RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A HORSE BOARDING/ TRAINING FACILITY - THOMAS L. AND EUDORA F. ROACH WHEREAS, the Board of County Commissioners of Weld County , Colorado, pursuant to Colorado statute and the Weld County Horne Rule Charter, is vested with the authority of administering the affairs; of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 9th day of June, 1982 , at the hour of 2 : 00 o ' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Thomas L. and Eudora F . Roach, 11000 U. S . Higiway #34 , Greeley, Colorado 80631, for a Use by Special Review for a horse boarding/training facility, on the following describei real estate, to-wit: The Northeast Quarter of Section 14, Township 5 North, Range 67 West of the 6th P.M. , Weld County, Colorado. WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicants and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Planning Commission that the applicant has shown compliance with Section 24 . 4 . : of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Compr.ehersive Plan in that policies of the plan promote agri- business so along as they do not create negative impacts on the environment or the County. Nc such impacts have been identified with this proposal. The proposal is consistent with the intent of the Agricultural Zone District in that the use does not constitute an interference with agricultural activities. b. Foose ASSISTANT COUNTY ATTORNEY, Lee Morrison PLANNING DEPARTMENT REPRESENTATIVE, Rod Allison The following business was transacted: I. hereby certify that pursuant to a notice dated May 24, 1982, duly published May 27, 1982 in the LaSalle Leader, a public hearing was held on the request of Thomas L. and Eudora F. Roach for a Use By Special Review for a Horse Boarding/Training Facility. Bryan Shaha, the attorney representing the applicant, explained the request. Commissioner N. Carlson stated he understood there was a problem with the rye blowing. The applicant, Tom Roach,was present and responded by stating that he planned on putting the 140 acres back into grasses for pasture. The area is too small to economically plant wheat. The proposed riding paths will be on the property only and will not be on the County Roads or on neighbors' property, stated the applicant. Commissioner Steinmark questioned whether any improvements will be made. The applicant stated that the only improvements to the existing improvements will be a large arena and riding paths. Mr. Willard, an adjacent landower of 32 years to this property, stated his only opposition is to a blowing problem. le stated in the past it has been a problem in keeping the weeds and rye down and would not be opposed to this request if the rye was keep under control . The applicant explained he has just boughtbig heavy equipment to control the rye and planned to disc it under and put in the riding paths along the fence lines to resolve the problem. Commissioner C. Carlson made a notion to approve the horse boarding facility and development standards as recommended by Planning Commission. The motion was seconded by Commissioner Kirby and it carried unanimously. The informal request of Commissioner Steinmark to keep down the rye was acknowledged by the applicant's attorney, Bryan Shaha, on behalf of the applicant. ,/ John T. The proposed use of the area is a horse boarding and training facility with an adjunct use of pro- viding horse and riding tack for the users of the facility. The proposal is consistent with the plan for Weld County, in that the present and future inhabitants will be provided with a ser- vice that is needed in this area due to the lack of such facility as we propose . b. The property is in an isolated area on a dry land farm. There is an irrigated horse pasture for th:- use of the property. The nearest neighbors ' home is approximately one quarter of a mile away. The next nearest home is one mile away . The proposal of a horse training facility is consistent: with the intent of the district in whica the use is located . c . The existing land uses adjacent to the property are : property directly to the south is a dry lane; farm and some wasteland; the property to the west is a dry land farm; the property to the north Iwh., ch is across US 34 Bypass) is irrigated and used as pasture for cattle in the winter; and the pronert7' to the east is also irrigated and used some for pasture for cattle and horses . d. Upon information and belief, the proposal. is not located within in any overlay district area. e. The proposed area is a small dry land farm that has not been farmed fcr two or three years . f . There is no foreseeable danger to the health, safety, and welfare of the inhabitants of the neighborhood, in that the closest neighbor is one quarter of a mile away, and the next cicsest neighbor is a mile awae . The type of use proposed is a horse training and boarding facility, enlarged from its previous smaller size . The number of shifts to be worked is one , and the maximum number of employees presently is three, with an eye to future growth. Maximum growth appears to be at no more than 10 employees , most17 working in the daytime hours . d. The average number of users, patrons, members , buyers, or employees at present is ten at any given time , subject to change with growth . There may be additional persons at horse shows , clinics , etc . , that may be given from time to time . e. Types of animals on the site are horses , and the maximum number to be concentrated on the site at any one time are 12 presently boarded and 11 per- sonal animals, subject. to change with growth . Anticipated growth will not exceed 100 animals . A daytime show may include another additional 23 animals which would be present on a one-day basis only . f . The present and proposed structures are as follows : riding arenas, a proposed indoor arena, one shed with outside runs for boarded horses, and a pro- posed small tack shop on the premises . The tack shop will furnish personal items to the riders wha use the facilities, as well as leather and cloth goods for their horses . g. The vehicular traffic and access routes that will be utilized: any and all types of passenger ve- hicles and some horse trailers using the facilities during the business hours . Access to the facilities will be gained via a private road adjoining US 34 Bypass . Average traffic, spread throughout the day, is 10 vehicles per day. h. The domestic sewage facilities are city water and a farm septic system. -2- C i. Wastes in the form of horse manure are picked up daily and loaded on a tractor-drawn manure spreader gathered in far pastures . Grounds are semi-public and are cleaned daily. j .
