No. ORDINANCE NO. 78 State of Colorado, Weld County Clerk & Recorder r IN THE MATTER OF SETTING THE MILL LEVY FOR THE ANNUAL APPROPRIATION FOR • WELD COUNTY, COLORADO FOR THE FISCAL YEAR 1981. c+ BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO: That it is necessary, by Colorado statutes, and by the Home Rule Charter of Weld County, Colorado, to set the annual mill levy for the annual appro- n priation for Weld County, Colorado, for the fiscal year 1981, and � WHEREAS, in compliance with an act of law entitled, "An Act to require ) the affairs of the several counties of the State of Colorado to be continued from the revenue derived from taxation and prevent other expenses of any county from exceeding its revenue---", and in accordance with Colorado Re- vised Statutes, Title 29, Article 1, 1973, "During the fiscal year, no officer, department, board, commission or other spending agency shall expend any money, or incur any liability, or enter into any contract which, by its terms, involves the expenditure of money for any of the purposes for which provision is made in the appropriation ordinance or resolution, including any legally authorized amendments thereto, in excess of the amounts appropriated in said ordinance or resolution for such office, department, board, commission or other expending agency, or purpose for such fiscal year. Any contract, verbal or written, made in violation of this section shall be void as to the local government, and no money belonging thereto shall be paid thereon.---", and WHEREAS, the Board of County Commissioners, in accordance with Section 14-7 of the Weld County Home Rule Charter have determined that the amount of property tax derived from only a 5% increase will be insufficient for County needs for fiscal year 1981, and WHEREAS, the majority of the County Council, in accordance with Section 14-7 of the Weld County Home Rule Charter, on November 6, 1980 granted an increased levy for the County within their authority which will allow a total property tax revenue of $12,622,216 and a total mill levy of 17.247. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Weld County, Colorado, that the revenue derived from taxation of said County, shall be and is hereby appropriated to defray the necessary expenses and liabilities of said County for the next fiscal year, 1981, in the following sums to-wit: - 800468 0-1 919 1841369 Mills Revenue County General Fund 13.734 $10,051,435 Road and Bridge Fund -0- -0- Social Services Fund 2.431 1,778,954 Hospital Capital Fund .911 667,000 Public Works Fund, County Buildings .171 124,827 Total 17.247 $12,622,216 BE IT FURTHER ORDAINED that the County Assessor and the County Treasurer of Weld County, Colorado, be, and hereby are, authorized and directed to make such entries upon their books, at such time or times as will be necessary to make this mill levy Ordinance for the annual appropriation for Weld County, Colorado, for the fiscal year 1981, effective. BE IT FURTHER ORDAINED that an emergency exists inasmuch as State law requires that the budget Ordinance of Weld County, Colorado, be enacted on or before the 15th day of November, 1980, and, therefore, this Ordinance is declared to be an emergency Ordinance under the provisions of Section 3-14 of the Weld County Home Rule Charter. The above and foregoing Ordinance No. 78 was, on motion duly made and seconded, adopted by the following vote on the 12th day of November, A.D. , 1980.
