RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 132 -
TENNIS MEADOWS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has approved Recorded
Exemption No. 132 on April 17, 1974 for Carl Sealey concerning
property described as all that part of Lot 3 of the NEa of the SE;
of Section 9, Township 5 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado, and
WHEREAS, Tennis Meadows has requested that Recorded Exepmtion
No. 132 be amended as follows:
Lot A, reduce from 4. 7 acres to 3. 86 acres
Lot B, remain at . 94 acres
WHEREAS, the Board of County Commissioners has studied said
request and deems it advisable to approve the amendment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners that the hereinabove amendment to Recorded Exemption No. 132
for Tennis Meadows be, and hereby is, approved.
The above and foregoing resolution was , on motion duly made
and seconded, adopted by the following vote on the 17th day of
February, A.D. , 1982.

Re: Amendment to RE 132
Dear Commissioners :
The attached application, plat and related items are in reference to a
request to amend recorded exemption #132 from Tennis Meadows , a general
partnership. The property is described as part of the pt. of Lot 3 NEa
of the SEa of Section 9, T5N, R65W of the 6th P.M. , Weld County, Colorado.
This property is located east and adjacent to the town of Greeley, north
of 18th Street on Cedar Avenue.
The request reduces the size of Lot A from 4.7 acres, more or less , to 3.86
acres, more or less . Lot B would be .93 acres , more or less . Property is
currently zoned "I-1" (Industrial ) .
Based upon the information submitted the Department of Planning Services
staff recommends approval of this requested amendment to the recorded
exemption for the following reasons :
1. The impact on the surrounding land uses would not appear to
be any different from the original request which has already
been approved.
2. The Greeley Planning Commission has set forth no objections to
this request.
3. This request is in compliance with Section 9-2A of the subdivision
regulations .
Conditional Statement:
1. An additional 20 feet of right-of-way should be dedicated by
the applicant on the north side of U.S. Highway 34 business route
as requested by the State Highway Department.

Greetings :
Enclosed herewith is a sketch and a completed "Recorded
Exemption Application" for a parcel of land legally des-
cribed in the application. Additionally, a copy of a
survey for a parcel owned by Alice B. Smith and generally
known as 1025 East 18th Street, Greeley, Colorado , and
which is adjacent to the southern most boundary of the
subject property. Also, a Land Contract and a copy of
the Title Insurance Policy on said transaction is enclosed.
Tennis Meadows , a General Partnership, owns Lot A but has
an encumbrance to Alice B. Smith on Lot Sand is desirous
of deeding said Lot B to Alice B. Smith in lieu of fore-
closure. Alice B. Smith is in agreement with this pro-
cedure and will make Lot B an addition to the property
known as 1025 E. 18th St. thus creating a parcel of ap-
proximately 1.25 acres with access onto both Cedar Ave.
and 18th St. (Highway 34) . This parcel is shown on the
sketch with a blue boundary line.
As per your instructions an "Application for Subdivision
Exemption" by Alice B. Smith is being submitted simul-
taneously with our "Recorded Exemption Application" so
that the aforementioned results can be accomplished.
Please advise if any additional information is needed.

Dear Mr. Allison:
We have reviewed the Tennis Meadows application for an amended Recorded Exemption,
and we ask for your consideration of the following comments.
1 . Consideration should be given to the need for additional right of way along
U.S. Highway 34 Business Route. At present, we can only document the existence
of a 60-foot total right-of-way width, 30 feet each side of the centerline.
This width would not allow for future improvement of the highway to a standard
consistent with the Weld County or City of Greeley Comprehensive Plans.
We recommend the dedication of an additional 20 feet along the north side
of the highway.
2. Access to Lot B is presently available from the highway through an existing
private driveway. Provided that there is no change in traffic at this
driveway as a result of this amended exemption, continued use of the driveway
is acceptable. A change in the amount or type of traffic would necessitate
the submission of an Application for Access Approach Permit.
