AND AUTHORIZATION FOR CHAIRMAN TO SIGN SAME WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has been pre- sented a road improvements and maintenance agreement between Weld County and Frontier Materials, Inc. , and WHEREAS, the terms and conditions of said agreement are as stated in the agreement, a copy being attached hereto and in- corporated herein by reference, and WHEREAS, the Board has studied said agreement and deems it advisable and in the best interests of the citizens of Weld County to approve said agreement. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the agreement for road improvements and maintenance between Weld County and Frontier Materials, Inc. be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is , authorized to sign said agreement. Brantner County1; ttorn �/L Norman Carlson ac uel e Joh s / DAY FILE: October 19 , 1983 PL0778 Pary llg 830366 OCT - s 1983 COUNTY OF WELD, STATE OF COLORADO ROAD IMPROVEMENTS AND MAINTENANCE AGREEMENT THIS AGREEMENT, made and entered into this 17th day of October , 1983, by and between the COUNTY OF WELD, STATE OF COLORADO, hereinafter called "County" and FRONTIER MATERIALS , INC., hereinafter called "Frontier" . WHEREAS, Frontier has applied to the County for a Use by Special Review Permit for an open-cut gravel pit and asphalt batch plant located in part of Sections 20 and 21, Township 2 North, Range 68 West of the 6th Principal Meridian, and WHEREAS, said gravel pit and asphalt batch plant will generate increased truck traffic, and WHEREAS, the County roads serving the property will not efficiently support the increased truck traffic, and WHEREAS, the County and Frontier have reviewed proposed improvements to the existing county roads and acknowledged they will enhance the accessibility and safety of the haul route to the above-mentioned gravel pit and asphalt batch plant, NOW, THEREFORE, in consideration of the mutual covenants and conditions hereinafter set forth, the County and Frontier mutually agree as follows : 1. The designated haul routes to be improved will be Weld County Road 5 from the entrance to the gravel pit and asphalt batch plant south to Weld County Road 18 ; Weld County Road 18 from Weld County Road 5 to Weld County Road 7; and Weld County Road 7 from Weld County Road 18 south to State Highway 52. 2 . The improvements will consist of a 3 inch thick, 24 feet wide hot bituminous asphalt mat and a total of 6 inches of aggregate base course on Weld County Road 7 from Highway 52 to Weld County Road 18 . Weld County Road 18 from Weld County Road 7 to Weld County Road 5 and Weld County Road 5 from Weld County Road 18 to the entrance to the gravel pit and asphalt plant will have a total of 6 inches of aggregate base 20 feet wide . The exact thickness of additional base course will be determined by sampling and testing of the existing materials. 3. Frontier will furnish the necessary base material, hot bituminous pavement, equipment and labor to construct the improvements . 4 . The County will reimburse Frontier for the cost of the AC-10 liquid asphalt required to manu- facture the hot bituminous pavement. -1- 5 . The County will inspect and replace any culverts and bridges that are in a deteriorated condition prior to paving. 6 . All construction and materials shall be in accor- dance with the State Department of Highways , Division of Highways, State of Colorado, Standard Specifications for Road and Bridge Construction, 1981. 7 . The County will provide testing and inspection for the construction. 8 . The unpaved portion of the designated haul routes , Weld County Roads 18 and 5 , will be maintained by Frontier during periods of hauling by Frontier. Maintenance will consist of regular grading to keep the surface reasonably smooth and the control of dust by the use of water, oils , or other com- mercially available chemicals. The County will be responsible for all other aspects of maintenance, such as culverts and signs. After a 2-year period, if the County or Frontier finds the maintenance of the unpaved roads is unacceptable, the County and Frontier may renegotiate the requirements on the unpaved roads. 9 . Frontier will not be restricted in hauling either direction on Weld County Road 7 from its intersec- tion with Weld County Road 18 . 10 . Access from the gravel pit and asphalt batch plant site to Weld County Road 20 to the north will be allowed on an occasional basis , but is not desig- nated as a haul route for periods of regular hauling.
