RE: APPROVAL OF RECORDED EXEMPTION NO. 488 - A. FRANK BARNES
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 18th day of March, 1981 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of land, as shown on the plat known as Recorded
Exemption No. 488 , being the property of A. Frank Barnes , described
as the Northwest Quarter of the Northwest Quarter and the East Half
of the Northwest Quarter of Section 36 , Township 3 North, Range 68
West of the 6th P.M. , Weld County, Colorado, being more particu-
larly described as follows , does not come within the purview of
the definition of the terms , "subdivision" and "subdivided land" ,
pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 ,
as amended:
The Northwest Quarter of the Northwest Quar-
ter and the East Half of the Northwest Quar-
ter of Section 36 , Township 3 North, Range
68 West of the 6th P.M. , Weld County, Colo-
rado.
The above described tract contains 120 acres,
more or less .
Subject to a County Road right-of-way 30 feet
of even width along the entire North side of
the above described tract and subject to any
rights-of-way or other easements as recorded
by instruments of record or as now existing
on said described tract of land.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-lA( 3) of the Weld County Subdivision Regulations.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the hereinabove described
parcel of land owned by A. Frank Barnes be, and hereby is, exempt
from the definition of the terms "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973 , as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 18th day of
March, A.D. , 1981.

RE: Recorded Exemption #488
Dear Commissioners:
The attached application, plat, and related items are in reference to
a request from A. Frank Barnes for a recorded exemption. The parcel of
land on which this request has been made is described as NWaNWa & EzNWa
of Section 36, T3N, R68W of the 6th p.m. , Weld County, Colorado. This
property is located 2 miles north and 1 mile east of Del Camino. The
property contains approximately 120 acres of Class II , III , IV, & VI
irrigated soils. The request is to split the property into parcels
of 1.0 acres and 119 acres.
Mr. Barnes wishes to sell the 1.0 acre parcel to his daughter and son-in-
law who have been assisting with the farming operation. Mr. Barnes
intent is to slow down his involvement with the farming operation as his
son-in-law assumes increasing responsibility with the farm.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the request
be approved for the following reasons.
1. The request conforms to the intent clause of the Recorded
Exemption Procedure (Section 9-2 of the Weld County Subdivi-
sion Regulations) , the intent clause of the Agricultural Zone
District (Section 3.3.A. of the Weld County Zoning Resolution) ,
and the Weld County Comprehensive Plan in that the uses will be
compatible with the surrounding agricultural uses. The re-
quest will allow agricultural and related uses to be the pre-
dominant land uses.
2. This request complies with the provisions of Section 9-4A. of
the Weld County Subdivision Regulations.

GENTLEMEN:
This letter is to request permission to have one acre of
land on my farm to be approved for a building site for Mr. Tony
DeCino, who is my son-in—law.
The reasons we are requesting this is as follows:
(A). There is only one home on the surveyed
farm where I live, which is free and
clear. The other farm I own has a real
old home on it.
(B). At the present I am interested in easing
off from the farming operation, and yet
still live on the farm. My son-in-law
has farmed with me in the past and is
interested in working into the farming
operation.
We have completed the survey and other pertinent requirements
in hopes of obtaining this recorded exemption. We thank you for
