RE: APPROVAL OF RECORDED EXEMPTION NO . 448 - FRANCIS AND AMY
ARENS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 11th day of June, 1980 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of land, as shown on the plat known as Recorded
Exemption No. 448 , being the property of Francis and Amy Arens,
described as part of Section 15 , Township 4 North, Range 65 West
of the 6th P.M. , Weld County, Colorado, being more particularly
described as follows does not come within the purview of the
definition of the terms, "subdivision" and "subdivided land" ,
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended:
The East Half of the Southeast Quarter of
Section 15, Township 4 North, Range 65
West of the 6th P.M. , Weld County, Colorado.
Lot "A"
Part of the East Half of the Southeast Quarter
of Section 15, Township 4 North, Range 65 West
of the 6th P.M. , Weld County, Colorado being
more particularly described as follows:
Beginning at the Southeast Corner of said Sec-
tion 15 and considering the East line of said
Southeast Quarter as bearing North 00°00 ' 00"
East, with all other bearings contained herein
relative thereto;
Thence North 00°00 ' 00 " East, 1196 . 17 feet to
the True Point of Beginning;
Thence North 40°50 ' 59 " West, 236 . 60 feet;
Thence North 01°32 ' 42" East, 313 . 18 feet;
Thence North 39°38 ' 21" East, 229 . 34 feet;
Thence South 00°00 ' 00" West, 668 . 65 feet to
the True Point of Beginning.
Said described parcel of land contains 1 .696
acres, more or less, including 0 .436 acres ,
more or less, reserved for county road right-
of-way purposes along the east line of said
described property, and is subject to any
rights-of-way or other easements as granted
or reserved by instruments of record or as
now existing on said described parcel of land.

WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not with-
in the purposes of the Weld County Subdivision Regulations and
the Board desires to exempt this particular division of land
from the definitions of "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973 , as amended, and Section 2-1A(3) of the Weld County Subdi-
vision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Francis and Amy Arens be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973, as amended, conditional upon the applicants
correcting the problems in coordination with the Weld County
Health Department prior to recordation of the recorded exemption
plat.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 11th day of
June, A.D. , 1980.

Re: Recorded Exemption #448
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Francis and Amy Arens for a recorded exemption. The parcel
of land on which this request has been made is described as the E₹ SEw,
Section 15, T4N, R65W of the 6th P.M. , Weld County, Colorado. This pro-
perty is located 2z miles south and 2I miles east of the town of La Salle.
The property contains approximately 80 acres of Class 11 , Ill and VI ir-
rigated soils. The request is to split the property into parcels of
1 .696 acres and 78+ acres.
Mr. and Mrs. Arens wish to sell the smaller parcel which has two residences
and continue farming the larger parcel . The residences are no longer needed
for the farming operation.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services Staff recommends the request be approved
for the following reasons:
I . The proposed split conforms with Section 9-2 of the Weld County
Subdivision Regulations ( intent clause of the recorded exemption
procedure) , Section 3.3 A. of the Weld County Zoning Resolution
( intent clause of the Agricultural Zone District) , and the Weld
County Comprehensive Plan in that the use will be compatible with
surrounding agricultural uses. The request will allow agricult-
ural and related uses to be the predominant land use. There will
be no reduction in the amount of land currently being used for
agricultural production.
2. This request complies with the provision of Section 9-4 A. of the
Weld County Subdivision Regulations.

The applicants are in the process of correcting problems with the sewage
system for the two residences. Therefore, the Department of Planning
Services recommendation for approval is conditional upon the applicants
correcting the problems in coordination with the Weld County Health De-
partment prior to recordation of the recorded exemption plat.
