RE: APPROVAL OF RECORDED EXEMPTION NO. 573 - GEORGE AND BARBARA
ROSENOFF
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 573, being the property of George
and Barbara Rosenoff, described as part of the SE4 NE4, Section
32 , T6N, R67W of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by
the applicants and known as Exhibit "A" , said plat to be recorded,
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by George and Barbara Rosenoff be, and hereby
is, exempt from the definition of the terms, "subdivision" and
"subdivided land" , upon the condition that prior to the issuance
of a building permit the applicants and/or owners shall submit
evidence from the Weld County Health Department that Lot "B"
shall have an adequate sewage system.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 13th day of
October, A.D. , 1982 .

Re: Recorded Exemption #573
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from George and Barbara Rosenoff for a recorded exemption. The
parcel of land on which this request is being made is described as part
of the SE' NEB, Section 32, T6N, R67W of the 6th P.M., Weld County,
Colorado.
The property is located 1.5 miles south of Windsor on Weld County Road
17. The property contains approximately 36 acres of Class IVe nonirrigated
soils.
The request is to divide the property into parcels of 29 acres and 7
acres, more or less. The applicant has a buyer who is interested in build-
ing a home on the proposed 7 acre parcel.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2 C. of the Weld County
Subdivision Regulations submission requirements.
2. The request complies with Section 9-2 of the Subdivision
Regulations as follows:
The request is in compliance with the policies of the
Weld County Comprehensive Plan in that to minimize
conflicting land uses, residential development will be
encouraged to locate adjacent to existing towns and in
accordance with the comprehensive plans and stated wishes
of each community. The parcel of land is located within 1.5
miles of the town of Windsor. The town of Windsor Planning
Commission has no objections to this request.

- The proposal is in compliance with Section 1-3 of the
Weld County Subdivision Regulations and the proposed
land division complies with the Weld County Compre-
hensive plan; therefore, the proposed use is consistent
with efficient and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- A cistern is proposed in order to provide adequate water
service for this proposal.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from
Weld County Road 17.
The Department of Planning Services staff recommendation for approval is
conditional and based upon the following:
- Prior to the issuance of a building permit the applicant
and/or owner shall submit evidence from the Weld County

The soils on the subject parcel of land are Class VIe nonirrigated soils
and have a low utility for agricultural production. The physical layout
of the parcel, including slope and size, diminishes the efficiency of
agricultrual operations on the parcel.

COMMENTS:
The subject site slopes to the east. There areno improvements_on the property. The
access to the property would be from Weld County Road 17. Approximately 17 acres
of the property was an abandoned landfill. The steep terrain makes farming this property
impractical.

Re: Proposed recorded exemption of the SE § of the NE a of Section 32
Township 6 Range 67 West of the 6th P.M. Weld County, Colorado.
Gentlemen;
In response of the list of determinations to be made by the Board
of County Commissioners, I have compiled the following information.
The parcel of land to be exempted is +7 acres of the SE corner
of the above mentioned I section. The parcel, as it exists, may be
described as waste land unsuitable for cultivation. It has been
fallow for as long as local residents and neighbors can recall. The
only recorded income from this parcel has been a landfill which has now
been covered over, then abandon. The location of the landfill is
indicated on the plat map attached. There is no irrigation water on
the parcel, steep slopes and arroyos predominate the 7 acres to
be exempted. The landfill site has been graded and could possibly
be returned to agricultural use at a future date. The 7 acre
parcel, however, offers no possibility of reclaimation into any
agricultural use other than poor pasture. This parcel does offer
a desirable building site overlooking the Windsor basin and sur-
rounding area.
Access to the smaller parcel would be from WCR17 as indicated on
the plat. REA is at the road and cistern and septic systems are in
use by the existing houses in the immediate area. A home built on
this land would be compatible with land use plans and other rural,
non-farm residences.
