PI.....rr n.tm, " • .•. abmailir 6 orr-�Z+'/''*7 yam!• �l�l./• RESOLUTION RE: APPROVAL OF AMENDMENT TO AN APPROVED UNIT DEVELOPMENT PLAN FOR LAND LOCATED IN PART OF THE NWQ Silk, SECTION 36, TOWN- SHIP 6 NORTH, RANGE 66 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO - NIGHTENGALE, SWANSON, AND PLATTE VALLEY INVEST- MENT COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 16th day of May, 1984 , at the hour of 2 : 00 p.m. for the purpose of hearing the application of Nightengale, Swanson, and Platte Valley Investment Company, c/o Stan Nightengale, 35279 Weld County Road 41, Eaton, Colorado 80615, for approval of an amendment to an approved Unit Develop- ment Plan on the following described real estate, to-wit: Part of the NWa SW4, Section 36 , Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission, and having been fully informed, finds that this request will be approved for the following reasons : 1. The applicant has complied with the application require- ments listed in Section 21. 7 et seq. , of the Weld County Zoning Ordinance. 2. The request is in conformance with Section 21. 6 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Weld County Comprehensive Plan, and that the proposed amended Unit Development Plan will be compatible with existing surrounding land uses and with the future development of the area. The Weld County Compre- hensive Plan directs commercial development in unincorporated areas to be located near or adjacent to existing communities because of the availability of urban services (i.e. , water and sewer) . b. The Greeley Planning Commission is recommending no objections to this request subject to the conditions outlined in a letter dated March 14 , 1984 . The subject site does contain a gravel resource, It is not considered to be a commerical mineral deposit due to the small size of this tract, and the uneconomic feasibility of extracting the underlying sand and gravel. d. The subject site is served by the City of Greeley sewer system. e. The subject site is served by a well water system. ₹. F Street will provide adequate access to the site. g. The attached Operation Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Nightengale, Swanson, and Platte Valley Investment Company for approval of an amendment to an approved Unit Development Plan on the above referenced parcel of land be, and hereby is, granted subject to the following conditions: 1) an Amended Unit Develop- ment Plat shall be submitted to the Department of Planning Services with the approved Development Standards; 2) no additional building or electrical permits shall be issued for the subject site until the Amended Unit Development Plat has been delivered to the Depart- ment of Planning Services Offices; and 3) an Amended Unit Develop- ment Plat shall be submitted to the Department of Planning Services showing the elimination of any fencing and outdoor storage in the landscaped area which is reserved for the future right-of-way. A twenty foot (20') landscape strip shall be maintained along the north side of "-F" Street right—of-way, -within the -area shown as "Reserved for Future Right-of-Way". Any hedge row or plantings shall be confined to the north thirteen feet (13') of the twenty foot (20') landscape strip and all landscaping shall be the responsibility of the owner(s) of said property until such time as the right-of-way is acquired for public purposes. -All landscaping requirements shall te completed within ninety (90) -days after final approval of the Amended Unit levelopment Plan by the Board of County Commissioners. B. A forty foot (40') -easement for a drainage ditch granted to the City of Greeley adjoins 35th Avenue on the west and an additional ten feet (10') of open space exists between the easement and the existing :building. This fifty foot (50') strip provides the setback and open space for separation from 35th Avenue. 5. Setbacks for structures shall be as follows: A. A minimum -of twenty-five feet (25') from the future north right-of-way line of "F" Street. B. Fifty (50) feet :from rom the west property dine. C. Zero (0) feet from the north property line adjacent to the Colorado and Southern Railroad right-of—way. 6. Adequate fire protection devices shall be installed by the owner of subject property An compliance with the requests of the Western Hills Fire Proterrion District. 7. Lighting provided fos security and night operation on the site shall he designed so that such lighting will not adversely affect surrounding property owners. 8. Access to the site shall be limited to one entrance from "F" Street, located two hundred thirteen (213) feet east of the centerline of the intersection of 35th Avenue and "F" Street, and as shown on RE 6d1. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 9. _Use o₹ property shall comply with aid county and state health standards and regulations pertaining to air -quality, water quality, noise emission, and sanitary -disposal systems. 10. Secretary 1 BACKGROUND INFORMATION Z-322:79:6 The original intent of this Commercial Unit Development was to allow zero lot line development in return for open space and landscaping requirements. The city of Greeley, in conducting an Administrative Review for Z-322 on May 2, 1979, supported this basic Planned Unit Development concept. The Department of Planning Services incorporated this recommendation as Development Standards #3 and #4. The Greeley Planning Commission, in its recent review (March 14, 1984), of an amendment to the Unit Development Plan offered four (4) suggestions (please see enclosed letter in your information packet). The staff reviewed the suggestions and felt that items #2 and #4 would be hard to enforce under the current structure -of the Weld County Zoning Ordinance. Also, in reference to item ill, the staff would prefer to remain with a twenty (20) foot reservation rather than requiring a twenty (20) foot dedication. Development Standard #8 limits access to the site to one (1) entrance. A field inspection of the site by the staff revealed that the entire southern boundary of the property was being used for ingress and egress purposes. The applicant should diligently pursue creation of the landscaping requirements identified in Development Standard #4 to limit access to the property to one (1) entrance as shown on the Unit Development plat.
