RE: APPROVAL OF RECORDED EXEMPTION NO. 445 - DORSEY AND NELLIE
GLENN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 9th day of April, 1980 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of land, as shown on the plat known as Recorded
Exemption No. 445, being the property of Dorsey and Nellie Glenn,
described as the South Half of the Northwest Quarter of Section
10, Township 1 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows does not
come within the purview of the definition of the terms "subdivi-
sion" and "subdivided land, " pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973 , as amended:
The South one-half of the Northwest one-
quarter of Section 10 , Township 1 North,
Range 66 West of the 6th P.M. , Weld County,
Colorado, more particularly described as:
Beginning at the Southwest corner of said
South one-half;
Thence North O0°00 ' 00" East, on an assumed
bearing along the west line of said South
one-half a distance of 1342 . 95 feet to the
Northwest corner of said South one-half;
Thence North 89°37 ' 3O" East along the North
line of said South one-half a distance of
2663 .59 feet to the Northeast corner of
said South one-half;.
Thence South 00°08 ' 00' West along the East
line of said South one-half a distance of
1348 . 78 feet to the Southeast corner of
said South one-half;
Thence South 89°45 ' 00" West along the South
line of said South one-half a distance of
2660. 42 feet to the point of beginning.
Contains 82 . 245 acres more or less.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the

Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-lA(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Dorsey and Nellie Glenn be, and hereby is,
exempt from the definition of the terms "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 9th day of
April, A.D. , 1980.

Re: Recorded Exemption #445
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Dorsey and Nellie Glenn for a recorded exemption. The
parcel of land on which this request has been made is described as Sz
NWo, Section 10, T1N, R66W of the 6th P.M. , Weld County, Colorado. This
property is located 3/4 mile South of Fort Lupton on Weld County Road
31 . The property contains approximately 82.245 acres of Class II , III ,
and IV irrigated soils. The request is to split the property into par-
cels of 5.436 acres and 76.809 acres.
Mr. and Mrs. Glenn wish to sell the cultivated land and retain their
residence and 5 acres for retirement purposes.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :
1 . The proposed request conforms with the intent clause of
the recorded exemption procedure, the intent clause of
of the Agricultural Zone District and the Weld County
Comprehensive Plan in that the uses will be compatible
with surrounding agricultural uses. The request will
allow agricultural and related uses to be the predominant
land uses. There will be no reduction in the amount of
land currently used for agricultural production.
2. The Town of Fort Lupton has no objections to this request.

3. The request complies with the provisions of 9-4-A of the Weld
County Subdivision Regulations.
The applicant presently has a temporary mobile home permit as accessory
to farm use. The Department of Planning Services recommendation for
approval is conditional upon the applicant either removing the mobile
home from the property or making applic tion for a permit for a mobile
home as a principle residence on Lot 1 '.1i

Gentlemen:
Mrs. Glenn and I have reached the age of retirement and find that
we are no longer able to continue farming.
In 1973 we built a new home on a 5 acre parcel that we are re-
questing a recorded redemption on. At the time we felt it would
be practical to live here after retirement and lease the farm
ground. At this time it becomes necessary that we sell the farm
land. We would rather not move to town but continue living on
this 5 acres because it is close to town and yet we have ample
space for a few livestock and garden for food.
