MARTENSEN WHEREAS, the "Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was conducted on November 16 , 1983 , to consider the request of E-VAP, Limited, c/o Arvin G. Martensen, 2121 North Lincoln Avenue, Loveland, Colorado 80537 , for a Use by Special Review permit for an oil and gas brine water disposal site on the following described real estate , to-wit: Part of the NE4, Section 26 and part of the NW4, Section 25 , all in Township 5 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, the Board did, on November 16 , 1983 , deny the re- quest for a Use by Special Review by a vote of 3-2 , and WHEREAS , the Board did subsequently receive additional in- formation indicating a change in the Operation Standards for said Use by Special Review application, and WHEREAS , the Board deemed it appropriate to reconsider the request for said Use by Special Review, and WHEREAS, on December 12 , 1983 , the Board did reconsider the request for a Use by Special Review at a public Board meeting, and WHEREAS , the Board, having heard the evidence regarding the additional Operation Standards, is of the opinion that such addi- tional Operation Standards obviate the concerns that the Board had during the hearing held on November 16 , 1983, which led to their decision to deny the application on that date, and WHEREAS , after reconsideration, the Board of County Commis- sioners, having heard the testimony and statements of those pre- sent, and reviewing the new evidence and the new Operation Stand- ards as proposed by the applicant, and all of the exhibits and evidence which were presented concerning this matter, and having 830159 ft0051i � � '• `� C. E-VAP LIMITED, MARTENSEN been fully informed, deems it advisable and in the best inter- ests of the citizens of Weld County to approve the request for a Use by Special Review for the following reasons: 1 . The submitted materials are in compliance with application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Com- missioners that the applicant has shown compli- ance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a) The policies of the Comprehensive Plan pro- mote Use by Special Review proposals in an Agricultural Zone District so long as they do not create negative impacts on the environ- ment or the County. The attached Operation Standards , as amended, will minimize impacts on surrounding agricultural uses to the greatest extent possible. The proposal is therefore consistent with the Weld County Comprehensive Plan and is consistent with the intent of the Agricultural District. b) The attached Operation Standards, as amended, will provide adequate protection of the health, safety and welfare of the inhabitants of the neighborhood and the County. c) The use is both compatible with existing agri- cultural activity and with future land use which is contemplated to be agricultural in the Comprehensive Plan. d) No overlay districts affect the site. e) The applicant has demonstrated that a diligent effort has been made to conserve productive agricultural land in the locational decision for the proposed use. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application for a Use by Special Review for an oil and gas well production water disposal site on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Operation Standards, as amended, for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2. No building or electrical permits shall be issued for the Use by Special Review Permit area until the Standards , as amended, for the Use by Special Review have been placed on the Use by Special Review plat and the plat has been delivered to the Department of Planning Services Office to be recorded in the office of the Weld County Clerk and Recorder. The use shall be an oil and gas brine water disposal and oil recovery facility as described in the submitted application materials. No hazardous wastes or nonhazardous industrial waste shall be allowed at the site. The facility shall he designed, constructed and operated to comply with the Colorado Department of Health Solid Wastes Disposal Sites and Facilities Act, Title 30-20, Part 1, CRS 1973, as amended. 2. The facility shall consist of the following: A. One (1) office/residence located as shown on the Use by Special Review Permit Plan Map. B. Three (3) skim tanks and one (1) dump tank. The tanks shall be located as shown on the Use by Special Review Permit Plan Map. C. Four (4) evaporative ponds located as shown on the Use by Special Review Permit Plan Map. D. One (1) heater treater and two (2) storage tank batteries as shown on the Use by Special Review Permit Plan Map. 3. There shall be one (1) point of ingress and egress to the facility from Weld County Road 54. The point of access shall be located, designed and constructed in accordance with the submitted application materials and Use by Special Review Permit Plan Map. 4. The access road to the dump tank shall be constructed and maintained in accordance to the application materials and Use by Special Review Permit Plan Map. 5. Entrance to the facility shall be controlled by electronic gate, activated by credit card as described in the submitted application materials. The State Health, County Health and Planning Department shall be issued a card for entry to the facility. 6. A six (6) foot chain link fence with three (3) strand barbed wire top shall enclose the Use by Special Review area. 7. Evaporative Ponds: A. The four (4) evaporative ponds shall be engineer designed and operated in accordance to the submitted application materials and Use by Special Review Permit Plan Map. B. During the construction phase, a full-time professional engineering/geologic consultant must be retained for continuous inspection of the evaporation ponds. The consultant shall certify by letters addressed to the State Health, County Health and Planning Departments that the design, materials, construction and operation of the evaporation ponds comply with the specifications as listed in the submitted application materials and on the Use by Special Review Permit Plan Map. C. Any areas of highly pervious soils encountered in the bottom of the evaporation ponds during excavation shall be removed to a depth of one (1) foot and replaced with clays equivalent in composition and compaction density to those used for liner construction. D. A representative of the State Health Department or Weld County Health Department must inspect the final evaporation pond excavations prior to liner placement. /. Operation Standards Road 54 E-Vap Park, Limited U.S.R. - 540:83: 3 Page 2 ; E. A representlitive of the State Health Department or Weld County Health Department must inspect the seepage detection system prior to placement of gravel and compacted material on the system. F. In the event it is concluded that the evaporation ponds are leaking or liquid waste is detected in the seepage detection system, the County and State Health Departments shall be notified immediately. Receipt of all waste at the facility shall be discontinued until it can he determined by the State or County Health Department, from evidence presented by the operator or State/County Health Departments, which pond(s) is leaking. The defective pond(s) shall be drained and repairs completed immediately in accordance with Operation Standard Seven (7)B. G. Operation Standard Seven (7)B shall apply to any evaporation pond liner left in a dry condition for a period of thirty (30) days of more. H. A gauge height indicator shall be installed in the evaporation ponds. The gauge must clearly indicate the depth of brine water waste. I. The evaporation pond(s) shall be kept free and clear of oil skims. * J. The dump and skim tank shall be engineer designed in accordance to the submitted application materials and Use by Special Review Permit Plan Map. B. During the construction phase, a full-time professional engineering/geologic consultant must be retained for continuous inspection of the tanks. The consultant shall certify by letters addressed to the State Health, County Health and Planning Departments that the design, materials, construction and operation of the tanks comply with the specifications as listed in the submitted application materials and on the Use by Special Review Permit Plan Map. C. Shelters shall cover all dump tanks. In the event water fowl gain access to the dump tanks one (1) inch square wire mesh shall cover the tanks. 9. All operating records shall be made available to the State Health and County Health Departments upon request. Operating records shall be maintained as described in the submitted application materials and available at the time of request. The facility shall be closed in accordance with the Solid Waste Disposal Sites and Facilities Act. 10. A responsible employee, trained to differentiate between brine water and other drilling fluids, shall be at the facility during receipt of all brine water. 11. A dust abatement program shall be implemented on the access road leading to the dump tank. 12. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 13. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Development Standards stated hereon and all applicable Weld County Regulations. 15. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16. The property owner and/or operator of this oFeration shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. The Operation Standards are to be amended to include Operation Standard No. 17 and Operation Standard No. 18 as follows: 17. Prior to starting the operation, the applicant shall plant and maintain the following landscaping and shelter belt: The northern boundary of the U.S.R. area shall contain two rows of Evergreen and/or Russian Olive trees; The east and west boundaries shall contain one row of Evergreen and/or Russian Olive trees; All trees shall be spaced at 10 feet apart and a minimum of 10 feet from the chain link fence. 18. In the event the U.S.R. area is still in operation at the end of a fifteen (15) year period from the date of final approval by the Board of County Commissioners the applicant shall submit a new U.S.R. and Certificate of Designation application. The U.S.R. and Certificate of Designation appli- cation shall be presented to the Weld County Planning Commission and the Weld County Board of Commissioners. The U.S.R. and Certificate of Desig- nation would require approval by the Board of County Commissioners in order to continue the operation for a period longer than fifteen (15) years from the date of approval by the Board of County Commissioners. • * Operation Standard No. 7-J is amended to read as follows: "An aeration system shall be installed and operated on the four evaporative ponds. In the event of an odor problem emanating from the ponds, an odor abatement program shall be instituted." Box 758 Greeley, Colorado 80632 RE: USR 540:83:3, Alvin Martensen, Gas and Oil Waste Disposal Facility Gentlemen: It has come to our attention through the news media that you have voted to reconsider the matter of the special use permit for a saltwater disposal facility near the Town of Milliken. The Platteville Board of Trustees by a unamious vote at their meeting last evening, request that you not grant approval of this facility until such time as definitive criteria have been established for the siting of such disposal facilities. We speak on this matter from practical experience. We had a "saltwater disposal" site on the outskirts of Platteville for several years on the Frank Stewart property. Granted, it was basically a "dump" but met the industry's "standard practices" and caused considerable contamination of the site. The site has since been annexed to the Town and we must now deal with the problem that originated in the County. Our point is that decisions made by the Commissioners in a vacumm of environmentally safe standards often lead to future problems for all of us. We urge you not to make that mistake. We request that you delay any action on the special use permit until the county municipaliites and the County Commissioners are able to jointly develop environmentally sound policies and direction for the siting of oilfield waste disposal facilities. Although this property is not in our immediate area, we feel that the siting of such a facility in close proximity to one of our sister Weld County municipalities may establish an undesirable precedent. The siting of this facilitiy adjacent to an established municipality, apparently without regard to that municipality's legitimate objections gives us cause for concern. Will you suddendly decide to allow one on our doorsteps as well? This matter was discussed in detail at last evening's Board meeting. By a unanimous vote, we are requesting the Weld County Commissioners to delay any action on the requested special use permit until definitive criteria for the siting of such facilities are developed by the State Oil and Gas Commission. We feel this is a matter of state wide concern and siting criteria should be determined on a statewide basis. As an alternative, we gladly offer our experience and services to assist the County in developing reasonable, environmentally safe siting criteria. Please advise us of your willingness to consider this attempt to balance the legitimate industry needs for disposal facilities and the public's need for responsible governmental protection of the individual's right to health and safety and from unwarrented intrusions by monied interests. Box 758 Greeley, Colorado 80632 RE: USR 540:83:3, Alvin Martensen, Gas and Oil Waste Disposal Facility Gentlemen: We have been advised through the Mayor's Coordinating Committee that you have recently voted to reconsider the special use permit for siting a oilfield waste disposal facility in close proximity to the Town of Milliken. As a municipality with 17 oil and gas wells within its corporate boundries, the procedures established by the County for the review of such facilities is of vital concern to us. Fortunately, AMOCO Production, the owner of our wells, disposes of their waste through injection. However; we are aware of the many problems that have arisen with the disposal sites in the Ft. Lupton and Rogen areas. We understand our sister commumity's concern that the facility will be sited adjecent to their borders apparently without regard to their objections. If it happens once, will it be allowed to happen again to Firestone? We discussed this matter at length at our regular meeting last evening. By unanimous vote, the Board requests that you not take any action on the Martensen USR request. We propose that the municipalities of Weld County and the County Commissioners develop siting criteria for oilfield waste disposal facilities that are uniform and environmentally sound. That the longterm impacts of the siting policies be examined and evaluated for socio—economic significance to the surrounding region. And that consideration of new facilities, including the Alvin Martensen facility, be withheld until these criteria have been developed and subjected to extensive public hearings throughout theCounty. To this end, we offer our assistance and experience. Please contact the Town Clerk to advise us of any further action you intend to take with regard to oilfield waste disposal sites. Box 758 Greeley, CO 80632 RE: USR 540:83:3, Alvin Martensen, Gas and Oil Waste Production Disposal Facility Gentlemen: The Mayors' Coordinating Committe has advised the Town of Gilcrest that you have, through resolution, decided to reconsider the matter of the special use permit for a saltwater disposal facility near the Town of Milliken. The Gilcrest Board of Trustees have discussed this matter at length at their meeting last Monday. By a unamious vote they request that you do not grant approval of this facility or any other facility of a similar nature until policies and criteria governing both technical aspects and socio—economic criteria have been developed. Gilcrest proposes that the municipalities of Weld County, representatives of the gas and oil industry and the County Commissioners jointly develop siting criteria for such disposal facilities. Such criteria should not consider only short—term impacts but also examine, equally, the long term impacts of these facilities. Gilcrest urges you not to be stampeded into a hasty decision. It has been our experience that gas and oil interests plead imminent need and other excuses to push government into what they deem an appropriate course of action. However, it has also been our • experience that everyone's interest is better served if the time is taken to examine all aspects of an issue and for government to act in a responsible manner i.e. to protect the right of its' citizen to a safe and clean environment; not to succumb to those who wield their money as though it gives them, by fiat, unlimited authority to do what they please, wherever they please. We await a response from you and offer you any assistance we may be able to provide. Box 758 Greeley, CO 80632 RE: USR 540:83:3, Alvin Martensen, Gas and Oil Waste Production Disposal Facility Gentlemen: The Mayors' Coordinating Committee has been notified by the Town of Milliken that you have decided to reconsider the matter of the special use permit for a gas and oil waste disposal site near the Town of Milliken and that you, as yet, have not responded to their proposal to establish policies and criteria on the siting of such facilities. This matter is serious concern to the MCC. All of our membership is impacted by gas and oil activities and the Committee, and it's individual communities, have been active in this particular area. It was in fact, at the urging of several of our municipalities, that the Gas and Oil Commission is in the process of promulgating regulations to cover the technical aspects of this very issue. We are and will continue to be monitering and providing suggestions on these regulations. Unfortunately, your decision to reconsider this matter occurred within such a short time frame, that the Committee has not been able to formally meet on this issue. However, I have been able to contact the majority of the eleven Weld County enities that are members of this Committee, as well as our Larimer County members. Those muncipalities contacted have been unamiously opposed to your reconsideration of this matter until resonable citing criteria have been promulgated. Of our members, only five were holding Town meetings this week. It is my understanding that they will sent you a letter stating their position on this matter. It is my understanding that it has been misrepresented to the Board of Commissioners that the City of Greeley was in favor of such a project, and the purpose of this letter is to advise you of our position with regard to the Waste Disposal Site. Please find attached my letter of March 14, 1983 to your Planning Department, requesting information with regard to the proposed disposal site. The City of Greeley Water Department did receive a copy of the proposed plans, and those plans were reviewed by my staff to determine if there was objection on account of a City of Greeley water line in the vicinity of the proposed disposal site. After a review of the plans, we determined that our water line was more than one mile from the proposed disposal site, and we did not comment further on the -matter . Recently I was visited by a representative of the Weld County Planning Department, who made an inquiry with regard to our position on the matter . It was explained that we had no objection to the proposal on account of the distance between the proposed site and our water line. My comments and absence of objection to the project are based solely on the geographical separation between the proposed site and the water line. Inasmuch as the proposed disposal site is located outside our planning jurisdiction, no other considerations were made officially by the City or personally by me. If, in fact, it has been represented to you that the City of Greeley or myself favors such a project, the representation is incorrect. We have taken no position other than not to object because we do not believe the site, if approved, would interfere with our water line. Box J r • February 24, 1983 • s 2 i ' : Dear Sir: At our last Town Board meeting on February 9, 1983, it was brought to our attention that Weld County would like to know how the Town of Milliken feels about permitting the Blehm Land and Cattle Company to place a production water disposal site north and east of Milliken. Theoretically there doesn't seem to be any problems and • actual construction of the facilities appears acceptable but because there are so ; , . many Possible problems that could occur, we are vehemently against the proposal. t.. This proposal raises the following concerns from the Town's perspective: 1. Though tests were undertaken for possible groundwater contamination and the tests were positive, tests were taken in December when the water table . is at its lowest. What happens if there is contamination? 2. How was the size and capacity of the facility determined? While the area :y, needs sites of this nature, are they planned to be distributed throughout the area .or with the construction of one, not coordinated with others, simply t '., create problems for one particular area of the County? Will all four sections of the land involved eventually turn into ponds? 3. What transportation routes will he used? Will there he extensive damage •"'i; ' • to Highways 60, 257, and 402? . ,. 4. How will the site be managed since no full time personnel is proposed? '-' How will it then be determined which six trucks will be permitted to dump? bat will be done to discourage illegal offsite dumping? Who will be physically responsible for cleanups of illegal dumping? We know this is very `?,'' likely to occur since Platteville estimates it receives 25 to 50 trucks per day, the majority of which illegally dump. l",.: 6. If this area is classified as a "Hazardous Waste Site" what • elwill that - ;. do to our potential growth as a town? Devaluation of -property will certainly ••_' occur. Will there he a threat to our wildlife in the area? #.;. 7. What will happen to the surrounding farmlands if the ponds overflow from heavy rains? One homeowner is within i. mile of the site. 8. . Only four people in the surrounding area were even notified about the site but a dozen came to us complaining when word spread about the proposal. 9.
