RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 499 - UNION
COLONY BANK
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on the 20th day
of May, 1981 , approved Recorded Exemption No. 499 concerning
property described as Part of the N', Section 1 , Township 6 North,
Range 65 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, Union Colony Bank is now requesting that Recorded
Exemption No. 499 be amended to decrease the size of Lot B from
160 . 4 acres to 136 . 622 acres, more or less, and
WHEREAS , the Board of County Commissioners has studied said
request to amend Recorded Exemption No. 499 and deems it advisable
to approve same.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the amendment to
Recorded Exemption No. 499 , requested by Union Colony Bank, be,
and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the applicant shall
submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The
plat shall be drawn in accordance with the requirements of Section
9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety days from the date of approval by
the Board of County Commissioners.

Re: Amended RE 499
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Union Colony Bank for a recorded exemption. The parcel of
land on which this request is being made is described as Part of the Nei
Section 1, T6N, R65W of the 6th P.M. , Weld County, Colorado.
This request is being done in conjunction ith another
both recorded amended
exemption (Amended RE 370) . The applicants are amending
exemptions for farming efficiency purposes. Approval of this amendment to
RE 499 will change the lot size of Lot B from 160.4 acres more or less to
136.622 acres more or less. Approval of this amended recorded exemption
will not create any additional residential building rights. Both properties
will continue to be used for agricultural purposes.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The impact on agricultural surrounding land uses does not
appear to be significatnly different than the original request
approved on May 20, 1981.
2. The request complies with Section 9-2E. of the Subdivision
Regulations.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements

Dear Mr. Mayerl:
Attached are the two Applications for Recorded Exemption Amendments as instructed
by your office.
The following two property owners:
Union Colony Bank (Bank), owners of Lot 'B' Recorded Exemption No. 0603-1-2-RE499
and Marvin L. Bay and Mildred N. Bay (Bay's), owners of Lot 'B' Amended Recorded
Exemption No. 0803-1-4-RE370; both of which are located in Section 1, Township 6
North, Range 65 West of the 6th P.M. , Weld County, would like to change their
respective property lines. Bank would like to convey that portion of Bank's
property east of the creek and Bay's would like to add that same land to their
electric sprinkler to irrigate subject land and more of their own land. Also,
subject land would allow Bay's to have better access to the back portion of
their own land. Bay's property borders subject property along the east and
south portions of subject property. The attached air-photo shows the relativity
of the properties.
Although the Bank's property and Bay's property are each Recorded Exemptions,
this transaction does not create a "new" piece of property, only a deletion of
one and an increase on the other. This exchange of property should be con-
sistant with the policies of the Weld County Comprehensive Plan, and should also
be consistent with the intent (agriculture) of the zone district in which subject
property is located. The use will not change. Irrigated crop land and pasture
has been what the subject property has been and will be used for. No additional
residential sites will be created, therefore water and sanitation will be the
same as previously approved, i. e. , North Weld County Water District and septic
tanks.
Both parties are very familiar with the potential flood condition of the creek.
Nearly all of the subject property is above the primary flood plain.
