RE: GRANT MOBILE HOME PERMIT NO. 776 - JAMES E. EVERETT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , James E. Everett was previously granted a Zoning
Permit for a Mobile Home to be used as a temporary dwelling
during construction of a permanent residence, and
WHEREAS, due to financial reasons the applicant has not
been able to construct a permanent residence, and
WHEREAS , James E. Everett has now submitted a request for
a Zoning Permit for a Mobile Home to be used as a principal
dwelling, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado did, on the 7th day of September, 1983 , consider the
request of James E. Everett to place a mobile home to be used
as a principal dwelling, and to be occupied in an A-Agricultural
Zone District, on a parcel of land more particularly described
as follows:
Lot 5 , Block 2 , JoAnn Subdivision,
Weld County, Colorado
WHEREAS, the Board of County Commissioners , having heard
the testimony, finds that said request should be granted sub-
ject to the following conditions:
1 . The applicant be allowed a period of three (3)
years to construct the permanent dwelling unit;
2. This Mobile Home Zoning Permit shall not be
transferable to any successors and interests
to the Zoning Permit as a principal dwelling
shall expire automatically upon conveyance or
lease of the property;
3. This permit shall be reviewed annually on the
anniversary of the permit' s issuance. The Board
shall review the progress of the construction
of the permanent dwelling unit to determine if
construction is being diligently pursued. Failure
to construct a permanent dwelling unit may be
cause for revocation of the Zoning Permit for
the Mobile Home.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the request of James
E. Everett to place a mobile home to be used as a principal
dwelling on the hereinabove described parcel of land, which was
found to be in compliance with the Weld County Zoning Ordinance,
Section 43 , be, and hereby is , granted subject to the conditions
as above listed.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 7th day of
September, A.D. , 1983.

Location: approximately one mile northwest of Lochbuie; north of Weld County Road 4
and east of Bailey Street
The Department of Planning Services staff has reviewed this request and recommends that
the request be approved for the reasons :

COMMENTS:
On August 26, 1982, Mr. and Mrs. Everett applied for a Zoning Permit for a Mobile
Home to be used temporarily during construction of a permanent residence. Because
Mr. Everett has not been able to find a job for the past several months he has not
been able to commence building his permanent dwelling unit. The Everetts are now
requesting a zoning permit fora mobile home to be used as a principal dwelling.
They have expressed to me, several times, that they still have every intention of
building their principal dwelling unit once their economic situation improves.
The Department of Planning Services has received both objections and support regard-
ing this application. (Please see enclosed letters.)
The Department of Planning Services staff recommendation for approval is conditional
upon the following:
1. The Board of County Commissioners setting a reasonable period of time
that will allow the Everetts to construct their permanent dewlling
unit. The staff would recomment that this time period not exceed
three (3) years;
2. The mobile home zoning permit shall not be transferable to any successors
and interests to the zoning permit as a principal dwelling shall expire
automatically upon conveyance or lease of the property;

3. This permit shall be subject to review annually on the anniversary
of the permit's issuance. The Board shall review the progress of
the construction of the permanent dwelling unit to determine if

On behalf of the Everett family we wish to support their
above request.
It is our understanding that the Everetts fully intend to
build a permanent home but due the economic crisis of Mr.
Everett being out of work, they are unable to build at
this time.
We see the fact tl'at several residents in this area signed
letters of opposition to the Everett' s request as an
unfortunate circumstance.
