RESOLUTION RE : APPROVAL OF RECORDED EXEMPTION NO. 725 - CARL SEALEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners , pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 725 , does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , and WHEREAS , the request for Recorded Exemption No. 725 was submitted by Carl Sealey for property which is located in Part of the NE4 , SE4, Section 9 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS , this request it to divide the property into parcels of . 659 acres and . 285 acres, more or less, to allow the applicant to sell the larger parcel. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms , "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1 . The applicant shall submit a revised mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within ninety (90) days from the date of approval by the Board of County Commissioners. 2 . The revised mylar plat shall show a note stating: "Should current septic systems on Lot A or B fail to function in compliance with the Weld County Individual Sewage Disposal System regulations , the owner shall be required to provide an engineer-designed system or attach to municipal sewer. 841055 3 . The revised mylar plat shall show a reservation of an additional twenty (20) feet of right-of-way north of the centerline of East 18th Street for a total of fifty (50) feet from centerline. It appears that the proposal is consistent with the Weld County Comprehen- sive Plan. Perhaps more important, the proposal is consistent with the City of Greeley Comprehensive Plan that shows the area to be a residential- commercial area. The area currently has a mixed residential-commercial character. The parcel is probably not consistent with the current county zoning. How- ever, the parcel again appears to be consistent with the City of Greeley Comprehensive Plan. It also appears that the existing zoning is not con- sistent with the existing character of the area. The proposed usage is residential and commercial (warehouse) and is compat- ible with existing surrounding land uses. The intent of the Individual Sewage Disposal System Regulations Section 3.33, is to allow expansion or replacement area for a failed septic system. Due to the small size of lot A, and the placement of the house there would not be sufficient area for expansion or replacement of the septic system in the event of failure without a variance. This problem could be further exaggerated by Commercial or Industrial Zoning of the property potentially requiring a much larger system. Carl F. Sealey, 1107 East 13th Street , Greeley. The Planning Commission recommended no objections to the recorded exemption with the stipulation that 50 feet of right-of-way north of the centerline of East 19th Street be reserved for the future expansion of East 18th Street by the State Highway Department . This property is located within an area as outlined by the East Greeley Comprehensive Plan intended to be utilized in a mixed use residential/commercial format . The Planning Commission did not anticipate that the separation of the residence from the trailer and warehousing facility would be in violation of any of the provisions established for the development of this property under the East Greeley Comprehensive Plan. We would like to point out that projected traffic on S.H. 34 in this area indicates the need for a 100-foot right of way, 50 feet each side of the highway centerline. Additional right of way to meet this need should be provided by reservation, or preferably dedication, as permitted by local regulations.
