RESOLUTION
RE: APPROVAL TO AMEND DEVELOPMENT STANDARDS FOR SPECIAL USE PERMIT
FOR A DOG KENNEL - AUDREY AND KENNETH ANDERSEN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on August 27 , 1980 at 2 : 00 o 'clock p.m. , the Board
of County Commissioners of Weld County, Colorado held a hearing
to consider the request of Audrey and Kenneth Andersen to amend
the development standards for a dog kennel, and
WHEREAS, the applicants have requested to amend the develop-
ment standards for a Special Use Permit for a dog kennel on the
following described parcel of land, to-wit :
A tract of land in the West Half of the South-
west Quarter of Section 2, Township 3 North,
Range 68 West of the 6th P.M. , Weld County,
Colorado, more particularly described as follows :
Beginning at a point on the South line of said
Section 2, from which the Southwest corner
thereof bears South 89°45 ' West, 50. 00 feet,
thence North 89°45' East, 253. 00 feet along
the South line of Section 2, thence North 00°15 '
East, 575. 00 feet, thence North 58 °18 ' East,
287 . 95 feet, thence South 85°38 ' East, 649 . 74
feet, thence South 31°43' East, 250. 41 feet
to the East line of the West Half of said
Southwest One-Quarter of Section 2 , thence
North 00°15 ' East, 534 . 50 feet along said
East line, thence South 89°46 ' West, 1281. 76
feet, thence South 00°02 ' West, 994 . 2 feet
to the point of beginning; thus described
tract contains 13. 435 acres.
WHEREAS, the Board reviwed the testimony of the applicants
and of all others present, and reviewed the recommendations of
the Weld County Planning Commission, and having been fully
informed, is satisfied that the above described request for amending
the Development Standards for the Special Use Permit for a dog
kennel should be granted.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the request of Audrey
and Kenneth Andersen to amend the Development Standards in the

Special Use Permit for a dog kennel be, and hereby is, approved
conditional upon the following:
1. The Development Standards contained in the Special
Use Permit.
2. No building or electrical permits shall be issued on
the Special Use Permit area until the Development
Standards for the Special Use Permit have been placed
on the Special Use Permit plat and said plat has been
delivered to the office of the Department of Planning
Services.
BE IT FURTHER RESOLVED by the Board of County Commissioners
that the reasons for approval contained in the Planning Commis-
sion recommendations be, and hereby are, adopted as the findings
of fact of the Board of County Commissioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
August, A.D. , 1980 .

NOVEMBER 7, 1979

The Board of County Commissioners of Weld County, Colorado, met in
regular session in full conformity with the law and bylaws of said
Board at the regular place of meeting in the Weld County Centennial
Center, Greeley, Colorado, on Wednesday, November 7, 1979, at the
hour of 9:00 A.M.
ROLL CALL: The meeting was called to order by the Chairman and on roll call the
following members were present, constituting a quorum of the members
thereof:

MINUTES APPROVED: Commissioner Steinmark made a motion to approve the minutes of the
Board of County Commissioners' meeting of November 5, 1979, as
written. Commissioner Dunbar seconded the motion and it carried
unanimously.
ADDITIONS AND DELETIONS TO THE AGENDA: The Chairman included on the agenda a request by
Don Warden, lease-purchase of a copy machine for the Health Department,
as item #11 under New Business.
ELECTED OFFICIALS AND DEPARTMENT HEADS: Mike Loustalet, Treasurer, requested that the Board
declare the first floor assembly room of the Centennial Center, as
a part of the Treasurer's Office for the purpose of a tax sale to
be held on Tuesday, November 13, 1979. Commissioner Roe made a motion
to approve said request. Commissioner Steinmark seconded the motion
and it carried unanimously.
The Treasurer announced that the present economy is having a definite
effect on the payment of taxes during the last month. One year ago
834 tax certificates went to sale, as of today there are -
1,389 accounts outstanding on real property. Personal property in
total dollars is less than $5,000 outstanding.
The Treasurer has issued 361 distraintson tax delinquent mobile homes.
The sale of mobile homes is being conducted by the Treasurer.
To-date two mobile homes have been sold and twenty three certificates
are being held by the County. By the end of next year, if the
certificates are not redeemed the County will become the owner of
said mobile homes. The next mobile home sale will be conducted Friday,
November 9, 1979, on twenty mobile homes.

The interest earned January through October, totals $740,260.14.
The Treasurer predicted that by year end this figure will reach
$800,000.
In conclusion, the Treasurer commented on the legislation pertaining
to mobile homes. He stated that by January 1, 1980, all the short
comings of said legislation should be realized. The Treasurer stated
that a cooperative effort to amend the mobile home legislation is
being prepared by elected officials and finance officers. Said
amendments will be presented to Colorado Counties, Inc.
Jerry Wones, Ambulance Director, reported that the Ambulance
calls for 1979 have increased by 11% over 1978. More calls have
been received during the month of October than any other month
to date; about 360 calls, approximately 12 calls per day.
A portable cat scanner will be installed at the hospital around the
first of the year, 1980. Mr. Wones noted that said installation should
lessen their number of trips to Denver.
The collection rate is up 81% this year over 77% in 1978.
Mr. Wones and an employee will be attending an E.M.S. Conference in
Denver next week, for two days, regarding E.M.S. legislation.
In closing, Mr. Wones announced that the past communications
problems have all been resolved and the systems are working well.
APPOINTMENTS, HEARINGS, REPORTS AND COMMUNICATIONS: The Board approved those listed on the
agenda with the following comments and/or additions:
ROCK CRUSHER PERMIT: Wayne Smyth, County Engineer, noted that thanks
to the persistence of the County legal staff on November 5, 1979,
the Colorado State Health Department issued two temporary permits,
with conditions, to Weld County on the rock crusher and the Hoekstra
gravel pit. Said permits are effective for the next six months.
Mr. Smyth stated that the crusher is operating and will be so
long as weather permits.
TOWN OF ERIE RE: COLORADO LANDFILL, INC., ERIE SITE: The Chairman
read the resolution adopted by the Town of Erie into the record. A
hearing regarding a Special Use Permit for said site was conducted
approximately six months ago and approved. The Town of Erie's
resolution #79-14 asked that a new hearing be convened and that the
special use permit be revoked. Commissioner Steinmark stressed that
Commissioner Kirby has participated in all discussions and action
regarding the landfill sites and further stressed that all Commissioners
be present when this matter is again discussed. Commissioner Steinmark
suggested that this matter be referred to legal counsel for his
recommendations. Commissioner Steinmark made a motion that this
matter be discussed during the Board work session scheduled for
November 19, 1979, and further that it be listed for action on the
Board's agenda scheduled for November 21, 1979. Commissioner Dunbar
seconded the motion and it carried unanimously. The County Attorney
announced that this matter will be discussed at 2:00 P.M. on November 19,
1979, during the Board's work session.
CIVIL ACTION MINCH, ET AL VS BOARD OF COUNTY COMMISSIONERS, ET AL: The
Chairman referred this action to the County Attorney.

COMMUNICATIONS ADVISORY BOARD RECOMMENDATION: Commissioner Steinmark reviewed the by-laws
as they read currently and reviewed the discussion conducted some
time ago in a board work session. After discussion, Commissioner
Steinmark made a motion to direct the County Attorney to rewrite
said by-laws to reflect that the Communications Director be a
non voting member of the advisory board, a member of the Board of
County Commissioners be appointed to the Advisory Board and said
commissioner shall serve as the Chairman, the Advisory Board shall
elect a vice chairman, and further that the rewritten by-laws be
presented to the Board for their consideration. Commissioner Dunbar
seconded the motion and it carried unanimously.
ITEMIZING LEGAL HOLIDAYS 1980: The County Attorney concluded that the Board does have
the power to make the holiday changes as suggested through
Ordinance procedure. Mr. David suggested that the Board not take
action on this matter until an ordinance can be written and
considered.
The following is a list of holidays to be observed as suggested by
the Board in 1980 as days off for Weld County employees:

The County Attorney stated that he has prepared a four page legal
opinion that he could present to the Board today.
Mary Ann Feuerstein, County Clerk and Recorder, stated that the Board
should not concern themselves with the amendment of legal holidays.
She stressed that Weld County should continue to observe holidays
as they are set by the state statutes and objected to the amend-
ment as suggested.
Mike Loustalet, County Treasurer, concurred with the Clerk and
objected to the amendment of the state statutory established holidays
because in the fall of the year his office is extremely busy. It was a
consensus of the Board to study the legal opinion and that this issue
be listed on the Board's agenda scheduled for November 14, 1979.
SURPLUS RADIO DISTRIBUTION: Commissioner Roe commented on the problems with said radio
redistribution. In his opinion, the purchase of a new radio, at
an approximate cost of $1,500, would remedy the problems. Mr.
Warden informed the Board that these funds could be drawn from the
capital outlay account. After additional discussion, Commissioner
Roe made a motion to amend the resolution dated September 19, 1979
to reflect that only one radio be transferred to Southeast Weld Fire
District instead of two. Commissioner Steinmark seconded the motion
and it carried unanimously. Commissioner Steinmark made a motion
to authorize the Purchasing Director to purchase one radio for the
Sheriff to be installed in the Prisoner Transport Van. Commissioner
Roe seconded the motion and it carried unanimously.

VETERANS DAY PROCLAMATION: The Chairman read the proclamation into the record which
designated November 12, 1979, Veterans Day in honor of those
men and women who have served in the defense of the United
States. Commissioner Steinmark made a motion to adopt said
proclamation. Commissioner Roe seconded the motion and it
carried unanimously.
APPROVE SALARIES OF DEPUTY DA'S, WILDENLOH AND KAUFFMAN: Mr. Warden noted that these
employees and salaries have been reviewed by the Personnel Department
and further, the Personnel Department concurs. Commissioner Dunbar
made a motion to approve said salaries as requested. Commissioner
Steinmark seconded the motion and it carried unanimously.
ACQUISITION OF GROUP INSURANCE COVERAGE AND ACQUISITION OF INSURANCE COVERAGE: Don Warden
presented a resolution on each of these topics. Said resolutions
are attached to these minutes. Mr. Warden elaborated on each factor
that created the necessity for this action and further the steps
necessary to develop requests for proposals for a comprehensive
insurance program and group insurance program.
Paul W. Bechthold, Greeley Association of Life Underwriters, reminded
the Board of the resolution adopted on the 27th day of October, 1971,
which read as follows: "That until further order of the Board, the
Greeley Association of Life Underwriters, be and it hereby is
appointed as exculsive agent to solicit and make recommendations to
Weld County pertaining to all group health insurance matters, and
• that Paul W. Bechthold, C.L.U. and Member of the Association act as
servicing agent." Mr. Bechthold elaborated on his duties over the
past years and stressed he has never been asked to seek bids since
the enactment of the Home Rule Charter. Mr. Bechthold stated that
he has been by passed and asked for an opportunity to meet with the
County Council and the Board regarding said acquisitions as just
presented by Mr. Warden.

Mr. Warden noted that the acquisition approach stressed in these
resolutions is more competitive and would be of benefit to Weld
County. Each Commissioner expressed their views with respect to
said resolutions. Mr. Bechthold objected to the fifteen hour
notice he received about this matter and further that thirty days
isn't adequate to get proper issirance quotations depending on the
specificiations.
Don Franks, expressed on behalf of the Greeley Weld Insurors
Association and Property and Casualty Industry, his appreciation
for the consideration given regarding these matters and further he will
comply with any rules imposed.
After deliberation, Commissioner Steinmark made a motion to approve the
resolution that references the acquisition of insurance coverage.
Commissioner Roe seconded the motion and it carried unanimously.
Commissioner Steinmark made a motion to approve the resolution which
references acquisition of group insurance coverage with the amendment
that the proposals must be submitted December 19, 1979, that the
coverage become effective by February 1, 1980 and that all the relative
dates be changed to concur. Commissioner Dunbar seconded the motion
and it carried unanimously.

FIRST READING ORDINANCE #56, AUTHORIZE HEALTH DEPARTMENT TO HOLD HEARINGS AND ISSUE ORDERS ON
CERTAIN HEALTH MATTERS: The Chairman asked the Assistant County
Attorney, Lee Morrison, to read said Ordinance #56, in the matter

of the delegation of authority for the Weld County Board of Health
to hold hearings and issue orders on certain public health matters
in the County of Weld, State of Colorado, into the record. Mr.
Morrison reviewed sections of said Ordinance. Dr. Juels answered
questions. Commissioner Roe made a motion to accept the first
reading of Ordinance #56 and directed the Clerk to the Board to
publish forthwith. Commissioner Dunbar seconded the motion and it
carried unanimously.
FIRST READING ORDINANCE #60, FEES FOR TESTING WATER BY HEALTH DEPARTMENT: The Chairman asked
the Assistant County Attorney to read Ordinance #60, in the
matter of fees for the testing of drinking water and pollutant
discharges performed by the Weld County Health Department, into the
record. Allen Palmquist, Phil Armstrong and John Hall, representing
the Health Department, commented on this ordinance. After study,
Commissioner Steinmark made a motion to accept the first reading of
Ordinance #60 and directed the Clerk to the Board to publish
forthwith. Commissioner Roe seconded the motion and it carried
unanimously.
UNC AUDIOLOGY CLINIC AGREEMENT/WELD COUNTY HEALTH DEPARTMENT: Phil Armstrong noted that
the agreement will provide audiological service to Weld County
Health Department through audiometric screening evaluations in the
WCHD Weld Oldster and Child Health Clinics. Screening services
will be offered each quarter to assess hearing loss of individuals
participating in clinics conducted throughout the county. In return
for these services, WCHD agrees to reimburse the University of Northern
• Colorado, the amount of $2100 to support the Fellowship in Geriatric
Rural-Rehabilitation. This agreement will be effective January 1, 1980
through December-31, 1980. Commissioner Dunbar made a:motion to approve
this agreement. . Commissioner Steinmark seconded the motion and it
carried unanimously.

AGREEMENT FOR SPECIALIZED REHABILITATION SERVICES, EVENTIDE NURSING HOME/WELD COUNTY HEALTH
DEPARTMENT HOME HEALTH CARE SERVICE: This agreement was effective
October 1, 1979 through September 30, 1980 with 30 days cancellation
notice by either party. Terms are to provide physical and occupational
therapy as ordered by resident physicians. The skilled nursing care
facility is billed directly for all therapy services under the Medicare
A program, stated Mr. Armstrong. Commissioner Steinmark made a motion
to approve this agreement. Commissioner Roe seconded the motion and it
carried unanimously.
AMENDMENT #1 AIR POLLUTION CONTROL, STATE HEALTH/WELD COUNTY HEALTH DEPARTMENT: This amendment
is nunc pro tunc October 1, 1978. Supplemental funding was received
by the State Health from EPA to support local air pollution programs.
The amendment increases the total contract to $1,562.50. Eleven
payments in the amount of $416 have been received and the 12th or
$1,986.50 will include the increase. The payment will be made upon
approval of the annual report .required by the contract and agent
designation. Commissioner Dunbar made a motion to approve
amendment #1 Air Pollution Control. Commissioner Steinmark seconded
the motion and it carried unanimously.
AFFILIATION AGREEMENT/WELD COUNTY HEALTH DEPARTMENT ALCOHOL RECOVERY AND REHAB CENTER AND
FT. LOGAN MENTAL HEALTH: This affiliation agreement is between the
two parties who agree to develop an exchange of alcoholism treatment
services, the greater utilization of these services and for the purpose
of ensuring that all listed services needed by the client are made
available to him through referrals by both agencies. Commissioner
Steinmark made a motion to accept said affiliation agreement.
Commissioner Roe seconded the motion and it carried unanimously.

LEASE-PURCHASE AGREEMENT OF A COPY MACHINE FOR THE HEALTH DEPARTMENT: Mr. Warden presented
said request and reviewed the terms of said agreement for a Sevin
780 copier, serial 11981205219. Mr. Warden noted that he and the
Purchasing Director recommend proceeding with said agreement.
Commissioner Steinmark made a motion to authorize the Chairman
to sign said agreement. Commissioner Dunbar seconded the motion
and it carried unanimously.

PLANNING DEPARTMENT: BOARD OF ADJUSTMENT DECISION RE: ANDERSON DOG KENNEL: The Andersons'
appeal was denied by the Board of Adjustments. Mr. and Mrs. Anderson
were present and commented on their operation. Mr. Honn, Zoning
��,'� ., (� Administrator, offered to assist the Andersons with their amended
special use permit application. Commissioner Steinmark made a motion
y ) to continue the violation until a decision can be made on the
amended special use permit and that the application of that permit

BOARD OF ADJUSTMENT DECISION RE: RYBERG HOUSE MOVING OPERATION: Mr. Ryberg's appeal was approved
by the Board of Adjustment. John R. Dent, legal counsel for Mr.
Ryberg was present. Commissioner Steinmark made a motion to continue
this violation until the determination of the special use permit can
be made and further that the special use permit application be filed
on or before December 21, 1979. Commissioner Roe seconded the motion
and it carried unanimously.
ZPMH #284, R. K. SITTINGDOWN: Mr. Honn read the favorable recommendation presented by the
Planning staff. The applicant was not present.

3.3.B. of the Weld County Zoning Resolution. The location and size of the
permitted structures shall be as shown hereon. The maximum numbers of animals
permitted shall be a total of 15 dogs, which includes adult dogs and puppies.
2. The Special Use Permit area shall be maintained in such a manner so as
to prevent soil erosion, fugitive dust, and the growth of noxious weeds.
3. All phases of the operation shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality, noise
emission, and samitary disposal systems.

4. The boarding kennel facility shall be subject to inspections by the Weld
County Health Department.
5. Access to the Special Use Permit area shall be as shown hereon. All accesses
shall have the approval of the Wild County Engineering Department and/or the
State Highway Department. All accesses shall be constructed in accordance
with the recommendations and/or equirements of the Weld County Engineering
Department and/or the State High ay Department.
6. 'The Special Use Permit shall be imited to the plans shown hereon and governed
by the Development Standards sta ed above and all applicable Weld County
Regulations. Any material deviations from the plans and/or Development
Standards as shown or stated above shall require the approval of an amendment
to the Speical Use Permit by the Planning Commission and the. Board.of County.
Commissioners before such changes from the plans, and/or Development Standards

I hereby certify that pursuant to a notice dated July 21, 1980, duly
published July 24, 1980 and August 14, 1980 in the Johnstown Breeze, a public
hearing was held on the request of Audrey and Kenneth Andersen for an amendment
to the Development Standards #157 for a dog kennel, Special Use Permit. Audrey -
Andersen was present for the hearing and reviewed said amendment. No one in
attendance at the hearing was opposed to the approval of said amendment. The
Planning Commission recommended approval of said amendment with seven development
standards. Mrs. Anderson said that she thinks they have now complied with
everything that Weld County has requested. After study, Commissioner Carlson
made a motion to approve the amendments to the Special Use Permit and further
included the development standards. Commissioner Steinmark seconded the
motion and it carried unanimously.

Dear Vickie:
In reviewing Andersen ' s application we cannot See any conflicts
or reasons why this proposal should not be adequate. It cer-
tainly will inhance their breeding farm and improve their opera-
tion considerably.
Both Mr. Doll (Greyhound Coordinator) and myself know the Ander-
sen ' s and have seen their farm many times and it always has
been in order and meets the Commission standards.
If we can be of any further assistance please don 't hesitate

William S. Alexander - Dog Kennel
The soils found on the proposed kennel site consist of Olney loamy sand
and Osgood sand. Both of these are well drained soils with moderate
to moderately rapid permeability. Both of theae soils have slight lim-
itations for septic tank absorption fields.
Having reviewed the information provided, I can see no problems with this
special use permit. Should you need additional information, please feel
