RE: APPROVAL OF RECORDED EXEMPTION NO. 691 - EARL D. MACKEY
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels ,
as shown on the plat known as Recorded Exemption No. 691 , does
not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No. 691 was
submitted by Earl D. Mackey for property being located in Part
of the SE4 NE4, Section 32, Township 5 North, Range 65 West of
the 6th P.M. , Weld County, Colorado, being more particularly
described in the plat which shall be provided by the applicant
and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
of 30 acres and 5 acres, more or less , so that the applicant may
sell the larger parcel and retain the 5 acre parcel as his resi-
dence.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is , exempt from the defi-
nition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations . The plat shall be submitted with-
in ninety days from the date of approval by the Board of County
Commissioners .

Re: Recorded Exemption #691
Dear Commissioners:
The attached application, plat and related items are in reference to a request
from Earl D. Mackey for a recorded exemption. The parcel of land on which
this request is being made is described as Part of the SEti NE1 Section 32,
T5N, R65W of the 6th P.M. , Weld County, Colorado.
The property is located one (1) mile northeast of LaSalle on WCR 41. The
property contains approximately 35 acres of Class IIs prime, VIIs irrigated
and VIIs nonirrigated soils. The parcel of land under consideration is the
total contiguous land holdings of the applicant.
The request is to divide the property into parcels of 30 acres and 5 acres,
more or less. There are no improvements on the 30 acre parcel. The applicant
is retiring and proposes to sell off the 30 acre parcel. He proposes to
retain the 5 acre parcel, which has the improvements on it, as his residence.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The request complies with Section 9-2C. of the Weld County
Subdivision Regulations submission requirements; and
2. The request complies with Section 9-2E. of the Subdivision
Regulations as follows:
- The 35 acres, more or less, under consideration will
be compatible with the existing surrounding land uses and
with future development of the surrounding area as
permitted by the existing Agricultural Zone. The proposal
is also consistent with the intent of the Agricultural
Zone District.
- The proposal was reviewed by the city of LaSalle and was
found to comply with their long-range Comprehensive Plan.

- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land
division complies with the Weld County Comprehensive Plan.
Therefore, the proposed use is consistent with efficient
and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- Central Weld County Water District has indicated adequate
water service is available for this proposal.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from WCR
41.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety (90) days from the date of approval by
the Board of County Commissioners.

To whom it may concern:
I wish to apply for a Recorded Exemption to divide my property into two lots.
I have owned this 35 acres since 1941. I have approximately 30 acres of level
irrigated farm land which I farmed myself for many years. As I have been re-
tired, I have been leasing the 30 acres to a neighboring farmer, so wish to
break that land off from my present home and accompaning buildings so I can
sell the 30 acres of farm land. I plan to keep the home and continue to live
in it. The remaining 5 acres is above the Union Ditch and does not receive
the irrigation water. All the improvements are on the 5 acres.
This proposal is consistent with the policies of the Weld County Comprehensive
Plan.
This proposal is consistent with the intent of the zone district in which the
subject property is located, as the zoning will not change from the presently
zoned agriculture district.
Uses that will be permitted are for rural residential and agriculture only.
These uses are compatible with existing surrounding land uses which are all
rural residential and agriculture.
The uses permitted will be compatible with the future development of the
surrounding area as permitted by the existing zone and with future development
as projected by the comprehensive plan of the County and the adopted master
plan of the municipality of LaSalle, Colorado.
This proposal will not be inconsistent with efficient and orderly development
of the area.
The proposed water for the property will be supplied by Central Weld Water
District. It is located in a satisfactory area for a septic system.
The property under consideration is not located in a flood plain, geologic
hazard, or the Weld County Airport overlay district.
