RE: APPROVAL OF RECORDED EXEMPTION NO. 500 - DOUGLAS AND MICHAEL
KIRKMEYER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 27th day of May, 1981 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of land as shown on the plat known as Recorded Exemption
No. 500 , being the property of Douglas and Michael Kirkmeyer,
described as part of the South Half of the Northeast Quarter of
Section 12, Township 1 North, Range 68 West of the 6th P.M. , Weld
County, Colorado, being more particularly described as follows,
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended:
A tract of land 5 . 14 acres more or less a part
of the South Half of the Northeast Quarter of
Section 12 , Township 1 North, Range 68 West of
the 6th Principal Meridian, Weld County, Colo-
rado, described as follows:
Beginning at a point on the East line of the
Northeast Quarter of said Section 12 from which
the East Quarter corner of said Section 12
bears South 1328. 3 feet; thence South 89°19 ' 00"
West, 150 . 00 feet along the North line of the
South Half of the Northeast Quarter of said
Section 12 to the center of the Bull Canal;
thence Southwesterly along the center of said
canal by the following courses: South 25°19 ' 00"
West, 322 . 0 feet; thence South 32°49 ' 00" West,
430 . 00 feet; thence South 22°49 ' 00" West, 29 . 29
feet; thence (leaving said Bull Canal) East
532. 11 feet, more or less to the East line of
said Section 12 ; thence North 681.25 feet along
the East line of said Section 12 to the POINT
OF BEGINNING.

CONTAINS: 2. 64 acres more or less.
WHEREAS, the Board of County Commissioners of Weld County,
finds that this particular division of land is not within the
purposes of the Weld County Subdivision Regulations and the Board
desires to exempt this particular division of land from the defini-
tions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-lA(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Douglas and Michael Kirkmeyer be, and
hereby is , exempt from the definition of the terms "subdivision"
and "subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973 , as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 27th day of
May, A.D. , 1981.

RE : Recorded Exemption # 500
Dear Commissioners:
The attached application, plat, and related items are in reference
to a request from Douglas and Michael xirkmeyer for a recorded
exemption. The parcel of land on which this request has been made is
described as Pt S1 NE1, Section 12 , T 1 N, R 68 W of the 6th p.m. ,
Veld County, Colorado. This property is located 14 mile south -of Dacono,
Colorado The property contains
approximately 5.14 acres of Class III irrigated soils.
The request is to split the property into parcels of 2.64 acres and
2.5 acres.
On March 25, 1981, the Board of County Commissioners approved a Lot Size Variance
so the applicant could proceed with his exemption request. At that time the
Department of Planning Service's staff recommended the request be granted. Nothing
has been received to change or alter said recommendation.
