RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR TWO LOTS, EACH WITH A PRINCIPAL DWELLING PER LOT - CARROLL V. SoRELLE WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 10th day of August, 1983 , at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board for the purpose of hearing the application of Carroll V. SoRelle, c/o Will Purdy, 1964 18th Avenue, Greeley, Colorado 80631 , for a Use by Special Review for two lots, each with a single family dwelling unit per lot, other than those permitted under Section 31 . 2 . 1 of the Zoning Ordinance on the following described real estate, to-wit: Part of the Si SE4, Section 29 , Township 5 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1 . The submitted materials are in compliance with the appli- cation requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a) The proposal is consistent with the Comprehensive Plan and the intent of the Agricultural Zone District because the predominant soils on the property are valent sand, Class Sixty-Nine (69) and Seventy (70) and are not considered prime agricultural crop land. Both lots are presently growing hay crops . b) The use is both compatible with existing agricultural activity and with land use in the area. There are approximately nineteen (19) parcels of land, forty acres , or less , in size surrounding the subject pro- perties. Both parcels have access to Weld County Road 53 . f) No overlay districts affect the site. Operation de- sign standards provide adequate protection of the health, safety and welfare of the neighborhood and the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application for a Use by Special Review for two lots , each with a principal dwell- ing per lot, on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions : 1 . The attached Standards for Use by Special Review be adopted , as amended. 2. The plat for the Use by Special Review Permit be placed of record by the Department of Planning Services staff prior to any building permits being issued on the site. SORELLE 1. The type of use shall be one (1) single family dwellings each on a separate nonirrigated forty (40) acre parcel in the "A" (Agri- cultural) Zone District. 2. The proposal shall comply with the Design Standards for Uses by Special Review, Section 24.5 et seq. of the Weld County Zoning Ordinance. 3. SoRelle for a Use by Special Review for two lots, each with a single family dwelling unit per lot other than those permitted under Section 31.2.1 of the Weld County Zoning Ordinance. Mr. Morrison read this request into the record. Rod Allison read the favorable recommendation, with conditions, fran the Planning Cat¢nission into the record. William Purdy, realtor, was present representing the applicant. He stated that the parcel is eighty acres, more or less, and they wish to divide • the parcel in half. Bruce Solomon, an adjacent landowner, questioned the set back requirement. Commissioner N. Carlson stated that the hares must be set back further than 55 feet from the center of the road. Mr. Solomon did not object to the request. Operation Standard #6 was read into the record and considered. The Operational Standard #6 read as follows, "Part of the SW4 SEa, Section 29, T5N, R64W of the 6th P. M. , Weld County Colorado shall have access to Weld County Road 53 via Weld County Road 52, a dedicated Right-of-Way." Mr. Morrison suggested that the Right-of-Way be private so that the County does not have to maintain said road. In this area, Weld County Road #52 has not been developed, however, the County does own the Right-of-Way. Mr. Morrison suggested that the smaller parcel have a reservation for access to Weld County Road #52. Herman Wohenberg, an adjacent landowner, stated that a fence runs down the center of where Weld County Road #52 would be if installed. He asked if the fence would have to be removed. At this time Weld County does not have any plans to develop Weld County Road #52. Commissioner N. Carlson stated that the owners must use the north side of the Right-of-Way on the north side of the fence and the fence need not be removed. After discussion, Commissioner N. Carlson moved to approve this request with the conditions as set forth by the Weld County Planning Commission and that operation standard #6 be amended to read as follows: #6.
