RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 171 - HEARST AND NANCY
PRESSLY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
No
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has reviewed the
request of Hearst and Nancy Pressly for an exemption from the
definitions of "subdivision" and "subdivided land" in Seciton
30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1 A. (3)

of the Weld County Subdivision Regulations, and
WHEREAS, the Board of County Commissioners finds the Hearst
rr = and Nancy Pressly are the owners of a certain parcel of land

Weld County, Colorado, and
WHEREAS, Hearst and Nancy Pressly desire to create a certain
parcel of land, being more particularly described as follows:
A tract of land located in the Northwest
quarter of the Southwest quarter of Section
18 , T2N, R67W of the 6th P.M. , Weld County,
Colorado, being more particularly described
as follows:
Commencing at the West one-quarter corner
of Section 18, whence the Southwest corner
of said Section 18 bears SOO°54 ' 51" E; thence
along the North line of the Southwest quarter
of said Section 18 N89°42 ' 08"E 255. 90 feet
to a point on the East R.O.W. Line of the
Union Pacific Railroad and the True Point
of Beginning; thence continuing N89°42 ' 08"E
358.51 feet; thence S01°29 ' 22"E 242. 20 feet;
thence S89°42 ' 08"W 361. 04 feet to said East
R.O.W. line of the Union Pacific Railroad;
thence N11°53 ' 25"W 242. 16 feet to the True
Point of Beginning, containing 2. 00 acres
more or less.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners that the above described parcel be, and hereby is,
declared to be exempt from the definitions of "subdivision" and
"subdivided land" as set forth in Section 30-28-101 (10) , CRS
1973, as amended, and Section 2-1 A. (3) of the Weld County Sub-
division Regulations.

BE IT FURTHER RESOLVED by the Board that the approval by
the Board of County Commissioners is conditional upon the appli-
cants showing a continuation of the twenty (20) foot wide access
easement along the west boundary on Lot "A" from Lot "B" to the
proposed two (2) acre lot north of Lot "A" on Amended Recorded
Err Exemption #477.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 24th day of
November, A.D. , 1982.

Legal Description of Property: Part of the SW1, Section 18, T2N, R67W
of the 6th p.m. , Weld County, Colorado.
Location of Property: 14 mile north of the north side of the incorporated boundary
of Firestone
The owners of the property described above have requested an exemption fran
Section 2-1 of the Weld County Subdivision Regulations adopted August 30, 1972.
The Department of Planning Services staff has reviewed this request and
recommends that the request be approved for the followings reasons:

Agree with surrounding land uses

The Department of Planning Services staff does acknowledge the fact that a
new parcel eligible for building permits will be created within the five (5)
year limitation of a previously approved recorded exemption (on January 21,
1981,)at this same location. According to Section 2-3 A. 3 of the Weld
County Subdivision Regulations, the Board may exempt from this definition
of the terms "subdivision" and "subdivided land" any division of land if the
Board determines that such division is not within the purposes of these
regulations. The Department of Planning Services staff does support this
exemption for the following reasons:
1. The town of Firestone has reviewed this request and has
determined the proposal to comply with their town
Comprehensive Plan.
2. The Tri-Area Planning Commission has reviewed this request
and has determined the proposal to be consistent with surround-
ing land uses.
3. Adequate water and sewer facilities will be available for
the proposed lots.
4. The proposed lots meet minimum lot size requirements for land
division.
The Department of Planning Services staff recommendation for approval is
conditioned on the following:
1. That the applicant show a continuation of the twenty (20) foot
wide access easement along the west boundary on Lot "A" from
Lot "B" to the proposed two (2) acre lot north of Lot "A" on
Amended Recorded Exemption #477 .

COMMENTS:
Parcel has one set of existing improvements located on it. (Residence) Access to property
is over and across 20' easement on west side of Lot B of RE-477. WCR 20 is gravel surfaced.
There is also an oil and/or gas improvements located on property or to the south of property.
It was hard to determine where the east/west property line was. North can of parcel is
higher that south end. Two residence exist to the south of property. Several small tracts
with residential dwelling are located to the east of this property.

This office represents Hearst J. and Nancy A. Pressly, the recorded
owners of Lot A, Recorded Exemption No . 1311-18-3-RE477.
Mr. and Mrs. Pressly own a mobile home on the south portion of
Lot A. They wish to give the north two acres of Lot A to their
daughter, Sandra Jo Matzke and her husband, Paul Edward Matzke
so that they can build a home on the two acres. Sandra is pregnant
and would very much like to have construction begin as soon as
possible so that the home might be completed by the time her baby
is born.
