the property being exempted (the subject of
this request) and copy of legal description for new parcel being created (the
parcel the subject of this subdivision exemption request plus existing parcel
identified as "A" on Plat of survey).
This Subdivision Exemption request is presented by Charles W. Kirby as he
is the land owner of the property under review, but it is also joined by Mr. and
Mrs. John Kelly, who own Parcel A, as identified on the Plat of Survey. Mr.
and Mrs. Kelly, who currently own Parcel A are desirous of expanding their
acreage to the west and Mr. Kirby is willing to sell the 1.74 acres to Mr. and
Mrs. Kelly for several reasons. You will note that the western boundary of the
property, the subject of this request, is on an angle. That angle is created by
an irrigation ditch, and the existing property parcel of 1.742 acres is very
awkward to farm due to its small size. The small size and shape of the parcel
makes it ideal for the Kellys to enlarge their acreage in light of the fact that
they would like to use it for pasture and grazing purposes. As the property
which is the subject of this application and parcel A will be combined, there is
no increase in density or new home construction, and therefore this request
complies with the subdivison exemption guidelines. Additionally, the property is
consistent with the Weld County Comprehensive Plan for rural residential
acreages, and most of the surrounding land use is also rural residential, thereby
making it consistent and compatible with the goals of Weld County.
At the present time there is no structure located on the property, the
subject of this exemption, and the Kellys have indicated that they have no plans
for construction at the present time; however, they may construct, at a later
date, a pole barn or similar structure for stalling one or two horses.
Again, this Subdivision Exemption should be granted as it does not result

in the creation of a new residential or permanent building site and does
intelligently and conveniently adjust property lines between two contiguous
parcels.
