CORRECTED RESOLUTION
RE: GRANT CHANGE OF ZONE FROM A (AGRICULTURAL DISTRICT) AND C-3
(COMMERCIAL DISTRICT) TO A PLANNED UNIT DEVELOPMENT - SEKICH
FARMS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , a public hearing was held on the 16th day of Feb-
ruary, 1983 , at 2 : 00 o'clock p.m- fcr the purpose of hearing the
application of Sekich Farms , I-25 & Highway 66 , Mead, Colorado

0 re 80542 , requesting a Change of Zone from A (Agricultural District)
to C-3 (Commercial District) to a Planned Unit Development, and
WHEREAS , the original resolution had a minor defect in the
legal description and should be corrected to read as follows:
A portion of land situated in the SWQ of Section 23 ,
T3N, R68W of the 6th P. M. Weld County, Colorado ,
more particularly described as follows:
Beginning at the center of Section 23 , and thence along
the center line of said Section 23 , S89°46 ' 21" W, 30 . 00
feet to the true point of beginning;
Thence 1) S 0°46 ' 27"E, 30 feet westerly of and parallel
to N-S center line of Section 23 , 2564 . 77 feet to a point;
Thence 2) S44°38 ' 13" W, 63 . 00 feet to a point;
Thence 3.))89°24 ' 50" W, 40 feet north of and parallel
to the southerly line of said Section 23 , 1193 . 63
feet to a point;
L: r` `• Thence 4) N 0°16 ' 59" E, 1280 . 18 feet to a point;
;.T „ Thence 5) S 89° 42 ' 56" W, 1336 . 38 feet to a point;
Thence 6) N 0°17 ' 04" W, 50 feet easterly and parallel
to the West line of the SW quarter of said Section 23 ,

of beginning;
Containing 114 . 050 acres more or less.
WHEREAS, Section 21. 6 . 2 of the Weld County Zoning Ordinance
provides standards for review of such a Change of Zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present , has studied the re-
quest of the applicant and the recommendations of the Weld County
Planning Commission, and having been fully informed finds as
follows:
1. The applicant has complied with Section 21 . 7 et. seq. of
the Weld County Zoning Ordinance regarding the applica-
tion requirements for a Change of Zone.

2 . The request is in conformance with Section 21 . 5 of the
Weld County Zoning Ordinance as follows:
a) The approval of Zone Case #378 from Agriculture to
Commercial 3 , north of the subject property on Nov-
ember 17 , 1982 , and the approval of Zone Case #369
from Agriculture to Commercial 3 on a portion of the
subject property on June 23 , 1982 , demonstrates that
the conditions in this area have changed and do war-
- rant industrial and commercial development.
b) In accordance with the Development Standards listed
below, Weld County Road 91, Colorado State Highway
66 , and the I-25 Frontage Road will provide adequate
access to the site.
c) The proposed rezoning would not interfere with ex-
traction of any known commercial mineral deposits.
d) Soil conditions do not present limitations to the
construction of the structure on the site.

e) The subject site will have an adequate sewage system.
cr The Weld County Health Department will require a
review of each individual septic system.
f) A letter dated September 17 , 1981 , from the Little
Thompson Water District indicates the subject site
will have an adequate water service.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application of

, ,, Sekich Farms, for a Change of Zone from A (Agricultural District)
c _ and C-3 (Commercial District) to a Planned Unit Development on
the above referenced parcel of land be, and hereby is , granted
subject to the following conditions :
1 . The final Change of Zone plat shall show a reservation
of an additional thirty-five (35) feet north of the
existing right-of-way on Colorado State Highway 66 .
2 . The final Change of Zone plat shall show one (1) access
point directly to Colorado State Highway 66 . The access
point shall be at the west edge of the subject develop-
ment' s southern boundary.
3 . Turn lane requirements shall be provided for as set
forth in the State Highway Access Code. The following
turn lanes shall be required; a median left-turn lane
from Colorado State Highway 66 to the access point at
the west edge of the subject development ' s southern
boundary. If a median left-turn lane cannot be con-
structed due to highway right-of-way limitations ,
this access shall be limited to right-turns . A right-
turn deceleration lane shall be required from Colorado
State Highway 66 to the access point at the west edge
of the subject development' s southern boundary.

4 . The applicant shall comply with the performance standards
contained in Section 35. 3 of the Weld County Zoning

Ordinance.
5. The final Planned Unit Development plat shall show one
pr-
(1) access to Colorado State Highway 66 . The subject
access shall be located at least one (1) foot from the
west edge of the south boundary of the Planned Unit
r ,z; Development.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 18th day of
April, A.D. , 1983.
