PURSUANT to the provisions of Sections 24-4-103(5) , 24-4-103(11) (d) , C.R.S. ,
19-3, as amended.
NOTICE is hereby given that the Colorado Water Quality Control Commission, after
public hearing on May 17, 1982, pursuant to public notice issued on February 17,
1982, complying with the provisions of C.R.S. 1973, 24-4-103, 25-8-102(5) ,
25-8-202(1) (b) and (2) , 25-5-204, 25-8-401, 25-8-402, and 25-8-702, adopted
pursuant to C.R.S. 1973, 25-8-401 (2) and Section 2.1.8 of the "Procedural Rules
for All Proceedings Before the Water Quality Control Commission and the Water
Quality Control Division" the regulatory revisions to Section 3.9.5 of the
Commission's Current regulation titled:
"COLORADO RIVER SALINITY STANDARDS"
ALSO pursuant to C.R.S. 1973, 24-4-103(8) (b) , this regulatory revision and the
current regulation were submitted to the Attorney General for review and were
found to be within the authority of the Water Quality Control Commission to
promulgate and further that there are no apparent constitutional deficiencies
in their form or substance; furthermore, this revision and regulation incorporate
by reference a general statement of their basis and purpose and economic
reasonableness and a fiscal statement in compliance with C.R.S. 1973, 24-4-103(4)
(8) (d) , and 25-8-102 (5) , as amended.
Publication in the Colorado Register as required by C.R.S. 1973, 24-4-103(5)
having been accomplished, these regulations will become effective June 30, 1982.
Regulation 3.9.0 with revision to 3.9.5 is attached and made a part of this
NOTICE.

Control Division" the revision to Section 6.9.2(1) of the current regulation
titled:
"REGULATIONS FOR THE STATE DISCHARGE PERMIT SYSTEM"
ALSO pursuant to C.R.S. 1973, 24-4-103(8) (b) , this revision to the current
regulation was submitted to the Attorney General for review and was found
to be within the authority of the Water Quality Control Commission to
7=-Tomulgate and further that there are no apparent constitutional deficiencies
in their form or substance; furthermore, this revision incorporates by reference
a general statement of its basis and purpose and economic reasonableness
and a fiscal statement in compliance with C.R.S. 1973, 24-4-103 (4) (8) (d) ,
and 25-8-102 (5) , as amended.
The revision was required because the entire sub-section (1) is not being
extended by the General Assembly and was scheduled to expire June 1 , 1982
under section 24-4-103 (8) (c) (I) , C.R.S. 1973.
Publication in the Colorado Register as required by C.R.S. 1973, 24-4-103 (5-
having been accomplished, this revision will become effective June 30 , 1982.
Section 6.9.2 (1) as revised, is attached and made a part of this Notice .

NOTICE OF ADOPTION UNDER EMERGENCY CONDITIONS
PURSUANT to the emergency provisions of Sections 24-4-103(6) , C.R.S. 1973, as
amended.
NOTICE is hereby given that the Colorado Water Quality Control Commission, after
a public hearing on May 18, 1982, pursuant to public notice issued on March 30,
1982, complying with the provisions of C.R.S. 1973, 24-4103(6) , 25-8-202(d) ,
25-3-304, 25-8-401, 25-8-501 through 25-8-SOS, adopted pursuant to C.R.S. 1973,
25-8-401 (2) and Section 2.1.8 of the "Procedural Rules for All Proceedings Before
the Water Quality Control Commission and the Water Quality Control Division"
the revision to Section 6.9.2(1) of the current regulation titled:
"REGULATIONS FOR THE STATE DISCHARGE PERMIT SYSTEM"
A1.S0 pursuant to C.R.S. 1973, 24-4-103(8) (b) , this revision to the current regulation
was submitted to the Attorney General for review and was found to be within the
authority of the Water Quality Control Commission to promulgate and further that
there are no apparent constitutional deficiencies in their form or substance;
furthermore, this revision incorporates by reference a general statement of basis
and purpose and economic reasonableness and a fiscal statement in compliance with
C.R.S. 1973, 24-4-103(4) (8) (d) , and 25-8-102(5) , as amended.
The action of the Legal Services Committee means 6.9.2(1) as originally adopted
will not be effective beyond June 1 , 1982. In order to prevent a gap in the
effectiveness of the first sentence of 6.9.2(1) between June 1 , 1982 and June
30, 1982, the Commission re-adopted said sentence as an emergency rule in
accordance with 24-4-103(6) to obviate the necessity of an additional hearing.
These regulations will become effective and made a part of this Notice.

NOTICE OF HEARING
IN THE MATTER OF WELLINGTON MUDDY UNIT
LARIMER COUNTY, COLORADO
On August 18. 1981 and February 18, 1982 the Division
of Administration of the Colorado Department of Health
( "division" ) issued notices of violation and cease and desist
orders to certain persons who have an interest in, or oper-
ate, the Wellington Muddy Unit oil field, located in Larimer
County, Colorado. Copies of the notices of violation and
cease and desist orders are attached to this notice. Pur-
suant to C.R.S. 1973, 25-8-603 ( Supp. 1981 ) tne parties to
whom the notices of violation and cease and desist orders
were issued have requested a hearing on the notices of viola-
tion. The hearing on this matter has been set for June 21
and 22. 1982, commencing at 9 a.m. in the following loca-
tions: June 21 , room 617. 1525 Sherman Street , Denver , Colo-
rado; June 22, Room 404, 1575 Sherman Street, Denver , Colo-
rado.
Party status in this matter may be obtained in accord with
C .R.S. 1973. 24-4-105 (2 ) and rule 2. 1 .7 of the "Procedural
Rules for All Proceedings Before the Water Quality Control
Commission and the water Quality Control Division , " 5 C .C.R .
1002-1 at 7-8. Any person who may be affected or aggrieved
by the agency action which is the subject of this hearing
shall be admitted as a party upon filing an appropriate and
timely written request. Applications for party status shall
be filed in writing with the hearing officer in this matter
no later than June 11 , 1982, at tne Division of Hearing Offi -
cers, State Services Building, Room 207, 1525 Sherman Street .
Denver , Colorado 80203. Thereafter. applications to oe
made a party shall not be considered except upon motion for
good cause shown. Party status may be granted by the hearing
officer. except that the hearing officer ' s decision must be
affirmed oy the division upon petition of any party.
Applications for party status shall indicate the gen-
eral nature of the individual or group applying, the reasons
for seeking admittance as a party, and the general nature
of the testimony to be presented oy the applicant.

On April 17 , 1981 , the Division of Administration of
tne Colorado Department of Health ( "the division" ) issued a
notice of violation and cease and desist order ( "the notice
and order" ) to Viking Petroleum, . Inc. captioned " In the mat-
ter of Viking Petroleum, Inc." An answer was subsequently
submitted to the division wherein it was stated that the
proper corporate name of the recipient of the notice and
order is Viking Petroleum Reserves , Inc . ( "Viking" ) . The
answer also stated that tne area referred to in the notice
and order as the wellington field is known as the Wellington
Muddy Unit. Henceforth, all documents filed in connection
with this matter shall be captioned " In the Matter of Wellington
Muddy Unit" and the notice and order is hereby amended to
contain that caption.
Viking also stated in its answer that it does not con-
duct oil and gas activities in the wellington unit. It also
stated that "certain reports have been made by the owners
of the property in the name of Viking" and that the answer
was submitted on their behalf as well as on behalf of Viking.
PUrsuant to C.R. S . 1973 , 25-8-304, 8S_dQeoded_I;Y S .B. 10
( 1951 ) you are hereby ordered to state the nature of Viking ' s
interest in the Wellington Muddy Unit , to state the names
of all other persons or entities Molding an interest in the
Wellington Muddy Unit , and to identify the nature of the
interest of each person or entity.

Pursuant to the authority vested in the division by
C .R. S. 1973 , 25-8-301 -308 , aa_aoecdld_DX S . B. 10 ( 1981 ) .
which authority has been delegated to me by the executive
director of the Department of Health. I hereby make the fol —
lowing findings of fact :
1 . On April 17, 1981 . the division issued the notice
and order to Viking. A copy of the notice and order is
attached hereto as exhibit A and incorporated by reference.
Viking did not request a hearing on the notice and order .
2 . The cease and desist order required Viking to
immediately cease and desist all discharges into state waters
from the Wellington Muddy Unit in violation of the Colorado
water Quality Control Act . C .R. S. 1973 , 25-8-101 ett_aeg.
( "the Act" ) .
3 . Contrary to the terms of the cease and desist
order , pollutants were discharged from the Wellington Muddy
Unit into the North Poudre Irrigation Ditch, which feeds
into, Wasson Lake and the Wellington No. 3 Reservoir , on the
following dates in 1981 : April 23 , - 24 , 25 , 26 , 27 , 28 , 29 ,
30 and May 1 .
4 . North Poudre Irrigation Ditch, Wasson Lake, and
Wellington No . 3 Reservoir are "state waters" as defined in
C .R. S. 1973 , 25-8- 103 ( 16 ) .
5. Neither Viking nor any other party having an
interest in the Wellington Muddy Unit holds a permit author-
izing discharges of pollutants into state waters from the
Wellington Muddy Unit , nor do any of those parties have a
Pending application for such a permit.

you are hereby notified that the facts stated above
constitute violations of C.R.S. 1973 . 25-8-501 ( 1 ) (Cum. Supp.
1980 ) which provides in pertinent part : "No person shall dis-
charges any pollutant into any state water from a point
source without first having obtained a permit from the divi -
sion for such discharge."
The facts stated above also constitute violations of para-
graph one of the April 17 , 1981 cease and desist order .

Pursuant to the authority vested in the division by
C .R. S. 1973 , 25-8-301 - 308 ( Supp. 1981 ) , which authority
has been delegated to me by the executive director of the
department , I hereby make the following findings of fact .
1 . The Wellington Operating Company ( "Wellington" )
conducts various activities related to the production of
oil from an oil field near wellington, Colorado. The area
is known as the Wellington Muddy Unit ( "the unit" ) .
2. Milton D. McKenzie , Thomas E . Fenno, F .M. Bernard ,
Wesley R. McKinney , and Richard L . Harris are the owners
of the oil and gas leasehold estate covering the wellington
Muddy Unit.
3. Upon information and belief, the division asserts
that Viking Petroleum Reserves , Inc. also has an interest
in the Wellington Muddy Unit.
4 . On April 17 , 1981 the division issued a notice
of violation and cease and desist order to Viking Petroleum,

Based on the forgoing findings of fact and notice of
violations and pursuant to L .R.S . 1973 , 25-8-605 , ai_ameplled
pX S.8. 10 ( 1981 ) , 1 hereby order you :
1 . - to immediately cease and desist from discharging
pollutants into state waters from the Wellington Muddy Unit
in violation of the Act ;
2 . to notify the division in writing, within five
days after service of this order , of your intent to comply
herewith.
C .A. S. 1973 , 25-8-603 , aa_ayenclet_px S.B. 10 ( 1981 ) .
provides that if the division does not require a hearing an
alleged violator may request the division to conduct such a
hearing. Such request shall be in writing and shall be
filed no later than 30 days after service of this notice
and order . The filing of an answer to the notice of viola-
tion does not constitute a request for a hearing. Absent
such a request , the division may resolve without a hearing
any issues raised by the answer to the notice of violation.
Penalties may be imposed upon violators pursuant to C .R. S .
1973 . 25-8-608.-609. For clarification of the rights of
recipients of notices of violation and cease and desist
orders , parties are advised to consult the Act.
Notning herein contained . particularly those portions
requiring certain acts to be performed within a certain
time , shall be construed as a permit or license, either to
violate any provisions of the public health laws and regula-
tions promulgated thereunder . or to make any discharges
into state waters .

cessation of all point source discharges into state waters
from the unit in violation of the Colorado water Quality Con-
trol Act , C .R . S . 1973 , 25-8-101 , ( Supp. 1981 ) ( "the
Act" ) .
6 . On May 18 , 20, and 22 , 1981 a representative of
the Larimer County Health Department inspected the unit and
observed pollutants being discharged from a point source
into the Nortn Poudre Irrigation Ditch which feeds into
Wasson Lake and the Wellington No. 3 Reservoir .
7 . North Pouare Irrigation Ditch, Wasson Lake. and
Wellington No. 3 Reservoir are "state waters" as defined in
C .R. S. 1973 , [5-8- 103 ( 16 ) .
8. Neither Viking nor any other party having an
interest in the unit Holds a permit authorizing discharges
of pollutants into state waters therefrom.

You are hereby notified that the facts stated above
constitute violations of L.R.S . 1973. 25-8-501 ( 1 ) (Supp.
1980 ) which provides in pertinent part : "No person shall dis-
charge any pollutant into any state water from a point source

The facts stated above also constitute violations of
paragraph one of the April 17 , 1981 cease and desist order .
