The parcel of land on which this request has been made is described at Pt. Ek SEa Section 7, T 1 N, R 68 W of the 6th p.m. , Weld County, Colorado. This property is located three quarters of a mile northeast of the Town of Erie. The property contains approximately 15.397 acres of Class II irrigated and Class III and IV non-irrigated soils. The request is to split the property into parcels of 12.897 acres and 2.5 acres. The applicant is seeking to obtain a construction loan from the Federal Land Bank to finish construction of a Passive Solar Hone located on the proposed 2.5 acre parcel. The applicant wishes to divide the property so that the total value of the hone and the land does not exceed $80,000.00. The Subdivision Exenption psucedure normally used for financing purposes is not acceptable to the Federal Land Bank. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff reccrnends the request be approved for the following reasons: 1. The request is in compliance with the policies of the Weld County Compre- hensive Plan in that to minimize conflicting land uses, residential de- velopment will be encouraged to locate adjacent to existing towns and in accordance with the carprehensive plans and stated wishes of each community. The parcel of land is located within 3/4 miles of the Town of Erie and is inside the Erie Comprehensive Plan. The Town of Erie Planning Commis- sion has set forth no objections to this request. 800631 Recorded Exemption #464 November 19, 1980 Page two 2. The request is consistent with Section 9-2 of the Weld County Subdivision Regulations and Section 3.3.A. of the Weld County Zoning Resolution. The use will be compatible with surrounding agricultural uses. 3. This request =plies with the provisions of Section 9-4 A. of the Weld County Subdivision Regulations with the exception of Section 9-4 A. (4) which is addressed as a condition for approval. The Department of Planning Services staff recommendation for approval is condi- tional upon the applicant demonstrating to the satisfaction of the Board of County Commissioners that an adequate water supply can be made available to the property. The existing well on the property is for house- hold use only from the Laramie-Fox Hills Aquifer. This aquifer is considered tributary and the existing permit was issued only because the parcel was in existance prior to the passage of Senate Bill 35. Unfortunately, this office cannot issue permits for additional wells on this property without an approved plan for augmentation. Due to this, we cannot recommend approval of the Rein Exemption.
