WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Weld County Department of Planning Services has informed the Board of County Commissioners that required improve- ments for the Althen/Boyer Subdivision, first filing, have been installed, and WHEREAS, the Department of Planning Services recommends that a portion of the letter of credit in the amount of $6 , 300. 00 for Alth'en/Boyer Subdivision be released and further, that $7 ,1-00 . 00 of the letter of credit be retained. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that a portion of the letter of credit in the amount of $6, 300. 00 for the Althen/Boyer Sub- division be, and hereby is, released. BE IT FURTHER RESOLVED by the Board that $7 ,100 .00 of said letter of credit shall be retained. Ordway: Per your request this office has reviewed the above referenced matter and finds the following: 1. The agreement for improvements for the first filing (Lots 1-5) estimated $6 , 300 .00 for water lines and hydrants ; and 2. Field review indicates required improvements have been installed. Attached please find a letter from Mr. Althen received January 10 , 1980 which verifies constructed improvements. It appears reasonable and proper to release the $6 , 300 .00 amount from the "letter of credit" held for the subdivision. The former Letter of Credit #146-A was for $13,100.00. It would be appropriate for you or your client to forward a certified statement of improvements made in the subdivision along with the revised letter of credit so that the Board may make a determination regarding acceptance of the new letter and the amount.
