The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the -Board of County Commissioners that the applicant has shown compliance with Section 24. 4. 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive plan. b. The proposal is consistent with the intent of the Agricultural Zone district in which the use is located. o. The uses which would be permitted will be com- patible with existing surrounding land uses and with future development of the surrounding area. d. The permitted use shall be oil and gas production facilities as described and located in the submitted application materials and plat maps on file with the Department of Planning Services. 2. To ensure adequate fire protection, the following measures shall be adopted: A. Final plans for a water supply on the subject site shall be reviewed and approved by the Brighton Fire Protection District. The letter of approval and plans shall be sent to the Department of Planning Services prior to final approval by the Board of County Commissioners. B. Final plans for a means of prompt notification of plant employees and the public fire department shall be reviewed and approved by the Brighton Fire Protection District. The letter of approval and plans shall be sent to the Department of Planning Services prior -to final approval by the Board of County Commissioners. C. All valves carrying flammable liquids or gases shall be properly labeled and readily visible. A map locating such valves shall be forwarded to the Brighton Fire Protection District and Department of Planning Services within thirty (39) days of final approval by the Board of County Commissioners. D. All fire extinguishers shall be rated a minimum 80 BC. The fire extinguishers shall be located at sites approved by the Brighton Fire Protection District. A letter from the Fire Protection District approving fire extinguisher locations shall be forwarded to the Department of Planning Services prior to final approval by the Board of County Commissioners. E. The property address sign shall be placed on the property and made visible fran Weld County Road 4. The address numbers shall be five (5) inches in height and three-quarters (3/4) inch in stroke. 3. A fifteen (15) inch by forty (40) foot corrugated metal pipe culvert shall be constructed at the entrance for drainage purposes. 4. All liquid storage vessels must be adequately bermed to contain all potential content in the event of spillage. 5. Hazardous substances per CRS 29-22-107 must be stored, handled, quantified and disposed of properly. Immediate notification to the State Health Department and the Weld County Emergency Response Coordinator is required. 6. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 7. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 8. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 10. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. Russell Anson Planning Department Representative, James Mayerl The following business was transacted: I hereby certify that pursuant to a notice dated November 21, 1983, and duly published in the La Salle Leader on November 23, 1983, a public hearing was conducted for the purpose of considering the request of Vessels Oil & Gas Company for a Use by Special Review for a gas processing plant. The Assistant County Attorney, Russell Anson, read this request into the record. James Mayerl, representing the Planning Depailttnt, read the favorable recommendation, with Operation Standards, into the record. Mr. Tom Vessels was present and explained to the Board that this request is being made in order to replace and modify the existing installation to handle additional amounts of gas and to • deliver gas to different markets than it did in the past. He said that the old plant no longer exists. Mr. Mayerl explained that because of the intensity of use, a new Use by Special Review is warranted. Commissioner Martin moved to approve, with Operation Standards, Use by Special -Review for a gas processing plant for Vessels Oil & Gas Company. To ensure adequate fire protection, the following measures shall be adopted: A. Final plans for a water supply on the subject site shall be reviewed and approved by the Brighton Fire Protection District. The letter of approval and plans shall be sent to the Department of Planning Services prior to final approval by the Board of County Commissioners. B. Final plans for a means of prompt notification of plant employees and the public fire department shall be reviewed and approved by the Brighton Fire Protection District. All valves carrying flammable liquids or gases shall he properly labeled and readily visible. David E. Howard, et al , has leased the surface rights of a twenty-three (23) acre tract to Vessels Oil & Gas Company since May 11 , 1974. A Warranty Deed on the property was executed September 2nd, 1983, for the purchase of 25.50 acres in the SE/4SE/4 of Section 28, Township 1 North , Range 67 West, by Vessels Oil & Gas Company. Vessels Oil & Gas Company has used the land for more than nine years as the site for a Gas Processing Plant Facility and Field Office. A Special Use Permit #256 was filed, and approved for this use, in 1974. Due to a changing gas market, Vessels Oil & Gas Company has found it imperative to diversify its gas markets and sell gas to new markets Vessels had not previously supplied. The conditions under which these additional markets will take gas are different than those of the markets Vessels was servicing. As a result of those new delivery conditions that must be met, Vessels Oil & Gas Company is currently modernizing and improving the existing Gas Processing Facility. Because of the renovation, replacements and improve- ments being made to Vessels facilities , the Department of Planning found it necessary to have the Special Use Permit #256 amended. Vessels Oil & Gas Company feels that the request is consistent with the Weld County Comprehensive Plan, in that the Vessels Gas Processing Facility, has and will , continue to enhance and support the oil and gas industry growth and development in Weld County. The land use is , and will remain compatible with the surrounding lands. The subject acreage will facilitate in the purchasing, and processing of the production, from the oil and gas wells that are located in the vicinity. The surrounding acreage is agricultural , which is consistent with the majority of the acreage in the area. The existing and proposed land use will continue to enhance the future development of the area. The acreage is presently zoned Agricultural , and is proposed to remain so. The Gas Plant Facility, by continuing to expand its pipelines and processing capabilities, will encourage more oil and gas production throughout the county, which in turn will bring both economic and employment opportunities to the residents of Weld County.
