RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A NURSERY AND GARDEN
CENTER - JAMES NELSON, ET AL
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 17th day February, 1982, •at the hour of 2:00 o'clock
p.m. in the Chambers of the Board for the purpose of hearing the
application of James P. Nelson, et al, 19709 Weld County Road 72 ,
Eaton, Colorado 80615, for a Use by Special Review for a nursery
and garden center, on the following described real estate, to-wit:
Part of the SE', Section 5, Township 6 North,
Range 65 West of the 6th P.M. , Weld County,
Colorado.
WHEREAS, Section 24.4. 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County Plan-
ning Commission and all of the exhibits and evidence presented in
this matter, and having been fully informed, finds that:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance;
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24. 4. 2 of the
Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the Comprehensive Plan
in that policies of the plan promote agribusinesses so
long as they do not create negative impacts on the
environment or the County. No such impacts have been
identified with this proposal. The proposal is consistent
with the intent of the Agricultural Zone District in that
the use does not constitute an interference with agricultural
activities.
b. The use is both compatible with existing agricultural
activity and with land use which is contemplated to be
agricultural in the Comprehensive Plan.
3. No overlay districts affect the site. Operation and design
standards provide adequate protection of the health, safety
and welfare of the neighborhood and the County.

proposed use.

land be, and hereby is, granted subject to the following conditions:
1. The attached standards for use by special review be
adopted.
2. The plat for the use by special review permit be placed on
record by the Department of Planning Services staff prior
to any building permits being issued on the site.
The above and foregoing resolution was, on motion duly made
and seconded, adopted by the following vote on the 17th day of

STANDARDS FOR USE BY SPECIAL REVIEW
1. The uses permitted on this site shall include the nursery and garden
center as described in the application materials on file in the Weld
County Department of Planning Services.
2. Design standards for Uses by Special Review, Section 24.5 et. seq. of
the Weld County Zoning Ordinance shall be complied with.
3. Operations Standards for Uses by Special Review, Section 24.6 et. seq.
of the Weld County Zoning Ordinance shall be complied with.
4. The Use by Special Review, shall be limited to the plans shown hereon
and governed by the Standards stated above and all applicable Weld
County Regulations. Any material deviations from the plans and/or
Standards, as shown or stated above, shall require the approval of
an amendment to the Permit by the Weld County Planning Commission and
the Board of County Commissioners before such changes from the plans
and/or Standards are permitted. Any other changes shall be filed in
the office of the Department of Planning Services.
5. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance
with any of the above stated Standards may be reason for revocation of
the Permit by the Board of County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated February 2, 1982, duly
published February 4, 1982 in the Johnstown Breeze, a public hearing was held
on the request of James P. Nelson, Susan Nelson, and Johanna White for a Use By
Special Review for a nursery and garden center. Mr. James P. Nelson was present
representing the applicants. Mr. Nelson elaborated on their plans. He added
that the water supply is adequate. They plan to sell for retail only. The Weld
County Planning Commission recommended that the request be approved with conditions
and standards. No one in attendance at the hearing was opposed to the granting
of said Use By Special Review. After, all the testimony was received, Commissioner
Steinmark made a motion to approve the request with conditions and standards as
established by the Weld County Planning Commission. Commissioner Kirby seconded
the motion and it carried unanimously.

To whom it may concern:
In accordance with the Use by Special Review application we
submit the following information as explanation for our
proposal:
The property is a ten acre parcel located one mile south and
one mile east of Eaton. It is currently used solely as a
private residence. We are surrounded on all sides by land
in agricultural use (the property to the east also contains
a residence) . A small housing development lies between i and
1'r miles to the northeast.
We propose to return a portion of our property to agricultural
use in the growing of trees, shrubs and bedding plants. As
the "harvesting" of landscaping plants involves transplanting
them to their permanent location, we propose to operate a
small retail sales facility on the site. Direct consumer
sales is common practice with the growing of trees , shrubs
and small plants.
Similar situations in Weld County and elsewhere in Colorado
indicate that nurseries are compatible with both agricultural
and residential land uses.
It is our intent to build the necessary buildings on an area
of the ten acres that is now a corner of our pasture that is ,
difficult to water and to cut and therefore becomes overgrown
with weeds. The nursery stook will be planted in an area
accessible to the buildings, but separate from the pasture.
We can see no way that this proposed special use could endanger
the health, safety or welfare of the inhabitants of the
surrounding neighborhood or the county.
We feel that this proposed use will put currently unused land
to a positive agricultural use and the general nature of the
business will enhance our neighborhood and the county at large.

Section 5 Detailed description of proposed operation and uses
A. Type of ues: Retail Garden Center - dealing in plants, chemicals,
tools, and equiptment typically used in home
gardening and landscaping.
B. Proximity to residential structures: nearest residential
structure is located on plot plan attached;
nearest residential structure adjacent to this
parcel is located 500 feet immediately east of
property described in plot plan.

temperature and moisture controlled storage of
dormant nursery stock (bare root cellar) .
3. one 20' x 70' rose arbor - wood framed & plastic
glazed, single story
4. one shade arbor of wood frame and open lathwork
construction 10'x 100'
H. Description of vehicular traffic: passenger cars and light trucks
of less than 70001bs. gross weight; plus occassional
and infrequent delivery trucks of unknown weight.
I. Domestic sewage: adequate facilities for domestic sewage disposal
will be included in the plans for largest of proposed
structures.
