RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 390 - FRANCIS
AND AMY ARENS
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on May 16 , 1979 , the Board of County Commissioners
of Weld County, Colorado adopted a resolution approving Recorded
Exemption No. 390 for Francis and Amy Arens , and
WHEREAS, the Board of County Commissioners has been informed
by the Department of Planning Services that Francis and Amy Arens
are requesting that the aforementioned Recorded Exemption No. 390
be amended by reducing the size of Lot B from 140 acres to 60
acres, and
WHEREAS, the Board, having studied the request, finds that
the amendment to Recorded Exemption No. 390 should be approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the amendment to Recorded
Exemption No. 390 for Francis and Amy Arens be, and hereby is ,
approved.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 11th day of
June, A.D. , 1980 .

Re: Recorded Exemption - Amend RE-390
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Francis and Amy Arens to amend recorded exemption 390. The
parcel of land on which this request has been made is described as the
Wi SE=„ Section 15, T4N, R65W, of the 6th P.M. , Weld County, Colorado.
This property is located 2i miles south and 2i miles east of the town of
La Salle. The property contains approximately 80 acres of Class I , II ,
III and VI irrigated soils.
The request is to amend Recorded Exemption 390 by reducing the size of
Lot B from 140 acres to 60 acres. Mr. and Mrs. Arens wish to apply for
a recorded exemption on the remaining 80 acres to split off two existing
houses. Mr. and Mrs. Arens no longer need the two houses for their farm-
ing operation. Lot A contains an existing dairy operation.
Based upon the information submitted, the Department of Planning Services
Staff recommends approval of this requested amendment for the following
reasons.
I . The impact on surrounding agricultural land uses would not
appear to be any different than the original request which
has already been approved.
2. The request conforms with the intent clause of the recorded
exemption procedure. The intent clause of the Agricultural
Zone District and the Weld County Comprehensive Plan in that
the use will be compatible with surrounding agricultural uses.
The request will allow agricultural and related uses to be the
predominant land use. There will be no reduction in the amount
of land currently used for agricultural production.

3. This request is in compliance with Section 9-4 A. of the Weld
County Subdivision Regulations.
