RE: AUTHORIZATION FOR CHAIRMAN TO SIGN LEGAL DOCUMENTS WHICH
CORRECT LEGAL DESCRIPTION ERROR CONCERNING THE JOHN L.
MOSER PROPERTY.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners has been informed

that an error in the legal description concerning the John L.
Moser property has been made, and
WHEREAS, a new legal description has been prepared concern-
r
ing said property, and
WHEREAS, the Board deems it advisable to authorize the chair-
man to sign all legal documents which correct the legal description
error concerning said property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Chairman of the
Board of County Commissioners be, and hereby is , authorized to
sign all legal documents which correct the legal description
error concerning the John L. Moser property.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
April, A.D. , 1980.

(INTESTATE ESTATE)
THIS DEED is made by DONNA R. MOSER, as Personal Representative of
the Estate of JOHN LEE MOSER, also known as JOHN L. MOSER, Deceased,
Grantor, to WELD COUNTY, a Political Subdivision of the State of Colorado,
Grantee, whose address is 915 - 10th Street, Greeley, Colorado 80631 .
WHEREAS, JOHN LEE MOSER, also known as JOHN L. MOSER, died intestate
at Fort Collins, Larimer County, Colorado, on October 17, 1979; and
WHEREAS, Grantor was duly appointed Personal Representative of said
Estate by the District Court in and for the County of Weld, and State of
Colorado, Probate No. 79 PR 240, on October 26, 1979, and is now qualified
and acting in said capacity:
NOW, THEREFORE, pursuant to the powers conferred upon Grantor by
the Colorado Probate Code, Grantor does hereby sell , convey, assign,
transfer, and set over unto Grantee , for and in consideration of the sum
of Ten Dollars ($10) and other good and valuable consideration, the
following described real property situate in the County of Weld, State
of Colorado:
All that part of that certain tract of land described in
Book 1444, at page 386, of the Weld County Records, and located
in the Southwest Quarter (SWa) of Section Thirty-three (33) ,

the Sixth (6th) P.M. , in Weld County, Colorado, more particularly
described as follows :
BEGINNING at a point on the right-of-way line on the East side
of the road running North and South along the West side of

of the Mosier-Williams Ditch,

Gentlemen:
You have explained to us the necessity for acquiring the following des-
cribed land which belongs to us for the purpose of improving or straightening
the County Road running North from Johnstown.
We are willing and hereby offer to sell and convey the following des-
cribed property to Weld County:
That parcel of land situated in the Southwest Quarter (SW*)
of Section Thirty-three (33), Township Five (5) North, Range
Sixty-seven (67) West of the Sixth Principal Meridian, in Weld
County, Colorado, more particularly described as follows:
Beginning at the Southwest corner of said Section 33; thence North
on the West line of Section 33 for a distance of 1242 feet to the
West line of The Great Western Railway Company's right of way;
thence Southerly 40 feet from and parallel to the center line of
said Railway for a distance of 1419 feet to the South line of said
Section 33; thence West on the South Section line 400 feet to the
place of beginning, containing 6.80 acres by actual measurement;
also, all water and water rights, lateral and lateral rights appur-
tenant to said land, and especially 1/10 of 1 share of the capital
stock of the Consolidated Hillsboro Ditch Company,
upon the following terms and conditions:

You will pay us the sum of Seven Thousand Two Hundred Fifty 'Dol1srs,
and we will furnish aiefibstract of title showing good and merchantable title
in us and will make, execute and deliver to Weld County a proper deed of con-
veyance together with assignments of said water stock. We will pay all
taxes on said premises, including the taxes for the year 1955 payable in
1956. All buildings, improvements and fixtures now on said land shall pass
with it to said County.
It is understood that this property is subject to whatever rights sub-
sist under an agreement pertaining to a seep ditch, recorded in Book 513, at
page 428 of the Weld County Records, and to its inclusion within Northern
Colorado Water Conservancy District and Johnstown Fire Protection District,
and to an Oil and Gas Lease recorded in Book 1334, at page 281 of said
Records and assignments thereof.
It is further understood that you shall pay whatever amounts remain due
to The Greeley National Bank on account of the stoker and furnace equipment
installed in the house on said premises and shall deduct the same amount from
any money or moneys due or to become due to us, and shall likewise pay to
A. V. Anderson, or his assigns, all moneys due under that certain note
secured by deed of trust recorded in Book 1404, at page 382 of said Weld
County Records.
It is further understood and agreed that we shall reserve to ourselves.
from said conveyance an undivided one-half interest in and to any oil, gas
or minerals in or under said property.

• We will surrender possession of said premises immediately upon the
payment of the purchase price.
All expenses of clearing title and closing this transaction properly
chargeable to us shall be deducted from the payment to made to us.
If this proposal is satisfactory to you, you will indicate your
acceptance thereof by endorsement hereon within five days from the date
hereof.

STRAIGHTEN AND IMPROVE COUNTY ROAD #455, RUNNING NORTH
FROM JOHNST OWN, COLORADO:
Commissioner Shultz offered the following resolution and moved its adoption:
WHEREAS, due to the demand for straightening and improving County Road #455,
running North from Johnstown, Colorado, it is imperative to acquire land for that pur-
pose, and
WHEREAS, Robert L. and Anna M. Smith have offered to sell to the County the
following described property:
That parcel of land situated in the Southwest Quarter (Sa'd4) of Section Thirty-
three (33) , Township Five (5) North, Range Sixty-seven (67) West of the Sixth Principal
Meridian, in Weld County, Colorado, more particularly described as follows: Beginning
at the Southwest corner of said Section 33; thence North on the West line of Section 33
for a distance of 1242 feet to the West line of the Great Western Railway Company's right-
of-way; thence Southerly 40 feet from and parallel to the center line of said Railway for
a distance of 1419 feet to the South line of said Section 33; thence West on the South
Section line 400 feet to the place of beginning, containing 6.80 acres by actual measure-
ment; also, all water and water rights, lateral and lateral rights appurtenant to said

a fair price and that it will be to the best interests of the County to purchase the
above described propery and under the above described terms and conditions.
NOW, THEREFORE, BE IT RESOLVED, that the County purchase the above described
property from Robert L. and Anna M. Smith for the amount of $7,250.00 under the above
terms and conditions, for the purpose of straightening and improving County Road #455
running North from Johnstown, Colorado.
The motion was seconded by Commissioner Magnuson and the resolution was
adopted by the following vote:

RESOLUTION
WHEREAS, in order to improve that certain County Highway running

northerly from Johnstown, Colorado, it became necessary to and Weld
County did acquire that certain tract or parcel of land described
in Book 144+, at page 386 of the Weld County Records, and
WHEREAS, in order to obtain the removal of the buildings there-
on from the site of the proposed new highway, said buildings were
sold to one John Moser, Jr., and
WHEREAS, in order to facilitate and expedite the removal of
said buildings from said road site and in order to obtain a loca-
tion therefor, said John Moser, Jr., has offered to purchase a
portion of said tract located in the southiant corner thereof des-
cribed as follows:
All that part of that certain tract of land described
in Book 14+44, at page 386 of the Weld County Records, and
located in the Southwest Quarter (SWu) of Section Thirty-three
(33), in Township Five (5) North, Range Sixty-seven (67)
West of the Sixth Principal Meridian, in Weld County,
Colorado, more particularly described as follows: ' Beginning
at a point on the right of way line on the East side of the
road running North and South along the West side of said
tract 10 feet, more or less, South of the right of way of
the Mosier-Williams Ditch, thence East 200 feet, more or less,
to the southwesterly right of way line of said new road to be
constructed across said tract, thence southeasterly along
said right of way line 183 feet, more or less, to the South
line of the right of way of the present road running East and
West along the South side of said tract, thence West along
said line 190 feet to a point, thence West 45° North 62 feet
to the East line of the right of way of said North and South
road, thence North along said East line of said road 168 feet
to the point of beginning, being 3/4 of one acre, more or less,
for the sum of $300.00, and
WHEREAS, said County does not need said portion of said tract
and would be benefited by the disposal thereof, and said portion of
said tract would tend to become a dump ground and eyesore if
retained by said County, and said sum of $300.00 is greatly in excess
of any sum that could possibly be obtained for it from anyone other
than said Moser,
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Weld County, Colorado:
1. That the above described portion of said tract of land con-
veyed to said County by deed recorded in Book 144+, at page 386 of
the Weld County Records, be sold and conveyed to John Moser, Jr.,
for the sum of $300.00 in cash.
2. That Charles 0. Bursiel, County Treasurer of said County,
be and he is hereby appointed Commissioner to convey said property
to said John Moser, Jr. , upon the payment to Weld County by said
Moser of said sum of $300.00.

Said motion was duly seconded and on roll call the foregoing Resolution
