RE: APPROVAL OF RECORDED EXEMPTION NO. 616 - ADOLPH AND BETTYE
ANDERSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 616 , being the property of Adolph
and Bettye Anderson, described as part of the W1 SWa, Section 22 ,
T2N, R66W of the 6th P.M. , Weld County, Colorado, being more par-
ticularly described in the plat which shall be provided by the
applicants and known as Exhibit "A" , said plat to be recorded,
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Adolph and Bettye Anderson be, and hereby
is , exempt from the definition of the terms, "subdivision" and
"subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the following: 1) The applicants shall submit
evidence to the Department of Planning Services staff of an
adequate water supply source prior to the issuance of building
permits; and 2) the applicants shall submit a mylar plat to the
Department of Planning Services Office to be recorded in the
office of the Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2 C. (4) of the
Weld County Subdivision Regulations. The plat shall be sub-
mitted within ninety (90) days from the date of approval by
the Board.

Re: Recorded Exemption #616
Dear Commissioners;
The attached application, plat and related items are in reference to a
request from Adolph and BettyeAnderson for a-recorded exemption. The
parcel of land on which this request is being made is described as part
of the W1 SW14, Section 22, T2N, R66W of the 6th P.M., -Weld County,
Colorado.
The property is located 2.5 miles northeast of Fort Lupton on Weld County
Road 18. The property contains approximately 57.5 acres of Class Ile,
IIIe, IVe and VIe irrigated and Die and VIe nonirrigated soils.
The request is to divide the property into parcels of 47.5 acres and
10 acres, more or less. The intent of this exemption is to separate
the ten (10) acre tract of land for a greyhound breeding and kennel
facility.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2 C. of the Weld County
Subdivision Regulations submission requirements;
2. The request complies with Section 9-2 E of the Subdivision
Regulations as follows:
- The 57 acres, more or less, under conoideration will
allow agricultural and related uses to be the predominant
uses. The use will be compatible with existing and
surrounding uses. These facts also support the pro-
posal as being consistent with the intent clause of the
Agricultural Zone District;

- The proposal was reviewed by the town of Fort Lupton
and was found to comply with their long-range Comprehen-
sive Plan;
- The proposal is in compliance with Section I-3 of the
Weld County Subdivision Regulations and the proposed
land division complies with the Weld County Comprehen-
sive Plan, therefore the proposed use is consistent with
efficient and orderly development;
- The proposal does not exist in an overlay district area;
- The proposed lots meet minimum lot size requirements for
land division;
- The applicants have applied to the Division of Water •
Resources for a commercial well permit;
- The proposed lots are not part of a recorded exemption
within the last five (5) years;
- The two lots proposed will have adequate access from
Weld County Road 18;
- The Weld County Health Department has indicated, in a
letter dated May 10, 1983, that both lots will have
adequate sewage capacity.
The Department of Planning Services recommendation for approval is conditional
upon the following:
1. The applicant shall submit evidence to the Department of
Planning Services staff of an adequate water supply source

2. The applicant shall submit a mylar plat to the Department of
Planning Services office to be recorded in the office of
the Clerk and Recorder. The plat shall be drawn in accord-

1. Statement of Purpose
To allow separation of ten acre tract from larger agricultural parcel
(57.5 acre prior to separation) for purpose of development of grayhound
breeding and kennel facility.
2. Consistency with Weld County Comprehensive Plan
Dog Kennels are use allowed by special use permit in the agriculturally
zone areas. There are several existing dog kennels in this general vicinity.
3. Consistency with Intent of A&ricultural District
Proposed use is not incompatible with agricultural use and proposed area
for recorded exemption is only marginally productive crop land or grazing.
Proposed use will provide maximum ulitization.
4. Compatibility with Existing and Surrounding Uses
Proposed Rec. Exeption area is immediatly across Road 18 from Aristocrat
Ranchettes, consisting of one to five acre residential parcles. Dog
kennel fits in nicely with Aristocrat Ranchettes development and does not
conflict with or interfer with continued agricultural use of surrounding
areas.
5. Compatibility with Future Development
As no contiguious residential development is anticipated and continuing
agricultural use is likely no conflict with future development is anticipated.
6. Consistency with Orderly Development
Development has already occurred. No additional development in forseeable
future is anticipated.
7. Overlay District Compliance
