RESOLUTION State of Colorado, Weld County Clerk & Recorder
RE: ESTABLISHING THE PROCEDURE FOR ANY AMENDMENT TO THE PARKLAND
SUBDIVISION IMPROVEMENTS AGREEMENT.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the

affairs of Weld County, Colorado , and

WHEREAS, the Subdivision Improvements Agreement was approved
by the Board of County Commissioners of Weld County, Colorado
concerning the Parkland Subdivision located in Section 7, Town-
ship 1 North, Range 68 West of the 6th P.M. in Weld County,
Colorado, which Subdivision Improvements Agreement has been
recorded in Book 809 , Reception No. 1730930 , Weld County records,
and
WHEREAS, Section 6 . 3 of said Subdivision Improvements Agree-
ment calls for the installation of a 200 , 000 gallon water tank
prior to the issuance of any Certificates of Occupancy upon any
buildings built within the confines of said subdivision, and
WHEREAS, the developers of Parkland Subdivision have indi-
cated their desire to apply for an amendment to said Subdivision
Improvements Agreement with regard to the water system and storage
requirements of said Subdivision Improvements Agreement, and
WHEREAS, the Board of County Commissioners therefore adopts
the following procedure for consideration of any such application
for amendment to the Subdivision Improvements Agreement, to-wit:
1. Any such application for a change in the Subdi-
vision Improvements Agreement shall be in writing
and shall contain documents prepared and certified
by a professional engineer registered in the State
of Colorado and shall certify that the water sys-
tem and storage tanks recommended by said profes-
sional engineer shall be adequate to fulfill all of
the requirements of the subdivision and related

sumption, lawn and garden care and any other reasonable
needs of the inhabitants of said subdivision after
the development of all 91 lots has been accomplished
and Certificates of Occupancy issued on all homes
built thereon and said documents shall further be
certified by said professional engineer that the water
system and storage facilities, as proposed, comply in
all respects with the standards set forth in the Weld
County Subdivision Regulations for water systems.
2. Any such application for an amendment to said Sub-
division Agreement shall be filed with the Director
of Planning Services of Weld County, Colorado, and
the Director of Planning Services of Weld County,
Colorado shall immediately make all referrals to any
required referral agencies who shall review any such
application for amendment to the Subdivision Agreement
within twenty-one (21) days of the date of filing.
The Board of County Commissioners of Weld County,
Colorado shall schedule a public hearing to be
held at a regular meeting of the Board of County Com-
missioners of Weld County, Colorado, at a date not
to exceed twenty-one (21) days from and after the
21-day period for review and referral by the Divi-
sion of Planning Services and any referral agencies
shall expire.
3 . Upon the scheduling of a hearing before the Board of
County Commissioners at a regular meeting, notice of
said hearing, together with a summation of the proposed
changes to the Subdivision Agreement, shall be mailed,
certified mail, return receipt requested, to all record
owners of lots located within the confines of Parkland
Subdivision, being the North Half of Section 8 , Town-
ship 1 North of Range 68 West of the 6th P.M. in Weld

County, Colorado, advising said landowners that they
may appear and be heard at the public hearing at which
the proposed amendment to the Subdivision Improvements
Agreement shall be considered by the Board of County
Commissioners of Weld County, Colorado.
4 . Commencing on April 23, 1980, which is the date of this
resolution, the Board of County Commissioners of Weld
County, Colorado consider the original Subdivision
Improvements Agreement, as amended, in full force and
effect and will abide by its terms which include the
issuance of building permits on all lots platted within
the Parkland Subdivision and which further prohibits
the issuance of Certificates of Occupancy for any
structure prior to the installation of the 200 , 000
gallon water storage tank which is shown on the final
plat and which is referred to in paragraph 6 . 3 of said
Subdivision Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove proce-
dure for any amendment to the Parkland Subdivision Improvements
Agreement be, and hereby is, established.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of
April, A.D. , 1980.
