RE: APPROVAL OF SUBDIVISON EXEMPTION NO. 196 - RICHARD AND SHERI
CARLSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners has reviewed the
request of Richard and Sheri Carlson for an exemption from the
definitions of "subdivision" and "subdivided land" in Section
30-28-101 (10) (d) , CRS 1973 , as amended, and Section 2-1 A. (3)
of the Weld County Subdivision Regulations , and
WHEREAS, the Board finds that Richard and Sheri Carlson are
the owners of a certain parcel of land located in part of the
NEa, Section 14 , T6N, R66W of the 6th P.M. , Weld County, Colo-
rado, and
WHEREAS, the applicants desire to separate the existing
residence from the 240 acres for financial reasons, and
WHEREAS, said parcel of land is more particularly described
as follows:
EXISTING PARCEL
An undivided one-third (1/3) interest in and
to the North Half of the Northeast Quarter
(NzNE4) of Section Fourteen (14) , Township
Six (6) North, of Range Sixty-six (66) West
of the 6th P.M. , Weld County, Colorado, toget-
her with four (4) shares of the capital stock
of the Larimer and Weld Reservoir Company,
two (2) shares of the capital stock of the
Larimer and Weld Irrigation Company, and
two (2) shares of the capital stock of the
Lucas Lateral Ditch Company.
Together with 125 acre feet of the Northern
Colorado Water Conservancy District.
PROPOSED SMALLER LOT
A tract of land located in the Northeast
Quarter of Section 14 , Township 6 North,
Range 66 West of the 6th P.M. , Weld County,
Colorado being more particularly described
as follows:
Commencing at the East Quarter Corner of
said Section 14 and considering the East
Line of the Northeast Quarter of said Section
14 to bear North 00°12 ' 30" West with all
bearings contained herein being relative
thereto;
Thence North 00°12 ' 30 West, 313 . 95 feet along
the East Line of said Northeast Quarter to
the True Point of Beginning;

Location of Property: Approximately 1.5 miles northeast of Greeley incorporated
city limits on Weld County Road 35
The owners of the property described above have requested an exemption from
Section 2-1 of the Weld County Subdivision '_Regulations adopted August 30, 1972.
The Department of Planning Services staff has reviewed this request and
recommends that the request be approved for the followings reasons:

The subdivision exemption would separate an existing residence from the
240 acre Carlson farm and place the structure on its own legal lot. This
procedure is for financing purposes only and, therefore creates a defined
legal lot for lending purposes.
The Department of Planning Services recommends approval condtional upon
the applicant resubmitting proper legal descriptions of the existing
situation and the proposed changes. The legal description shall be
prepared by a registered land surveyor in the State of Colorado.

SUPPORTING INFORMATION FOR APPLICATION FOR
SUBDIVISION EXEMPTION
Applicants, Richard L. Carlson and Sheri B. Carlson, hereby
submit the following supporting information for their Application
for Subdivision Exemption.
1. The legal description and map of the parcel to be
exempted is attached hereto as Exhibit "A" .
2. Exhibit "B" is a map showing the general location of the
larger tract containing 240 acres. The larger tract consists of
the Northeast Quarter and the North one-half of the Southeast
Quarter of Section 14 , Township 6 North, Range 66 West of the 6th
P.M. which is owned by Richard L. Carlson; David L. Carlson and
Gretchen Carlson; and Donald C. Carlson.
3. The improvements on this property have been in existence
for over thirty years. Applicants ' purpose in obtaining this
exemption is so that Applicant can obtain a loan to remodel the
improvements on the property which consist of a one-story frame
house and two garages.
4 . Copies of deeds to the property are attached hereto as
Exhibits "C" and "D" .
5 . Applicants submit Exhibits "A" and "B" as graphically
depicting Applicants intentions and will submit a plot plan once
the Application for Subdivision Exemption has been approved.
6 . The fee of $35. 00 is enclosed.
