RE : APPROVE CONTINUANCE OF USE BY SPECIAL REVIEW HEARING TO
OCTOBER 12 , 1983, CONCERNING A DAIRY OPERATION - GERRIT AND
HENRIETTA HOOGLAND
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , a Use by Special Review hearing for a dairy oper-
ation for Gerrit and Henrietta Hoogland was scheduled for Octo-
ber 5, 1983, at 2 : 00 p.m. , as stated in the Notice dated Septem-
ber 19 , 1983 , a copy of said Notice being attached hereto and
incorporated herein by reference, and
WHEREAS, at the hearing of October 5, 1983, the Board,
after consideration, deemed it advisable to continue the hearing
until October 12 , 1983, at 2 : 00 p.m. in order to allow the Com-
missioners time to visit the site.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Use by Special Re-
view hearing for a dairy operation for Gerrit and Henrietta
Hoogland be, and hereby is, continued to October 12 , 1983, at
2 : 00 p.m.
The above and foregoing Resoltuion was , on motion duly made
and seconded, adopted by the following vote on the 5th day of
October, A.D. , 1983 .

A public hearing was conducted on October 5 , 1983 at 2:00 P. M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated September 19, 1983, and duly
published September 22, 1983, in the La Salle reader, a public hearing was held
for the purpose of considering the application for a Use by Special Review, '
dairy operation, for Gerrit and Henrietta Hoogland. Russ Anson, Assistant
County Attorney, read this proposal in the record. Rod Allison, representing
the Planning Department, read the favorable recommendation of the Planning
Commission into the record. He also stated that there are ten Operation
Standards associated with this proposal. Mr. and Mrs. Hoogland were present
and came forward to present their request. Mrs. Hoogland stated that they
• have dairied all their lives and that dairying is their permanent occupation.
Their proposal is to have 1,000 cows on 42 acres. Chairman C. Carlson questioned
the proposed drainage. Joan Murphy, owner of property east of the proposed
dairy operation, stated that in the past she has had problems with overflow
from a dairy owned by the Hooglands draining onto the property on which the
Hooglands wish to develop for this dairy operation. Ms. Murphy further stated
that she had not objected earlier because she was of the impression they were
requesting to have only 200 cows and would not object to the smaller operation.
She expressed concern about the health hazard created by run-off, and also
stated that she felt this will not help her property value. Ms. Murphy asked
that, if this is approved, there be sane stipulation to control the water.
Rod Allison pointed out that Operation Standard #6 addresses the issue of
run-off. Bob Lebsack, who owns and operates two farms adjacent to the proposed
site, stated he is also concerned about the run-off. He presented the Board
a petition in opposition from neighbors, a map showing their locations, and
a letter fran Harry Lateral Ditch Company concerning its policy of accepting
runoff. Mr. Lebsack said he is getting considerable run-off from the dairy
which is already situated west of the dairy being proposed, estimating that
he has already lost fifteen to twenty acres of hay. Commissioner Johnson stated
that, due to no opposition at the Planning Commission hearing, she had not
visited the site and would like a chance to look over the situation. Commissioner
Carlson stated that the problem seems to be with the existing dairy and perhaps
some checking should be done as to whether they are operating within their
Operation Standards. Chairman C. Carlson commented that the Board likes
to work with people in the Agricultural areas and several members of the
Board would like to look over the area. Mr. Hoogland stated that these
problems have arisen since they left the operation, and the current manager
will probably get things under control. He further stated that he tried to
pump his water back over the land. Mr. Lebsack said this type of water seals
the ground and requested that the Board look at the property. Commissioner
Johnson moved that this hearing be continued to October 12, 1983, at 2:00 P.M.
Commissioner Brantner seconded the motion, which carried unanimously.
