HomeMy WebLinkAbout830994.tiff RESOLUTION RE: APPROVAL OF LEASE AGREEMENT BETWEEN WELD COUNTY, COLORADO AND DOROTHY F. ERICKSON FOR MAINTENANCE SHED AND MOBILE HOME PAD AND AUTHORIZATION FOR CHAIRMAN TO SIGN SAME WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Weld County desires to lease a certain parcel of land from Dorothy F. Erickson for the purpose of having a main- tenance shed and mobile home pad on said parcel, and WHEREAS, said parcel is more particularly described as follows: A parcel of land located in the South Half (S1) of Section Twenty-nine (29) , Township Eleven (11) North, Range Sixty-three (63) West of the Sixth Principal Meridian, Weld County, Colorado, containing approximately one (1) acre, more or less , and adjacent to County Road No. 124 WHEREAS, the Board has been presented with a lease agree- ment between Weld County, Colorado and Dorothy F. Erickson, and WHEREAS , the lease shall be from March 24 , 1983 , to March 24 , 1993 , at a total rental fee of $1 ,200 , and WHEREAS , the further terms are as stated in the lease agree- ment, a copy of which is attached hereto and incorporated herein by reference, and WHEREAS , the Board deems it advisable to approve said lease agreement. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the lease agreement between Weld County, Colorado and Dorothy F. Erickson to have a maintenance shed and mobile home pad on the above described parcel of land be, and hereby is , approved. ERICKSON, the Lessor, and WELD COUNTY, COLORADO, the Lessee, WITNESSET H: That in consideration of the payment of the rent and the keeping and performance of the covenants and agreements by the said Lessee hereinafter set forth, the said Lessors hereby lease unto the said Lessee the following described premises, situate in the County of Weld, State of Colorado, to wit: A parcel of land located in the South Half (S1) of Section Twenty-nine (29) , Township Eleven (11) North, Range Sixty-three (63) West of the Sixth Principal Meridian, Weld County, Colorado, containing approximately one (1) acre, more or less, and adjacent to County Road No. 124. TO HAVE AND TO HOLD the same and any and all appurtenances unto the said Lessee from twelve o'clock noon of the 24th day of March, A.D. 1983, nunc pro tunc until twelve o'clock noon of the 24th day of March, A.D. 1993, at and for a rental, for the full term aforesaid, of One-thousand Two-hundred Dollars ($1,200) , which rental shall be paid in installments as follows: One-hundred and twenty Dollars ($120.00) , being the full rental for the first year of said term, upon the signing hereof, and One-hundred and twenty Dollars ($120.00) on or before the 24th day of March of each year thereafter during the full term of this lease. Lessee, having erected a maintenance building and mobile home pad on said plot for use by Lessee for equipment, machinery, and housing, shall have the right at the expiration of this lease to remove said building. It is understood and agreed by and between the parties that said premises are being leased by said Lessee as quarters for its road maintenance man or men and shall be occupied by any person or persons so employed at the election of said Lessee and that such person or persons shall have continuous and uninterrupted right of access to said property and to make such roads, fills, or crossings as shall be deemed necessary for the purposes of its use. In the 1 event the current road maintenance man terminates employment and continues to reside on the site at the option of the Lessor, the Lessee can erect a mobile home trailer pad with utilities, water well, and septic system at the Lessee's cost on the site complying with all zoning and building regulations and shall pay an additional Twenty Dollars ($20.00) per month for the remainder of the lease period for the additional home trailer site. THIS AGREEMENT shall be binding upon the heirs, administrators, and assigns of said Lessors.
