WASHINGTON,O.C.20036 (202)828-2900 .NOT ADMITTED IN COLORADO Board of County Commissioners Weld County, Colorado 915 Tenth Street Greeley, Colorado 80631 Re : Proposed Industrial Development Revenue Bond Issue for Commercial Office Building Ladies and Gentlemen: We have reviewed a proposal for the issuance of indus- trial development revenue bonds (the "Bonds") by Weld County, Colorado (the "County") , the proceeds of which Bonds would be used to finance the cost of acquiring and constructing the hereinafter defined Project . The Bonds would be issued under the County and Municipality Development Revenue Bond Act , article 3 , title 29 , C.R.S . 1973 , as amended (the "Act") , and would not constitute an indebtedness of the County. The proposal we have reviewed provides that the proceeds of the Bonds would be loaned to a number of individuals , as joint tenants (the "Participants") . The Participants would acquire land and construct thereon a 30 , 000-40 ,000 square foot commercial office building (the "Project" ) . Voss City Clerk • • CITY COUNCIL PROCEEDINGS January 19 , 1982 The meeting was called to order at 7 : 30 p .m. by Mayor Mike Lehan. in the Council Chambers . 1. PLEDGE OF ALLEGIANCE The Pledge of Allegiance to the American Flag was led by Mayor Lehan. 2. ROLL CALL Roll was called by City Clerk Gayle Voss . Present were: Mayor Lehan, and Councillors Tom Starr, Warren Terry, John Donley, Tom Romero, Bruce Forbes and Tom Maya 3. APPROVAL OF MINUTES Councillor Starr moved, seconded by Councillor Terry, to approve the January 5, 1982, Council meeting minutes as printed. Motion carried: 7-0 . 4 . APPROVAL OF AGENDA There being no additions or deletions , Mayor Lehan declared the agenda approved as printed. 5 . FUTURE ITEMS FOR AGENDA There were no items noted for a future Council agenda. 6. REPORT FROM THE COMMITTEE-OF-THE-WHOLE Mayor Lehan reported on the Committee-of-the-Whole meeting of January 12 , 1982 , at which the Committee considered the Golf Course fees for 1982, the site selection for the Girl Scouts building, an ordinance adding a section to the Uniform Building Code relating to historic buildings, and considered appointments to the Greeley Downtown Development Corporation, Citizens Traffic Safety Committee, Parks and Recreation Advisory Board and Urban Renewal Board. Councillor Terry moved, seconded by Starr, to approve the minutes with the following addition: Under the site selection for the Girl Scouts building, "Mrs . Haas indicated that the Girl Scouts will replace and maintain any trees that are removed for the building. " Motion carried: 7-0 . 7. INTRODUCTION AND FIRST READING OF AN ORDINANCE REPEALING SECTION 3. 16 . 290 THROUGH AND INCLUDING SECTION 3 . 16 . 370 OF GREELEY MUNICIPAL CODE CONCERNING DISCIPLINARY PROCEDURES AND APPEALS FOR EMPLOYEES OF THE CLASSIFIED SERVICE AND RE-ENACTING THE SUBJECT MATTER THEREOF Councillor Donley moved, seconded by Forbes, that all members of Council present at this meeting coo on record as introducing this ordinance to be read at this time . CONSIDERATION OF A RESOLUTION AUTHORIZING THE PREPARATION OF AN IMPROVEMENT DISTRICT CREATION ORDINANCE FOR CURB, CUTTER, SIDEWALK, AND PAVING IMPROVEMENT ON 24TH STREET FROM 6TH AVENUE TO 7TH AVENUE AND THE AUTHORIZATION TO BEGIN PRELIMINARY WORK ON SUCH IMPROVEMENT DISTRICT Councillor Donley moved, seconded by May, to adopt the resolution. Motion carried: 7-0 . (RESOLUTION NO. 2 , 1981) 16 . REQUEST FOR AUTHORIZATION TO TERMINATE EXISTING DEFINED BENEFIT EMPLOYEE PENSION PLAN AND TO REPLACE SAID PLAN WITH A DEFINED CON- TRIBUTION PENSION Councillor Terry moved, seconded by Forbes, that the staff be authorized to execute the necessary documents to terminate the existing defined benefit pension plan with Mutual Benefit Life, effective December. 31, 1981, and implement, subject to final approval by the City Council , a defined contribution pension plan with Bankers Life Company, effective 0J uary 1, 1982 . Motion carried: 7-0. 17. CONSIDERATION OF REFERRAL FROM WELD COUNTY FOR CITY'S POSITION O PROPOSED INDUSTRIAL REVENUE BOND ISSUE FOR AN OFFICE STRUCTURE O BE LOCATED AT 11TH AVENUE AND 10TH STREET Councillor Terry moved, seconded by Forbes, to favor the issuance of Weld County Industrial Development Revenue Bonds for a proposed office structure located at 11th Avenue and 10th Street. CONSIDERATION OF APPROVAL OF CONTRACT BETWEEN THE CITY OF GREII.LEY AND GAGE DAVIS ASSOCIATES FOR DESIGN SERVICES AND COORDINATION OF THE GRL•'ELEY DOWNTOWN DEVELOPMENT PROJECT Councillor. Terry moved, seconded by Starr, that we, as members of The City Council , authorize the Mayor and Chairman of the Board of Directors of. Greeley Improvement District No. 1 to execute the contract between Gage Davis and the City of Greeley. Motion carried: 7-0. Mayor Lehan adjourned the Council meeting and called the meeting of the Greeley Improvement District No. 1 Board of Directors to order. Councillor Terry moved, seconded by Romero, that we, as members of the Greeley General Improvement District No. 1, Board of Directors , authorize the Mayor and Chaiiman of the Board to execute the contract between Gage Davis and the City of Greeley. Motion carried: 7-0 . Mayor Lehan adjourned the meeting of the Greeley Improvement District No. 1 Board of Directors and reconvened the regular Council meeting . 19 . CONSIDERATION OF SITE SELECTION FOR GIRL SCOUTS BUILDING Councillor Starr moved, seconded by Terry, to approve the Committee- of-the-Whole's recommendation that the site on 23rd Avenue be selected with the stipulation that the building be designed in a manner so as to preserve as many existing trees as possible and that the Girl Scouts replace the trees that are removed for construction of the building. Motion carried on a roil call vote: 5-2 (Donley and Romero dissenting) 20. CONSIDERATION OF IMPLEMENTATION OF ELDERLY AND HANDICAPPED TRANSIT SERVICE Councillor Donley moved, seconded by Forbes, to continue discussion of this item to item no. 26 . Motion carried: 7-0 . 21. CONSIDERATION OF AN APPLICATION FOR RETAIL LIQUOR STORE LICENSE TO ESTABLISH NEIGHBORHOOD AREA AND SET PUBLIC HEARING FOR B/B, LTD. D/B/A BOOZE BAG, 3635 W. 10TH STREET Councillor. May moved, seconded by Donley, to set the public hearing date for February 16, 1982 , and to establish the neighborhood area as 4th Street on the north, 20th Street on the south, 26th Avenue on the east and 42nd Avenue on the west. Motion carried: 7-0 . 22. APPROVAL OF CHANGE OF CORPORATE STRUCTURE FOR B/O, INC. D/B/A LASSO LIQUOR, 803 5TH STREET Councillor Starr moved, seconded by Donley, to approve the change of corporate structure for 8/O, Inc. d/b/a Lasso Liquor, 803 5th Street. Motion carried: 7-0 . 23 . APPROVAL OF CHANGE OF CORPORATE STRUCTURE FOR A.C.M.s, INC. D/B/A EASTSIDE LIQUORS, 328 18TH STREET City Council Procee ngs January 19 , 1982 Page Five Councillor Starr moved, seconded by Terry, to approve the change of corporate structure of A.C.M. ' s , Inc. d/b/a Eastside Liquors , 326 18th Street. Motion carried: 7-0 . 24 . APPOINTMENTS TO THE GREELEY DOWNTOWN DEVELOPMENT CORPORATION, CITIZENS TRAFFIC SAFETY COMMITTEE, PARKS AND RECREATION ADVISORY BOARD, AND BOARD OF COMMISSIONERS OF COMMUNITY DEVELOPMENT AND URBAN RENEWAL Councillor Terry moved, seconded by Starr, to approve the Committee-of- the-Whole's recommendation that Ken Whitney be appointed to the Greeley Downtown Development Corporation, completing the term of Royce Clark (1-1-83) ; that Mac McKinley be appointed to the Citizens Traffic Safety Committee to complete the term of Thomas Burnett (7-82) ; that D. Rae Scudder be appointed to the Parks and Recreation Advisory Board to complete the term of Henry Shearer (6-82) ; and to ratify the Mayor 's appointment of Maxine Marquez to the Board of Commissioner' s of Community Development and Urban Renewal to complete the term of Mike Lehan (11-84) . Motion carried: 7-0. 25 . REPORT FROM CITY MANAGER City Manager had nothing to report. 26 . REPORT FROM FINANCE COMMITTEE A student at Aims College, Alma Kobobel , Ruth Bruce, Linda Piper of the Weld County Council on Aging, and Millie Stof£ler of WIRS spoke against proposed budget cuts to the transportation system, including the elderly and handicapped program. Councillor May moved, to adopt the elderly and handicapped program and eliminate the Saturday bus service at a savings of approximately $16 , 000 . A substitute motion was made by Councillor Starr, seconded by Romero, to fund the elderly and handicapped transportation program as presently budgeted; however, should the regular transportation program funds be reduced , that the elderly and handicapped program funds be reduced proportionately. Motion carried: 7-0 . Councillor Starr moved, seconded by May, to schedule a Committee-of-the- Whole meeting for 7 : 00 a.m. Friday, January 22, 1982 , to review the Finance Committee 's recommended 1982 Budget cuts . Motion carried: 7-0 . 27 . ORAL AND WRITTEN PETITIONS TO COUNCIL There were no oral or written petitions to Council . 28. CONSIDERATION OF MOTION AUTHORIZING THE CITY ATTORNEY TO PREPARE ANY REQUIRED RESOLUTIONS, AGREEMENTS, AND ORDINANCES TO REFLECT ACTION TAKEN BY THE CITY COUNCIL AT THIS MEETING AND AT ANY PREVIOUS MEETINGS , AND AUTHORIZING THE MAYOR, CITY CLERK, CITY MANAGER, AND CITY ATTORNEY TO SIGN ALL SUCH RESOLUTIONS, AGREEMENTS AND ORDINANCES Councillor Terry moved, seconded by Starr, to approve the above authorizations .
