RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 494 -
GEORGE AND LAUREN SANDBERG
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , on the 6th day of May, 1981, the Board of County
Commissioners approved Recorded Exemption No. 494 concerning
property described as including the West 1/2, Northeast 1/4 ,
Section 6 , Township 4 North, Range 67 West of the 6th P.M. , Weld
County, Colorado, and
WHEREAS , George and Lauren Sandberg have requested that
Lot B of Recorded Exemption No. 494 be amended from 151 acres ,
more or less, to 71 acres, more or less, and
WHEREAS , the Board of County Commissioners has studied
said request to amend Recorded Exemption No. 494 and deems it
advisable to approve the request.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove amend-
ment to Recorded Exemption No. 494 requested by George and Lauren
Sandberg be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services Office to be recorded in the
office of the Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2 C. (4) of the
Weld County Subdivision Regulations. The plat shall be sub-
mitted within ninety (90) days from the date of approval by the
Board.

Re: Amended Recorded Exemption #494
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from George and Lauren Sandberg for a recorded exemption. The
parcel of land on which this request is being made is described as the
West 1/2, Northeast 1/4, Section 6, Township 4 North, Range 67 West of
the 6th P.M. , Weld County, Colorado.
The property is located one (1) mile northwest of Johnstown on Weld County
Road 50. The property contains approximately 155 acres of Class Ile,
IIIe and IVe irrigated soils.
The request is to amend Lot B of RE 494 from 151 acres, more or less, to
71 acres, more or less. The 71 acres, more or less, will be used for
agricultural purposes. The remaining 78 acres, more or less, of Lot B is a
separate legal lot in the Agricultural Zone District as defined by Section
31.5.1 of the Weld County Zoning Ordinance.
Based upon the submitted information and policies of the County, the Department
of Planning Services staff recommends the request be approved for the
following reasons:
1. The request complies with Section 9-2 C of the Weld County
Subdivision Regulations submission requirements.
2. The request complies with Section 9-2 E of the Subdivision
Regulations as follows:

- The 77 acres, more or less, under consideration will be
compatible with the existing surrounding land uses, The uses
which would be permitted are consistent with the intent of the
Agricultural Zone District in which the uses are located.
- The proposal was reviewed by the City of Johnstown and was found
to comply with their long-range Comprehensive Plan.
- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land division
complies with the Weld County Comprehensive Plan. Therefore,
the proposed use is consistent with efficient and orderly
development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- The Little Thompson Water District has indicated adequate
water service is available for this proposal.
- The proposed lots are not part of a recorded exemption within
the last five (5) years.
- The two lots proposed will have adequate access from Weld
County Road 50.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant submitting a mylar plat to the Department of
Planning Services office to be recorded in the office of the
Clerk and Recorder. The plat shall be drawn in accordance
with the requirements of Section 9-2 C. (4) of the Weld County
Subdivision Regulations. The plat shall be submitted within
ninety (90) days from the date of approval by the Board.

COMMENTS:
The subject site is irrigated cropland with an eastern slope. Amended RE-494 includes
the Martin residence, garage, four outbuildings, pole shed, and corrals (all on Lot
"A") . RE-642 currently does not have any improvements except for a tank battery.
Access for the resulting lots will be Weld County Road 50, a gravel road.

My father, George L. Sandberg, and I purchased Lot B, Recored Exemption
Number 1059-6-1-RE494 on October 30, 1981.
My wife and I would now like to place our permanent residence on the
property. After discussing the financing of our new residence with our
lender, we were informed we would have to have a separate deeded parcel
to obtain financing. The problem arises from the fact that my father
and I own the farm and my wife and I desire to build the house. There-
fore , we are requesting a amended recorded exemption on RE494 to adjust
the property lines so that we can locate our home at the desired location
on the farm. We are also requesting a recorded exemption in the East
half of the NE k Section 6 Township 4 North Range 67 West, so that we
can establish our permanent residence on the farm.
We have discussed this proposal with the Little Thompson Water District
and water taps are available for all the parcels discussed. We have also
discussed this with our engineer as far as septic tanks are concerned , and
he assures there will be no problem in establishing functional septic systems.
We have discussed this proposal with the staff and reviewed the County Comp-
rehensive Plan and Zoning Regulations. We have been unable to find any con-
flict with the County' s existing rules.

LEGAL DESCRIPTION
The West Half of the Northeast Quarter (W4NE4) of Section 6, Township 4 North, Range 67
West of the 6th P.M. , Weld County, Colorado, being more particularly described as
follows:
Beginning at the North Quarter Corner (Nk Cor) of said Section 6 and considering the
North line of said West Half of the Northeast Quarter (WINE'a) of Section 6 as bearing
South 84°14'59" East and with all other bearings contained herein relative thereto;
Thence South 84°14'59" East along said North line 1383.38 feet; Thence South 04°04'13"
