CARLSON, 23016 WELD COUNTY ROAD #74, EATON, COLORADO 80615 WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 31st day of December, 1980 at the hour of 2: 00 o'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of John C. Carlson, 23016 Weld County Road #74 , Eaton, Colorado 80615, for a Special Use Permit for a commercial swine operation on the following described real estate, to-wit: Part of the North Half of Section 1, Town- ship 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, the petitioner was present, and WHEREAS , evidence was presented in support of the granting of the Special Use Permit for a commercial swine operation on the above described real estate, and WHEREAS, Section 3 . 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon appro- val by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent, has studied the request of the petitioner and the recommenda- tions of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a commercial swine operation on the hereinabove described real estate conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of John C. Carlson for a Special Use Permit for a commercial swine opera- tion on the hereinabove described tract of land be, and hereby is , PL0741 800358 granted subject to the following: 1. Plans and design for the proposed lagoons shall be submitted to the Weld County Health Depart- ment prior to construction of the lagoons. 2 . The Development Standards contained in the Spe- cial Use Permit. 3. The Development Standards for the Special Use Permit and the property owner ' s signature shall be placed on the Special Use Permit plat and the plat shall be delivered to the office of the Department of Planning Services. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval contained in the Weld County Planning Commission recommendations dated December 16 , 1980 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. All other uses permitted by right in the Agricultural District and uses previously approved by Special Use Permits shall be permitted on the property. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 4. Lagoons shall be installed in accordance with REGULATIONS FOR THE CONTROL OF WATER POLLUTION FROM FEEDLOTS, August 1974, Colorado Department of Health, specifically paragraph 8. 1 .4. The applicant shall be responsible for any ad- ditional applicable directives or guidelines issued by the Colorado Department of Health, Water Pollution Control Division. 5. The Soil Conservation Service has suggested in a letter dated November 26, 1980 that this request be denied until more information is provided regarding potential high watertables on the proposed site and the effect on the proposed lagoons. The Department of Planning Services Staff feels that Development Standard #4 and Condition #1 adequately addresses this concern and the con- cerns of the Colorado Geological Survey expressed in its letter of November 21 , 1980. 2. The Weld County Engineering Department has recommended in a memorandum dated November 18, 1980 that permanent buildings and lagoons should not be constructed in low lying areas subject to flooding. 3. To date our office has not received any opposition to this request from surrounding property owners. 4. The Galeton Area Fire Protection District did not respond to the referral sent to it. We are planning to construct a total confinement hog finishing unit which will handle up to 1500 hogs at one time. The finishing barn will be of pole barn construction with cement floors pitched to drain to the slats in the middle. This will in turn flush to a pit constructed of cement at the lower end of the barn. The manure will then be spread on the adjacent farm ground. The water supply will consist of a domestic well. A minimal electrical hook up will be required. We project that two loads of feeder pigs will be brought to the barn per week and approdimately two loads of fat hogs will be leaving per week. The area indicated in the request is made up of the soil type Aquolls and Aquepts, flooded (34-U). This is a nearly level soil on smooth plains in _ - depressions and along the bottoms of natural drainageways. It is usually a deep, poorly drained soil. These areas are usually subject to excessive runoff and watertables at or near the surface in the spring and during the peak irrigation season. These are not prime farmland soils. -..== The major hazard or limitations of the soil for use as a confined hog facility is the possible high watertable. The presence of a watertable will require special site design and building design to account for possible high frost action in winter and water conditions in the spring and summer. Twenty percent of this mapping unit (Aquolls and Aquepts, flooded) , may be made up of soils which are well drained and have sandstone or shale within - 48 inches of the surface. If the confined hog facility happened to be located in one of these areas, the plans and design for buildings and facilities would be very different. I suggest that a qualified soil engineer investigate the site and prepare design information for planned building and facilities. Attached is a soil map and soil description for your information. Box 86 Greeley, CO. 80632 I have reviewed the request from Chuck Carlson, Special Use Permit for a Commercial Swine Operation, to be located in the NZ of Section 1, Twp. 6N, Range 65W, two miles west of Galeton, Weld County, Colorado. The soils information provided to Mr. Carlson on October 15th, 1980 indicated the area under consideration for the planned project is a deep, poorly drained soil which is usually subject to excessive runoff and high watertables. There is no data presented with this plan to prove site conditions are different than those cited above. Animal waste lagoons will surely be into the water table, which will have a very detrimental effect on water quality, both for surface and subsurface. Even with construction of a concrete vault tank type waste storage, underground water will create many problems unless certain engineering and construction standards are followed. I would suggest that this request be denied until more plan information is provided so that a more adequate determination can be made. incere , Ronald D. Miller District Conservationist Greeley Field Office xc: Weld County Department of Planning Services P/— RDM:jb ,'s • 4 - Aquolls and Aquepts , flooded I' r These nearly level soils are on smooth plains in depressions and along the bottoms of natural drainageways throughout the survey area. • The Aquolls , which have dark colored surface layers , make up about 55 percent of the mapping unit. The Aquepts , which have lighter colored s""rface layers , make up about 25 percent. About 20 percent is made up of soils which are well drained and soils which have sandstone or shale within 48 inches of the surface . These are deep , poorly drained soils . They formed in recent alluvium. Typically they have mottled , mildly to moderately alkaljne , loamy or clayey surface layers and underlying materials which extend to a depth of 60 inches or more. They may or may not have a gleyed layer in the 1 underlying material. Most of these soils are subject to excessive runoff. A watertable is at or near the surface in the spring and during the peak of the irri- gation season. These soils are used for rangeland and wildlife habitat . Some small areas are used for irrigated pasture. The potential native vegetation on these soils is dominated by switch grass . prairie cordgrass , saltgrass , alkali sacaton , big bluestem, Indiangrass , western wheatgrass , slender wheatgrass , sedge and rush. Cattails and bullrush occur on swampy spots associated with this site . Much of this site has an increased amount of salts due to farming and irrigation of adjacent areas . Potential production ranges from 4000 .%a I 3 17l1 pounds per acre in favorable years to 3000 pounds per acre in unfavorable years. When range condition deteriorates the tall and midgrasses decrease , production drops and saltgrass sedge and rush increase. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Switchgrass , big bluestem Indiangrass , western wheatgrass , pubescent wheatgrass , intermediate wheatgrass , tall wheatgrass and tall fescue are suitable for seeding. The plants selected should meet the seasonal requirements of livestock For successful seeding, a firm, prepared seedbed -- several tillage operations will normally be needed to eliminate the undesirable vegetation-- and a grass drill should be used. Early spring seeding has proven most successful. t..��. Wetland wildlife , especially waterfowl, utilize these areas . The a- i availability of moisture due to the wetness of this soil allows pro- duction of wetland plants that provide nesting and protective cover •I as well as some food for waterfowl . The juxtaposition of this soil . to irrigated cropland areas where wildlife obtain much of their food . along with the cover provided , make this soil valuable to both wetland and openland wildlife. { Openland wildlife , especially pheasants . use these areas for cover and nesting , while they also provide excellent cover for deer when found in areas inhabited by deer. Management for wildlife would include prevention of overgrazing by 1r---- livestock , protection from unplanned fire , and prevention of drainage . • J � 2'47— ‘446007 Where livestock are present , these valuable wildlife areas should be fenced to prevent encroachment and overuse by livestock.
