RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 722 - CHARLES EVANS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners , pursuant to its authority under Section 30-28-101 (10) (d) , CRS , as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 722 , does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS , the request for Recorded Exemption No. 722 was submitted by Charles Evans for property which is located in the S1 NWa NWo , Section 3 , Township 2 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS , this request is to divide the property into parcels estimated to be approximately 17 acres and 3 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be , and hereby is, exempt from the definitions of "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1) the applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The parcel of land on which this request is being made is described as the S1 NW' NW1, Section 3, T2N, R67W of the 6th P.M. , Weld County, Colorado. The property is located 3.75 miles northeast of Firestone on Weld County Road 19. The property contains approximately twenty (20) acres of Class file, IVw irrigated and IVe, VIw nonirrigated soils. The parcel of land under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 17 acres and 3 acres, more or less. Mr. Evans would like to construct a new residence on the proposed smaller parcel. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2C. of the Weld County Subdivision Regulations submission requirements; and 2. Evans am respectfully requesting through the Department of Planning and Board of County Commissioners that a recorded exemption be allowed to separate approximately three ( 3) acres from the approximate twenty (20) acres that I now own. This request is being made for the following purpose and reasons. Do to my age and health plus running a business, I find that I have less time and more difficulty in spend- ing enough time in order to keep the place looking the way I feel it should. In separating the approximate three acres from the approximate twenty acres, it would allow me to slow down and the three acres would give me enough land to build a small home on that I can care for properly . Also, I would rather live on the smaller plot that I already own rather than try to find something else that I might not be happy with. This would also allow me to remain around those neigh- bors that are my friends . I feel this proposal is consistant with the policies and the zone district of the weld county comprehensive plan because it would not be changing the farm and rural atmosphere and would be consistant with other such past exemptions in the immediate area. It would not be in any way inconsistant with future orderly development and the property under consideration in this requested exemption is not located in a flood plain, geologic hazard or weld county airport overlay district. If this request is granted, I would apply for all necessary building permits and etc. to build a new home on the approx- imate three acres, at a later date.
