RESOLUTION RE: ACTION OF THE BOARD OF COUNTY COMMISSIONERS CONCERNING THE SITE APPLICATION OF THE CITY OF GREELEY FOR A WASTEWATER FACILITY. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of .administering the affairs of Weld County, Colorado, and WHEREAS, the City of Greeley, Colorado is presently in the process of developing a new wastewater treatment system to meet the future needs of the community, and WHEREAS, the regulations of the Colorado Water Quality Con- trol Commission require a hearing for a site approval before construction may be started and further, that various local and state agencies be given the opportunity to review and com- ment on the Site Application, and WHEREAS, said Site Application has been submitted to the Board of County Commissioners of Weld County, Colorado for its review and comment, and WHEREAS, state law does not provide for a hearing before the Board of County Commissioners on a land use matter such as this one, which is presented by a public entity, and WHEREAS , the Board of County Commissioners of Weld County, Colorado desires to issue a "no comment" concerning said Site Application for the reason that no Special Use Permit hearing was held before the Board of County Commissioners and therefore, the Board has no basis for a determination in this matter. NOW, THEREFORE, BE IT RESOLVED that the Board of County Com- missioners does hereby issue a "no comment" , for the reason stated herein, concerning the Site Application of the City of Greeley for a wastewater facility. BE IT FURTHER RESOLVED by the Board of County Commissioners that the Chairman of the Board be, and hereby is , authorized to sign said Site Application. It is the opinion of the Planning Commission that the request is consistent with the basic goals and policies of the Weld County Comprehensive Plan. Within the Plan, it is stated that the Plan is: ". . .a direction for development based upon two fundamental determinations: (1) that agriculture has historically been and should remain as the basis for Weld County's economic and ecological well being, and (2) that urbaniza- tion can best be served by existing municipalities." In setting forth the second fundamental determination - "that urbanization can best be served by existing municipalities" - the Plan, in various instances, recognizes the need for municipalities to develop service capabilities to mcct the demands of expanded populations. For example, the Plan states: A. Page 10 - "The rapid population growth of the County can be expected to continue and even accelerate with increasing pressures for residential, commercial and industrial development. This increased population will require a corresponding increase in public facilities and services. B. Page 11 - "Development around existing towns should be accompanied by corresponding development of the towns utilities and facilities." C. Page 60 - "Existing municipalities are the best and most efficient sources of public goods and services which are necessary to serve new residential developments. These municipalities will be encouraged to improve their ability to serve new developments within their corporate areas, in annexable areas immediately adjacent to the town and even those areas not immediately available for annexation, but within a reasonable service distance from the municipality." D. Page 91 - "Since the capacity for sewage treatment is an important determinant on the growth a community can acconodate, treatment plants should be expanded and improved to accommodate the growth desired by the individual community." Finally, the Plan sets forth two basic policies which speak to the establish- ment and provision of utilities, public goods and services: A. Page 91 - Proliferation of service districts shall be opposed while consolidation of existing service districts shall be encouraged when it tends to improve the efficiency and economy of the service. B. Page 92 - Regionalization of services and facilities shall be opposed if it will lead to growth which is not compatible with the desires of of the towns involved. It is the opinion of the Planning Commission that the regional sewage treatment facility proposed by the City of Greeley in the current application is consistent with the basic determinations and policies set forth above as set forth by the Weld County Comprehensive Plan. This opinion is based on: A. The proposal sets forth a means by which the City of Greeley can meet the demands of increased populations which if located consistent with Weld County's Plan, will be located within or adjacent to Greeley's exisiting urban area; B. It appears that the proposal will not encourage the proliferation of service districts; and C. It appears that the regional nature of the facility will not lead to growth which is incompatible with the desires of the City of Greeley. 2. It is the opinion of the Planning Commission that the proposed operation is in compliance with the provisions of Sections 3.3.E.2. and 3.3.E.3. of the Weld County Zoning Resolution. It is the opinion of the Planning Commission that the location, operation and maintenance of the proposed wastewater treatment facility as set forth in the Special Use Permit application and as controlled by the Development Standards attached hereto will minimize adverse impacts on surrounding uses and the area in question to the greatest extent possible. Further, it is the opinion of the Planning Commission that the current proposal provides adequate protection of the health, safety and welfare of the inhabitants of the area and the County. These determinations are based, in part, upon a review of the information submitted by the applicant, oral statements made by the applicant, other relevant information regarding the request, and the responses of the referral entities which have reviewed this request. Specific concerns and/or recommendations of the Planning Commission and referral entities are addressed in the conditions for approval or the proposed Development Standards. The Planning Commissions recommendation for approval is conditional upon the following: Planning Commission R emendation City of Greeley - SUP z-.5:80:35 Page 3 1. The adoption of the attached Development Standards which are designed to set certain standards for the location, operation and maintenance of the proposed wastewater treatment facility. 2. No building or electrical permits being issued on the Special Use Permit area unti the approved Development Standards have been placed on the Special Use Permit plat and said plat has been delivered to the office of the Depart- ment of Planning Services. 3. Submittal of a program which details measures to identify, monitor and mitigate potential problems with underground seepage from the facility which could result in contamination of ground water resources. This monitoring program shall be submitted for acceptance with the site plan review. 4. The natural flow capacity of Crow Creek shall be determined by the applicant prior to recordation of the Special Use Permit plat. 5. An assurance agreement as presented at the November 5, 1980 meeting be offered to all adjacent property owners. CAC/dr 11/7/80 City of Greeley • SUP-445:80:35 DEVELOPMENT STANDARDS 1. Permitted uses on the hereon described Special Use Permit area shall be a land application wastewater treatment facility. The facilities may include a storage reservoir, aerated lagoons, center pivot sprinklers, and associated maintenance and administrative facilities. Treatment processes, structures, and facilities shall be of the type and nature described in the Special Use Permit application document titled City of Greeley, Colorado Wastewater Facilities Plan, Weld County, Colorado, Special Use Permit Application, Land Application Treatment Facility prepared by ARIX and as outlined by the application in the Plan- ning Commission hearings of October 21, 1980 and November 5, 1980. 2. Specific site plans showing the type, nature and location of structures for the aforementioned land application wastewater treatment facility shall be approved by the Planning Commission prior to issuance of building permits for construction of the facility to determine compliance with the hereon described standards and design concepts. 3. The facility shall be designed, maintained and operated to comply with State Health Department regulations regarding odor. 4. Landscaping plans as recommended by the Colorado Division of Wildlife shall be reviewed and approved at the time of specific site plan approvals as set forth in Development Standard #2. 5. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust and growth of noxious weeds. The site shall be maintained in such a manner as to present a neat and well kept appearance. 6. Lighting provided for security and night operation on the site shall be designed so that the lighting will not adversely affect surrounding property owners. Lighting shall be reviewed and approved at the time of specific site plan approvals as set forth in Development Standard #2. 7. All phases of the wastewater treatment plant facilities and operations shall con- form with all applicable County, State and Federal Health Standards and Regulations and any other applicable rules and regulations of governmental bodies having jurisdiction on the premises. 8. Additional design criteria of the dam and reservoir shall be submitted at the time of specific site plan approvals as set forth in Development Standard #2. 9. The applicant shall insure that the flow capacity of Crow Creek shall not be increased beyond the natural flow limits due to discharge from the wastewater treatment facility. During periods of high natural flows of Crow Creek, releases from the wastewater treatment facility shall be terminated to prevent damage to Crow Creek and downstream properties or users. 10. All design and construction shall conform to applicable local, state and national building codes. 11. All structures shall comply with the minimum setback requirements as defined in the Weld County Zoning Resolution. 12. Signs warning the public that the site is a wastewater treatment facility shall be placed on all sides of the facility where a County Road exists. All warning signs shall be of sufficient size to be read at a distance of 200 feet. 13. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recammendations and/or requirements of the Weld County Engineering Department. 14. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission before such changes fran the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the Office of the Department of Planning Services, Development Standards City of Greeley - SUP-445:80:35 Page 2 15. A minimum setback of a single pivot sprinkler diameter (approximately one- half mile) shall be provided from the east side of the reservoir and treat- ment lagoons or western boundary of the Special Use Permit boundary, whichever is greatest, to the closest sprinkler. This setback shall be required, at least, during the initial phase of the land application construction which will include placement of approximately six sprinklers. Placement of the sprinklers shall be reviewed and approved at the time of specific site plan approvals as required in Development Standard #2. CAC/dr 11/7/80 City of Greeley SUP-445:80:35 COMMENTS: 1. The Colorado Division of Water Resources has, in a letter dated October 28, 1980, stated that: "it is our opinion that if the City changed its wastewater treatment facility to land application on crop land, that court approval will be necessary and that a plan for augmentation may be required. Therefore, we cannot recommend approval until the court rules on the City's application." Colorado Statute places jurisdiction over the matter in the Division of Water Resources, State Engineer's Office and Division Water Court. It is felt that consideration of factors relating to a water augmentation plan would be inappropriate in the current application. 2. To date, our office has received letters and petitions in opposition to the proposed wastewater treatment system. Copies of those items were distributed to the Planning Commission prior to the November 5, 1980 Planning Commission hearing. 3. The issues raised by the Colorado Department of Health, Water Quality Control Division, in its letter of October 29, 1980 are issues which, in the opinion of the Department of Planning Services Staff, will be dealt with by the State Health Department at the design phase and encompassed in Development Standard #7. The Department of Planning Services Staff feels that certain parts of the proposal must be more clearly described to the satisfaction of the Planning Commission. The Staff feels those issues requiring more description are as follows: A. Underlying bedrock formations not permitting infiltration of any significant quantities of treated wastewater into lower formations which would adversely affect the surrounding areas; B. Overburden materials capability of accepting application at estimated rates; C. The proposed sprinkler application system not adversely affect- ing farm lands adjacent to the site by raising the existing and/or historical groundwater table; Dept. of Planning Services Recommendation City of Greeley - SUP-445: 80: 35 Page 4 D. Water passing through the crop root zone and not consumed by the corps being adequately recaptured by the use of interceptor drains, ditches, and wells; and E. No effect on existing legal liability of the City in the Ogilvy Ditch. In regard to A through D above, if geologic conditions are felt to have limitations or irregularities, conditions or development stan- dards should be established to define methods which may be employed to avoid such limitations or irregularities. Additional detailed investigations can be made prior to final design and recommendations derived there from can be incorporated into the "Site Plan" review. On November 5, 1980 the Weld County Planning Commission granted a Special Use Permit for the Land Application Treatment System located in Sections-5 and 6, T5N, R63W and in Sections 15, 21, 27, 28, 29, 31, 32 and 33 all in T6N, R63W of the 6th P.M. , Weld County, Colorado. The Planning Commission's approval was made with certain conditions and development (performance) standards. These same conditions and standards were to be forwarded to the Water Quality Control Commission as a part of the Commission's action on the site application. Glen M. Hanson, Superintendent, has been approved by official board action as spokesman for our group. The concerns are expressed from our collective interests in the welfare of the school district in which we serve. Our concerns about the location of the proposed Greeley Wastewater Treatment Facility focus on several issues, namely, the effect its lo- cation at Site # 1 will have on the quality of life in the surrounding area, the effect the facility location will have on our tax base now and in the future, the concern about using highly productive agricultural land when non-productive land is available, and the fact that there is a reasonable alternative. Our concern about the quality of life in the area surrounding Site # 1 has implications with air quality, land value, and the productivity of some of the surrounding land. Past history of air quality problems of Greeley's Sewage Treatment Fa- cilities, namely the First Avenue Site and the Lone Tree Site, should be all that one would need to bring your attention to realize why the people are concerned about Site # 1 which places the facility in an area where farm homes and small rural communities would be in close proximity. The past history argument is usually countered by proponents of Site 1/ 1 who cite the tremendous capability, superiority, and national recognition of this aerobic process combined with land application. We are only reminded of a few short years ago when we heard in hearings how the anaerobic process proposed at Weld County Planning Commission Page 2 October 21, 1980 the Lone Tree Site was internationally recognized as the Cadillac of sewage treatment. We do not disagree with the capability of either system if properly operated and maintained. Our concerns are more on how the system is operated and maintained than in the type of treatment facility. We feel the location of the facility will have a negative impact on surrounding land values and the quality of life in the area. The affected area to the west and north of Site # 1 is presently highly productive farmland with higher sale value. Many farmers find it necessary to borrow operating money against the increased value of their land, that will no longer increase, but in fact, will decrease. The third concern under quality of life is the affect the excessive amounts of water applied by the sprinklers will have on the water table and the affect the sewage water will have on the quality of the underground water. Many acres of land adjacent to the proposed sprinkler site has a delicate balance in the water table. So delicate, in fact, that years of experience and dollars spent for seep tile are all that keep it in good production. If the water table problem is com- pounded by the excessive application of water and the seepage from the lagoons and reservoirs, it is almost a certainty that many acres will be declared non- productive. The water seepage and purification problem also is a great concern for the home sites in the area since underground water• is used for domestic purposes and no assurances are given that it will be fit for human consumption . It should also be noted that homes in the area with basements will have to declare their basements unusable. In a predominately agricultural county it is ironic to note the lack of concern for those valuable productive acres. The Site # 1 proposal takes 320 acres, of which 240 acres are highly productive land, out of production for the location of the treatment ponds and holding ponds as well as destroying the productive capability of numerous addtional acres because of the water table level. In addition to these items we are concerned with the future growth of the facility. We are concerned about the expansion of the facility in future years as large and small population centers tie into this regional facility. (Our concern is based on the fact that expansion would logically be to the west and north, areas high in agriculturally productive acres, since it is presently unfeasible to go to a dryland location to the east or south as proposed in Site /I 4. ) Our concern about the tax base for our s6hool district relates to the concerns expressed, that the numerous acres of presently productive land will be deemed non-productive as the water table rises. Looking into the future we are concerned about the future expansion of the facility, potentially destroying the productivity of an unknown number of acres, and taking those acres purchased by the City of Greeley off the tax roles. We realize the potential increase in value on the dryland Weld County Planning Commission Page 3 October 21, 1980 placed under the sprinklers, but we have no assurance that now or in the future that land will remain in private ownership, which it must if our school district is to benefit. The last point we would like to focus your attention on is that the City of Greeley does have a feasible alternative. That alternative is Site # 4. Site # 4 would solve concerns about the destruction of presently productive acres, would solve the concerns about water table problems and water quality problems for domestic use, would greatly reduce the air quality impact because of the remoteness of the location, would not be taking highly productive acres out of production, and would have a positive impact on the tax structure of Weld County School District RE-#7, as well as, the economy of Weld County in general. Furthermore, the impact of future growth of the facility to accomodate Greeley's growth or to provide ac- comodations as a regional facility are present, without concern for the devastating effects of Lhat growth. We realize that money is an issue of concern when considering Site # 4. It is a short range view on an issue that has long range impact. If the money concern is viewed relative to the impact not only on Greeley, but on the economy of Weld County, then the Greeley Planning Commission, The Greeley City Council, the Weld County Planning Commission, and the Weld County Commissioners, will find it necessary to select Site # 4. We are providing the following additional information regarding these questions for your use in developing the staff recommendation to the Planning Commission on November 5. Effect of Discharges to Crow Creek We have conducted field inspections and surveys along those portions of Crow Creek for which we could obtain permission to enter. Based upon our analysis , it appears that Crow Creek can adequately carry additional flows of at least 30 CFS without causing any problems. In discussing the flow conditions of Crow Creek with long-time area residents , we have learned that up to 50 CFS of ditch water is sometimes wasted into Crow Creek from the North Side extension ditch at a point on the east edge of Section 17, T6N, R63W. Apparently, no damage is caused by such releases. Av- erage releases from the wastewater facility would be significantly less than 50 CFS, more in the range of 15-20 CFS. During periods of high natural flows , releases from the wastewater facility can be terminated to prevent damage from occurring. Trappers Trail Cultural Resource Inventories have been undertaken by Gordon and Kranzush, Inc. in accordance with the requirements set forth by EPA and the CHS. Phase II work conducted by this firm and as reported in Volume II of the Wastewater Facility Plan, Appendix I , pp 10-11, identifies Trappers Trail (Cherokee Trail ) "A COMMUNITY OF PROGRESS" Mr. Tom Honn October 30, 1980 Page Two as being located within the project area. Quoting from this report, "Though historically significant in terms of exploration and settlement of Colorado, the CHS-DHP considers development in this corridor to have adverse impact to these sites only if construction affects physical remains of the routes (stage stations , campsites , etc. ) . " As of this time, no such remains have been iden- tified. Any cultural resources which are discovered during design and con- struction of the project will be preserved in accordance with the regulations established by both State and Federal agencies. Odor Comparisons have been repeatedly made between the proposed facility and the Lone Tree Plant. The Lone Tree facility is an anaerobic treatment process (without air) whereas the proposed facility is an aerobic facility. Anaerobic facilities are odor producing and when operated without enclosures will produce strong odors. Aerobic systems operate with very little odor and are not offensive. Numerous people have visited the Muskegon facility to assess odor and other aesthetic factors. While it is not possible from a scientific point of view to quantify such conditions, most individuals visiting this project have not found it to be offensive to the senses in any way. Airborne Pathogens Numerous studies have been completed analyzing the health effects resulting from aerosol dispersal from waste treatment facilities . No scientific evidence has been discovered from previous studies which identifies any adverse health effects in areas adjacent to wastewater treatment facilities . Water Quality - Groundwater The major concern regarding groundwater quality is for the concentration of nitrates. The U. S. Public Health Service recommends that the nitrate concen- tration should not exceed 10 mg/1 in public water supplies. Calculations indi- cate that the average concentration of nitrate in leaching water will be approx- imately 7 mg/1 , which is below the maximum recommended allowable amount. Further, it is planned to recover this water and not allow it to permanently enter any existing aquifier. A complete discussion of water quality issues can be found in Volume I of the Facility Plan. Interception Ditch/Reservoir Concern has been expressed that the proposed interceptor ditch will take water from the North Lateral Irrigation Ditch. The entire area proposed for irriga- tion lies at a much higher elevation than the North Lateral Ditch, making it physically impossible to capture any water from this facility. Mr. Tom Honn October 30, 1980 Page Three Final design of the reservoir has not been completed; consequently, the selec- tion of the ultimate method of seepage control has not been made. Several engineering methods are available for seepage loss control , including reservoir lining, physical barriers , and hydraulic barriers created by interceptor wells or ditches. The final decision regarding the method of control will be made during the design phase and will be based upon cost and reliability factors. Geological Conditions at Site All existing geological information has been included within the Facility Plan. Should you have specific questions not covered by this material , feel free to contact Barbara Turner (825-8464) for additional information. Partially Lined Reservoir/Reduce Seepage As previously stated, final design of the reservoir facility has not been com- pleted. Consideration will be given to all available methods of control with the final selection based upon cost and reliability. Underdrain System/Sprinklers The underdrain system will consist of an underground network of perforated pipes designed to capture most all of the water percolating below the crop root zone. It has been suggested that systems of this type do not function success- fully in many cases. Normally, systems of this type are installed to alleviate severe natural drainage problems caused by high groundwater, tight soils , etc.-- conditions which are not well suited to drainage by any method. Site 1 was selected because soil conditions are uniform and well suited for recapture of the treated wastewater by the method proposed. Any comparison of what is being proposed to performance reliability of systems constructed to alleviate naturally occurring poor drainage conditions is not a valid comparison. WELD COUNTY REFERRAL: LAND APPLICATION WASTEWATER TREATMENT FACILITY LOCATION: Three miles east of Gill Ken McWilliams indicated that the Planning staff is supporting the proposed Site 1, three miles east of Gill. He then turned the meeting over to Bill Hargett, the City's Public Works Director, for a more detailed explanation of the proposal. Gary Windolph, Vice-President of ARIX (the firm retained to design the plant) gave some background on the project. He explained that the planning for the project started in 1972 with the initial selection of sites. It was decided in 1976 to build a mechanical treatment plant in the Delta. This was approved by the State Health Department and-the EPA. The City then moved into the design of the facilities at the Delta site and found the cost had increased to about three times the original estimates due to time delays in obtaining all the required approvals. The City then decided to analyze alternative sites and treatment methods. After evaluating everything, the City reached the decision that a land application system should be constructed at Site 1. Mr. Windolph illustrated Site 1 chosen by the City for the plant and explained that the second alternative was to collect all the sewage and bring it to the Delta site for treatment. The County did approve a Special Use Permit for a complete sewage treatment plant at this site should that be the City's decision. However, the plans now call for only a pump facility at this site. The County "g would now like for the City to amend the Special Use Permit to show 1 what will be done at the Delta site. It is now proposed that through the use of pressure lines, the sewage will be brought from the Delta out to the Gill location (Site 1) for further treatment. Bill Hargett presented slides of the proposed Gill site showing the I i natural rise of the land and explained why the site was superior to the others studied. The slide presentation included shots of the Muskegon, Michigan, sewage treatment facility which is the same type being proposed for Greeley. After the slide presentation, the Commission entered into a lengthy discussion regarding the pros and cons of Site 1 versus the other sites studied. Bill Hargett indicated that the Water Rights Manage- ment is greatly simplified at Site 1. He also indicated that should ' Site 1 not be chosen, then the Delta site would be the alternative I location. Commissioner Miller questioned why Site 4 had been dropped ' as an alternative. Mr. Hargett indicated that it was because of the Water Management costs. Gary Windolph explained that Water Rights I Management does not simply relate to the physical aspects but also to ' the concept of change in use and whether or not the City is selecting I I the reasonable method for treating their wastewater. At Site 1, the water can go almost directly back into Crow Creek. In addition, there is the problem of the Ogilvy ditch and the fact that the City might have some contractural liability to continue to provide water to that • j ditch which could be as much as 3,000 acre feet per year. To provide this water to the ditch, it would be somewhat expensive from Site 1, but it would be almost impossible from Site 4. The cost for this could be between 9 and 11 million dollars. Another reason for the elimination of Site 4 is that the Federal Government's laws and regulations require that the most cost efficient system be selected. In this case, the land application system and Site 1 meet this criteria and Site 4 does not. The issue boils down to whether Site 1 is environmentally acceptable and there are no conditions that make it unacceptable. 0 Commissioner Cummins asked what the depth of the overburden is. Mr. Windolph indicated that it varies in places from 30 to 40 feet with most of the site being 10 to 20 feet, Chairman Dietz asked if there was only one farm that must be removed for the storage reservoir. Mr. Windolph indicated that there was only one, Chairman Dietz then asked for any comments from the audience. Mr. Jack Larson, a farmer in the area and president of the Concerned Citizen's Committee, spoke on behalf of the residents in the vicinity of Site 1. Mr. Larson explained that the citizens were not opposed to the Land Application theory, but were opposed to the site. He indicated that some of the main concerns are the damage to underground water in quali y and quantity, effect of the sewage treatment facility on surrounding land values, and air quality and odor control. Mr. Larson explained each of these concerns in great detail. He indicated that 1/2 section of good irrigated land was going to be totally covered by the reservoir. He also noted that some of the surrounding farmers are at a slightly lower elevation than the proposed site for the resevoir. The citizens are especially concerned about their farms being flooded out with seepage from the reservoir or that the wastewater application system will raise the ground water level substantially and damage their crops with too much moisture. Or, there is the possibility that the plant will be pumping so much water that it will lower the level of water in their ditch. He further indicated that the farmers in the area did not have much confidence in the collection ditches for the run-off water. He explained that this method had been tried in the past and it has never been able to capture 700% of the run-off. The residents are concerned about the portion of the run-off water that escapes and that it might contaminate their water should it come out onto their land. Mr. Larson then restated the four major concerns of the residents of the Site 1 area: 1) Too much water or taking away water; 2) Con- taminating water; 3) Air quality and odor control; and 4) Effect on property values. I Mr. Larson then explained why the citizens felt that Site 4 would be better for the plant. Some of those reasons included: 1) nearest neighbor is three miles away; 2) only need 3x miles more of pipe II to reach the Ogilvy ditch than is needed from Site 1; and 3) the ' cost to the City to purchase dryland at Site 4 versus irrigated land ;I at Site 1. He stated that the citizens felt that the additional 9 I to 11 million dollars to build the plant at Site 4 is minimal in Ii comparison to the dollars that would be lost if the irrigated land i is damaged. • It II i (I I I • i � D BRADFORD PUBLISHING CO DENVER RECORD OF PROCEEDINGS I ` 1 y Planning Commission Page 6 October 14, 1980 Mr. Vic Wolfe of the Concerned Citizen's Committee also spoke on I a behalf of the residents. He reiterated the arguments of Mr. Larson, I E commenting that he lived only 1/2 mile from the proposed site and was concerned with the fact that some of the land proposed for the • i �► reservoir rises 30 feet higher than the flat valley surrounding it. Commissioner Keirnes asked if their Committee had not been working up some guidelines to present to the City that would be acceptable to the land owners and if they would continue to oppose the site selection if they were given certain assurances that were reasonable in providing protection to them in regard to any possible damage to their property. Mr. Larson indicated that the Witwer Ranch had drawn up some assurances that- apparently were not agreeable to the City. He personally was not in favor of any type of contractural agreements because once the damage was done, it could not be reversed; once the money was spent and the sewage plant installed, it cannot be taken out; what the farmer defines as damage may not be what the City describes as damage; and finally, why take the chance when there is another site available? Commissioner Keirnes indicated that he and the Commission could sympathize with the feelings of the farmers, but they had to rely on what the engineers had presented to them and take their assurances that no damage would result to the surrounding land. What the whole argument comes down to is an emotional issue and the Planning Commission must be concerned with the long range planning of the City. Bill Hargett indicated that an additional $173,000 of State assistance was spent to check into the concerns of the farmers as Mr, Larson had outlined. From this addditional study, the engineers were confident that Site 1 was the best possible site and no damage would occur to the surrounding land. He further indicated that Site 4 was not even the second alternative so the arguments in favor of this site were really not necessary. Should the City decide against Site 1, the complete plant will be built at the Delta site. Commissioner Keirnes asked the engineers to give an estimate of how much this delay was costing per day. Mr. Hargett estimated the delay is costing a total of 8100,000 per week. Commissioner Miller questioned how long the proposed system would satisfy the sewage treatment needs of Greeley. Mr. Windolph indicated that it depends on future growth. The plant is designed to handle sewage for 120 to 140 thousand residents. He further indicated that the projected time frame for the City to reach this size is about 20 years from now. Mr. Bill Crosier, representing the Greeley Board of Realtors, asked if anyone knew what the difference was to purchase the irrigated land at Site 1 versus the dryland at Site 4. Mr. Windolph indicated that Site 1 land acquisition-costs would be about 1.35 million dollars as compared to $850,000 for Site 4. However, Site 4 would be the more expensive of the two sites for the completed plant because of the additional preparation the land would require. After some additional discussion regarding the two sites, Chairman Dietz called for a motion. Commissioner Keirnes indicated that he could understand the concerns of the citizens and he would hope that they could work something out with the City through some type of contractural agreement. He then made a motion to recommend to the Weld County Planning Commission that they have no objections to Site 1, three miles east of Gill, for the Land Application Wastewater Treatment Facility. The Section has no objection to the issuance of a special use permit. The following comments should be addressed during the design phase: 1.) The pond and lagoons may require lining to prevent any impact on the surrounding ground water. Drawings of the proposed interceptor trench are necessary to ascertain whether the trench would be able to fully contain the see- page from the pond and/or lagoons. 2.) No monitoring wells were indicated on any of the drawings enclosed. It is necessary to know where these wells are to be located and their depths before any recommendations can be made as to their adequacy. 3.) From a containment stand point, it appears that the under- drains are inadequate. It would seem that the underdrains or interceptor trenchs, used to contain seepage, should be placed around the outside edge of the entire area instead of being located as indicated on the enclosed drawings. The thinking on this is that when the land application system is operated, it will cause ground water mounding to occur around the system, particularly around the southern edges of sections 10 and 11. When this happens, the ground water flow regime will be reversed for a short distance, and spreading will occur. Because of this potential for spreading, the placement of the catchment system is all importment. This is especially true because of the proposed rate of application in conjunction with the evaporation rate experienced in this area. Also, the potentiometric map (Figure 4, page III-6, Volume III) indicates flow to the southwest. 4210 EAST 11TH AVENUE DENVER,COLORADO 80220 PHONE (303) 320-8333 ) J It will be necessary to have a detailed crossection of the underdrains or interceptor trenches, indicating their exact dimensions. Also, it would be necessary to know the effluent amount and discharge location. 4.) Another concern is that this system not be used in conjunc- tion with any industry that might discharge heavy metals or exotic organics/inorganics. If this is to be the case, then possibly a pretreatment may be needed at the industrial site. 5. ) An additional suggestion is that a geologic soil description, similar to ones found on drilling logs, instead of the engi- neering soil classification be utilized when discussing soil strata at the site. Further analysis of the soil characteris- tics for prolonged irrigation should include the following: (1) Cation exchange capacity (2) pH (3) Calcium Carbonate (4) Particle size distribution (5) Total organic carbon (6) Total organic nitrogen (7) Exchangeable Ca, Mg, K and Na (8) Total soluble salts and Chloride - of interest to irrigator (9) Bulk Density 6.) Proper operation of a land application system requires a mandatory maintenance schedule. This schedule should be addressed to avoid serious problem. The Bedrock Geology Investigation by ESA Geotechnical Consultants and the Geotechnical Investigation by Empire Laboratories , Inc. (for the Waste Water Land Application) provide very adequate information on the geo- technical considerations of this project. If their recommendations for additional definition of conditions for design of the dam and reservoir are followed, we have no objection to approval of Application SUP-445:80:35. We have reviewed the Primary Geotechnical Investigation for the Delta site plant. As the CH2M Hill report indicates, additional investigation is needed to determine the behavior of the subsurface when loaded by a foundation. The seasonally high groundwater table may also make construction difficult. These conditions, among others, should be taken into account in a more detailed soils and foundation investigation. For many reasons it had been determined that the Delta Site proposal was no longer workable. Our Commission heard numerous presentations from consultants retained by the City of Greeley as to the merits and demerits of the various site and treatment options. It is my opinion that the site identified simply as Site Number 1, located in near proximity to Gill, Colorado, offers the best opportunity for the proposed treatment facility when all factors are considered. This opinion becomes especially valid if Greeley can, as proposed by Mayor Hall, provide fair and binding indemnification to adjacent land owners whose property may be adversely impacted by construction and operation on the subject site. There was a tremendous amount of technical data supplied that supported that the land application treatment long term would be the most cost effective process and that Site 1 would be the most efficient location for such a treatment facility . There were many questions raised by the members of the Advisory Board similar to the questions that are being raised for the Planning Commission . I feel that all of these questions have been answered through additional technical studies, and I strongly recommend that the County Planning Commission approve Site 1 as the site for the wastewater treatment facility. We have reviewed the various reports and exhibits prepared by the City consultants . Based on that review, it is our opinion that the combined works represents one of the most thorough studies ever done in the State of Colorado . Expert input has been obtained from environmentalists , agronomists , geologists , facilities engineers, lawyers , water rights engineers , hydrologists, and others . Obviously, no expense has been spared in soliciting involvement from all needed experts . It appears that all conceivable problem areas have been adequately addressed. If any further delays are encountered before proceeding with the proposed improvements , it is quite likely that the enforcement division of the Health Department would impose very rigid tap restrictions , or conceivably a total moratorium on the Greeley system. Such action would be devastating in terms of impact on the already poor condition of the area' s economy. Not knowing how much information you have received, I will attempt to touch lightly on some of the major issues that are very important to us. We are very concerned with odor which we have been assured would not be a problem but with the human error and malfunction of equipment, which we all know is bound to happen, we feel sure there will be odor at least intermittently. To enforce this con- cern one of the first questions asked at our first advisory com- mittee meeting on October 30, 1979 was how the land treatment site was chosen and the reply was, "remoteness tor odor control, uniform soils, cost of land, and water rights." This reply indeed falsi- fies their assurance that there will not be any odor. Next consideration is the devaluation ot properties around the lagoon. While fully appreciating the problem of waste disposal that the city of Greeley is facing and not being opposed to new inovations ot sewage treatment or new iuethodo ot any kind I do not believe it is fair to expect property owners in the area to suffer a financial loss of any kind. Although being assured once again that this will not happen, one onLy needs to ask himself his choice in purchasing property close to a sewage treatment facility or property that is not and the answer is self explana- tory as to the drop in value. Next point ot concern is the underground water table. The seepage from the lagoon and reservoirs and the water perculated through the soil through crop application will indeed change the Page 2 quality and quantity of the underground water. The engineers call the layer of rock "bedrock" but in layman's terms we know it is shale and that it is not solid but has millions of tiny cracks which would prevent their recapturing 100% of the water that perculates through the soil. We happen to v talking about an area that has a very intri- cate balance in the water table. Much more so than in any area I know of. There used to be bogg holes, swampy areas and small ponds until irrigation wells lowered the water table enough that crop growth is possible on 100% of available land. Any adding to or taking from this underground water table would be most critical for we have experienced years when the irrigation wells will surgelonce again reminding us of the intricacy of our under- ground water. Many of the homes use this water for household and livestock use. The high nitrate count present in the water they will be applying to crops, I 'm sure, will make this no longer possible. The engineers have told us that if this becomes a pro- blem they can drill test holes to monitor the water level and in- stall pumps to control it. Considering this remedy, we are once again faced with the problem of malfunction of equipment and dedi- cation of employees that plagues us all today. However, I do not believe that this can be done with any great degree of success. If Site #4 and land application would be your choice, all of the above mentioned problems would no longerna problem. There is no one living close to this area. There is not any irrigated land to damage by a raise in the water table, as a matter of fact rage 3 I believe escaping water from the system in this area would indeed be an asset to the extremely dry grasslands. There would be added costs for the extra distance and earth work. This would be off- set somewhat by the purchase of expensive irrigated land, pumping stations, extra pipe for recapturing the uncierdrain which are necessary for Site #1. PROJECT TEAM MEETING NO. 19 September 19, 1980 IN ATTENDANCE: Ga t- ry Fortner, Weld County Planning Department Tom Honn, Weld County Planning Department Bill Hargett, City of Greeley John DiFalco, City of Greeley Mark Rybus , City of Greeley John Gauthiere, City of Greeley Dave Winger, City of Greeley Bill Kolly, ARIX Dick Huwa, ARIX • Gary Fortner and Tom Honn of the Weld County Planning Department were present to coordinate the Site Application and Special Use Permit procedures with the City staff and consultants. Mr. Fortner said that basically the Site Applica- tion is processed under the County's Special Use Permit procedure. The County Planning Commission reviews the Application to see if it is in conformity with the County Plan and makes comments which are then submitted to the Board of County Commissioners. It is anticipated that the Board of County Commissioners will probably sign off on the Application in conformity with the Planning Com- mission's recommendation. Should the Planning Commission make a negative recom- mendation, the City Council would need to overrule the decision. The review process requires a minimum of 30 days. As part of the review process, the County Planning staff seeks input from various referral agencies. Mr. Fortner and Mr. Honn said they would supply the City with a list of these agencies so that the City could contact them directly and any questions that might arise could be answered more quickly. John Gauthiere noted that delays can be encountered if there is no intergovern- mental agreement and Mr. Fortner suggested that the City start looking into the matter as it can be a very involved and lengthy process. It was decided that ARIX should meet with Chuck Cunliffe of the Weld County Planning Department so that he could review the draft of the Special Use Permit and point out what further information might be needed. Mr. Cunliffe also could outline the timetables to shorten the process as much as possible. The following schedule was decided on: September 22 Site Application completed and mailed to all reviewing agencies September 26 Special Use Permit completed and submitted to County October 7 Weld County Planning Commission receives a copy of Special Use Permit Application Project Team Meeting No. 19 September 19, 1980 Page Two October 21 Project Team makes presentation to Weld County Planning Commission November 4 or 5 Weld County Planning Commission acts on _Special Use Permit November 10 Weld County Commissioners act on Site Application Mr. Fortner noted that it might be very helpful to include a summary of the proposal with the Special Use Permit application which would aid the Planning Commission in understanding the project. The Special Use Permit will be reviewed at the September 26th Project Team meeting. Any necessary corrections will then be made and it should be submitted to the County that day. Mr. Fortner said that if any questions arise at the October 21st meeting of the Planning Commission, the City and consultants should be ready to move quickly to answer them so that they can be answered satisfactorily by the November 4th meeting. Bill Hargett asked if the City needed to submit a letter to the County requesting to be placed on the agenda for the October 21st meeting. Mr. Honn said they could set it up on the basis of the verbal request as long as all requirements of the County Attorney are met. The City staff then reviewed the Special Use Permit and Site Application mate- rials with Bill Kelly and Dick Huwa. John DiFalco pointed out that a letter is needed from the State which says that they will enter into a ground lease with the City because the City cannot condemn the portion of land controlled by the State. Mr. Rybus and Mr. DiFalco felt that the City should move as quickly as possible in obtaining options on the land. ARIX was asked to check with the County and find out what is the minimum legal document needed. WHEREAS , it is the intention of the City of Greeley to construct, maintain, and operate a Wastewater Treatment Facility, including a reservoir and lagoon, to be located in Section 31, Township 6 North, Range 63 West of the 6th P .M. and in Section 6 , Township 5 North, Range 63 West of the 6th P.M. ; and WHEREAS, the Witwer family, owners and operators of the S.L.W. Ranch located near the proposed reservoir and lagoon, have asked the City for assurances that said Wastewater Treatment Facility will not violate applicable air quality and water quality standards nor materially increase nor materially decrease the subsurface water in, on, or under any adjacent or nearby land, specifically lands owned or leased by the Witwer family; and WHEREAS, the Witwer family has indicated that if given such assurances, they will not actively oppose the construction of said Wastewater Treatment Facility; and WHEREAS, it is considered to be in the best interest of the people of the City of Greeley to grant assurances to the Witwer family. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREELEY, COLORADO: 51/ Section 1 . The Mayor of the City of Greeley is hereby authorized to execute Assurance Agreement designated attached hereto and incorporated herein by reference . Section 2. Water Quality. The City assures that the facility and its operations connected therewith shall not lower the quality of any stream, subsurface water, ditch or surface water below the allowable state and federal water quality standards. C. Underground Water Quantity. The City assures that the facility and its operations connected therewith shall neither materially increase, nor materially decrease the subsurface water in, on, or under any adjacent or nearby land. II. ENFORCEMENT A. The assurances given by the City shall inure to the benefit of and may be enforced only by Clara and Stow L. Witwer, their lineal descendants and their spouses, or the S.L.W.
