WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 4th day of November, 1981, at the hour of 2 : 00 o' clock p. m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Continental Pipeline Co. , c/o Mr. Thomas C. Knudson, 1750 Westland Road, Cheyenne, WY 82001 for a Use by Special Review for an amendment to CUP 66: 80: 14, on the following described real estate, to-wit: Northwest quarter of Section 20, Township 2 North, Range 66 West of the 6th Principal Meridan, Weld County, Colorado. WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. Unchanged SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING October 6, 1981 A regular meeting of the Weld County Planning Commission was held on October 6, 1981, at 1:30 p.m. in the Commissioners' Hearing Room, 915 10th Street, Centennial Building, Greeley, Colorado. The meeting was called to order by the vice-chairman, Jerry Kiefer. CASE NUMBER - 472:81: 19 - Continued from September 15, 1981. APPLICANT - Erie Water and Sanitation District SUBJECT — Wastewater Treatment Plant LEGAL DESCRIPTION - Part of the NWk, Section 6, T1N, R68W of the 6th P.M. , Weld County, Colorado LOCATION - 11/2 miles north of Erie APPEARANCE: Richard Lyons, Attorney for the District reiterated the presenta- tion made at the last regular Planning Commission Meeting held on September 15, 1981. Tom Honn read the engineer' s report submitted by Drew Scheltinga, Engineering Manager for Weld County. Attached as a permanent part of the summary of the meeting. Steve Sears, Chairman of the Weld County Health Board reported there is still no word from Sam Cooper of the State Health Department. However, the Health Board was concerned there may be groundwater contamination. The present lagoon system is not in conformance with the state standards. The Chairman called for discussion from the audience. , Summary of the Weld County Planning Commission Meeting October 6, 1981 Page 2 Benny Bruntz, Westview Estates resident told the Committee the residents of this subdivision were contesting the application at the level of county government because they did not know what input, if any, they would have at the state level. The residents of the area feel their homes would decrease in value with a sewer so close to the subdivision. Also, the median income of the residents of the town of Erie is approximately $12,000.00 per year, and it is his feeling it is unreasonable to expect families with income levels this low to be assessed for a new sewer. Sam Little, Westview Estates — It was his feeling the growth of the Erie District in the last ten years has been negligible. It was also his feeling the sewer could be moved about one—half mile north of the proposed site as easily as it could be installed were planned and would be offensive to no one. He also asked if written documentation of tests were done to proved this is the best area for the sewer. Patty Bruntz, Westview Estates asked the members of the Planning Commission to consider this application carefully. The applicants have a right to present the plans for a new sewer; and they have the right to oppose it. This is an important issue to the people who live in the Westview Estates Subdivision. She stated whe was appealing to the Planning Commission as a human being to a human being. Tape 72 — Side 1 Lee Morrison, Assistant County Attorney told the Planning Commission we are still functioning under the old zoning resolution, which has a provision in it which talks about alternatives. Jerry Keifer stated testimoney was given to this Board by the engineers, we accept that testimony, we weight that testimony, this is our job. We then evaluate that testimoney and make a decision. Zelma Dugger, Westview Estates related the problems they had with the town of Erie when she was working on the Parkland Estates Planning Committee regarding use of the town' s water supply. Erie does not serve the Westview Subdivision in any way. They are under the jurisdiction of Weld County. If the sewer is approved for this site, the subdivision would probably not be able to hook—on of it, therefore, if there were problems with odor or maintenance it would complicate enforcement and correction of these problems due to dual governmental agencies. Mr. Bell, Engineer for the project reported the town of Erie upped their sewer rates a few years ago from five dollars per quarter to five dollars per month in anticipation of either upgrading or installing a new sewer system. No further rate increases are anticipated for financing the new sewer. Summary of the Weld County Planning Commission Meeting October 6, 1981 Page 3 MOTION Don Billings stated he would like to make a motion; however, he would like to make a comment first. He felt much of the testimony on this application, due to the intense intrest from both sides, tends to get a little beyond what the Planning Commission would normally consider in making a decision, so basing his motion on three items listed in the Special Use Permit Standards he moved this request be denied for the following reasons: 1. It is not compatible with the surrounding area; 2. Its effect on the immediate area is not good; and 3. Its effect on the future development of this area would be poor. Motion seconded by Bob Ehrlich. The Chairman asked for discussion from the Planning Commission members. There was none. The Chairman asked the secretary to poll the members for their decisions. Wilbur Wafel — yes; Bette Kountz — yes; Don Billings — yes; Bob Ehrlich — yes; Bill Diehl — abstain; Jack Holman — abstain; Jerry Kiefer — No. Motion carried with four voting for, one against and two abstaining. (Comments by Planning Commission members concerning their decision are recorded on Tape 72 — Side 1. ) Richard Lyons, attorney for the project, reported the site application received a no comment pending a decision by the Planning Commission. Now that the vote is negative will a letter be written and attached to the site application informing the state of the decision of the Planning Commission? Lee Morrison answered yes, there would be a letter written. He also pointed out the Erie Water and Sanitation District is a separate governmental agency. It is not dependent on Weld County for any funds and, therefore, it is impowered to override any decision by this Board. Jerry Kiefer reported the Board was aware of this, but each application is taken on its own merits and weighed individually by the Board. They (the Planning Commission) does not see this as a waste of their time, although it may be seen by many to be so. CASE NUMBER - USR-478:81:24 APPLICANT - Richard Chana SUBJECT - Greyhound Kennel LEGAL DESCRIPTION — Part of the NE4, Section 35, T1N, R68W of the 6th P.M. Weld County, Colorado. LOCATION - One mile east of 1-25 and 3/4 mile north of Weld County Road 2 APPEARANCE: Richard Chana appeared in his own behalf. He gave background information on the company to the Planning Commission. He stated he had met with all of the neighbors, they had signed a petition; and there is no opposition to this request. He outlined their plans for this permit and the number of employees - they anticipated. Jerry Keifer, Chairman, asked if he was aware of the recommendation and development standards proposed by the Department of Planning Service' s staff. He stated he had been given a copy just before the meeting, but had not had time to review them. Tom Honn read these documents. Tape 72 — Side 2 The Chairman asked Mr. Chana if he felt they would have any problems living within these perimeters. He stated he would not. CASE NUMBER — USR-477:81:24 APPLICANT - Continental Pipeline Company SUBJECT - Amend CUP-66:80:23 - Truck Unloading Terminal Addition LEGAL DESCRIPTION — The NIA, Section 20, T2N, R66W of the 6th P.M. , Weld County, Colorado. LOCATION - 2 miles north of Fort Lupton on Weld County Road 181/2. APPEARANCE: Lori Tipton represented Continental Pipeline Company. She reviewed the improvements planned for this area. A fourth company will be hauling into this area. Additional impacts on the area will be minimal with an increase of only about four trucks per day. The Chairman called for discussion from the audience. Danny Mentel who resides on Weld County Road 181/2 stated if the trucks are coming from the south, which is highway 85, they have a side lane to pull off from, if you are coming up Weld Coutny Road 181/2, facing west, pulling off of Highway 85, you cannot see around the trucks to pull onto the highway. You have to pull off onto the highway before you can see the traffic coming from the south. This is a dangerous situation. If the corner cannot be purchased by Continental Pipeline from the estate, Summary of the Weld County Planning Commission Meeting October 6, 1981 Page 5 is there a safer alternative? Discussion between the Planning Commission Members and the Planning Service's staff ensued. MOTION Don Billings moved the Planning Commission recommend to the Board of County Commissioners that USR-478:81:23 be approved and that the Planning Commis— sion request the Board have our county legal staff write a letter to Continental Pipeline outlining what aid might be possible on the radius problem from a condemnation standpoint and perhaps suggesting a trade to justify this sixty foot right—of—way on Weld County Road 18z being paved to the site, and to ask the county engineer to make recommendations about the conditions of Weld County Road 181/2, among them the possibility of paving. Motion seconded by Bill Diehl. The chairman asked for discussion for the Planning Commission members. There was none. The Chairman asked the secretary to poll the members of the Planning Commis— sion for their decisions. CASE NUMBER — SUP-470:81: 16 APPLICANT — Power Resources Corporation SUBJECT — Uranium (In—Situ) Mine LEGAL DESCRIPTION — Part of Sections 25, 27, 34,35 and 36, T9N, R6OW and part of Section 30, T9N, R59W of the 6th P.M. , Weld County, Colorado LOCATION — Adjacent to the town of Keota. Tom Honn, Zoning Administrator, stated this application was setup by the Department of Planning Service's staff to be heard in two parts. They felt at this meeting the applicants could present their studies; there could then be questions from the Planning Commission members and the audience. All referrals have not been received. The staff has addressed some of the concerns regarding this project in the recommendations of the Department of Planning Service' s staff. Another hearing is setup at the regular meeting of the Planning Commission on November 3, 1981. APPEARANCE: Milton Childers, Energy Mineral Corporation, outlined the background of this company. Eric Tiepel of Power Resources Corporation, explained the plans for the area, and the various licenses and permits which would need to be applied for in the future, and permits which have been applied for and approved or awaiting approval. He also described the process which would be used Summary of the Weld County Planning Commission Meeting October 6, 1981 Page 6 to remove the uranium using oxygen, water and carbon dioxide. The slurry will not be dried at this site, so there will be very little chance for contamination. He also discussed this project' s impact on the environment, and the community, surface impact and water quality control. He explained their plans for construction, amount of employees anticipated and the approximate amount of revenue which would benefit the area and the county. Tape 73 — Side 1 Ken Kuckar, Energy Mineral Corporation, showed slides on the geological and hydrological findings of this area. The Chairman asked for discussion and comments. Bill Diehl, Planning Commission member inquired about the amount of water that would be used and the quality of the water that would be restored to the wells. Tape 73 — Side 2 Ned Snader, area resident who owns property adjacent to the project outlined his concerns. He stated there are wells in the area that are drawing water from the White River Sands and stated that these wells are dropping. Norman Brown, Weld Ag Council, discussed the Grover Project, investigation of the plugged holes left from this project and the importance of the wells to this area. It was the feeling of the Ag Council, if this project is approved, adequate bonding of the company should be required to compensate the farmers and ranchers adequately if there is a loss of water due to the project. Reference was also made to the Powder River Basin project and the problems that have been encountered by the residents there. Albion Carlson, attorney, representing his son John Carlson, discussed a State Statute regarding use of nontribuatory water, which is how the underground water in this area is classified. Tom Honn stated every effort will be made to address these concerns at the next hearing of the application. Ken Weaver, State Health Department, reported they have several people working on this application and he is not sure they will be able to have a complete report available by November 3, 1981. Tom Honn stated the Department of Planning Services will not holdup their recommendation because of the State Health Department' s permits. It was felt at the next hearing of this application it would be important to have people from the Water Quality Control Department at the meeting. Condition #3 regarding the County Attorney' s office assisting Continental Pipeline in acquiring the needed right-of-way for the turn lane by condemnation was brought to the Board' s attention by Mr. Honn. Brad Haywood, representative for the applicant, explained their request and discussed the easement problem. • Tim Kassen, right=of-way agent for Continental, elaborated on the problems they are having acquiring the needed right- of-way. Mr. Kassen said that he hated to use condemnation as a threat and would like to continue . negoiating until their six month extension is up. If Continental has not -been successful in acquiring the right-of-way, at that time they would ask for the County' s assistance. Commissioner Carlson made a motion to approve the amendment to SUP 66: 80: 14 with the development standards as amended. Commissioner Martin seconded the motion. Commissioner Steinmark asked the motioner whether or not his motion included any of the conditions? Commissioner Carlson stated he said with the conditions as amended. Commissioner Steinmark stated that the development standards are not the same as the conditions. Commissioner Carlson stated that the development standards are fine. Commissioner Steinmark asked Commissioner Carlson if he didn' t want to include any of the condit- ions. Commissioner Carlson stated he didn't follow Commissioner Steinmark. Commissioner Steinmark proceeded to explain to Commis- sioner Carlson where the conditions were in the packets, citing the u one requesting a recommendation from the County Engineer, and asked if he wanted to continue those or eliminate some and keep others. Six-month extensions of the permit were granted by the Board on July 15, 1981 and January 15, 1982, due to legal difficulties encountered in our attempts to acquire right-of-way on the affected property. As the attached instruments indicate, these problems have been resolved, and we have obtained the right-of-way for this property. We have applied for an access permit to enable us to begin construction, and we are currently concluding design coordination with the State of Colorado Division of Highways. Construction should be completed within 60 days at which time the road improvements will be dedicated to the Division of Highways. The facility will continue to be automated. Continental Pipe Line Company employees stationed at the Ft Lupton Pump Station, will maintain and supervise the operations at the unloading facility. There are not now, nor will there be, any personnel physically assigned to the Spindle B Station, thereby eliminating the need for a water supply or a sewage disposal system. Under current operations, the facility provides for four crude oil transports to unload their contents simultaneously, while providing parking for up to five additional transports on the facility grounds. Individual transport operators make the necessary connections to the facility to unload and pump their contents directly into designated breakout tankage. At a predetermined level , a pump will automatically begin transferring volumes from that tank, through an Automatic Custody Transfer (ACT) unit for measurement, and subsequent delivery via under- ground pipeline, to Continental Pipe Line Company's mainline injection station at Ft Lupton. The facility has one (1 ) 1 ,000 barrel tank, two (2) 400 barrel tanks, and one (1 ) 500 barrel tank enclosed by an earthen dike, two ACT units, a 6-foot high chain link fence around the tank and ACT area, and four truck unloading pumps. The paved aprons where the trucks unload are equipped with catch basins which gather and contain any oil which is lost during unloading operations, thus eliminating the hazard of ground water pollution. The proposed modifications will be designed and constructed so that an additional crude oil transport can unload at the facility. An additional curbed and paved apron will be installed equipped with a catch basin to gather and contain any oil which is lost during the unloading operation. A pump will be installed adjacent to the apron, approximately 120 feet north of the existing tankage. The earthen dike surrounding the existing tankage will be enlarged to facilitate the addition of one (1) 500 barrel tank. One additional ACT unit will be installed immediately adjacent to the three existing ACT units. The operation and maintenance of this expanded facility will be identical to the existing facility. The facility will pro- vide parking for five additional transports on the property while they wait use of the facility. The 6-foot high chain link fence around the tank and ACT area will be maintained. Traffic volume at the Spindle B Station will average approximately thirty trucks per day. In view of the local residents ' concerns which recently surfaced relating to truck turning radius, truck speed, and routing, plans have been initiated to install a three (3) centered curve, in accordance with State Highway Department recommendations, on the south corner of County Road 182 and U.S. Highway 85. The facility will be maintained in a neat and professional manner. Noxious weeds or any unsightly debris will be disposed of promptly and in accordance with any applicable regulations. The construction of the access approach and its appurtenances as required by the terms and conditions of the permit shall be completed at the expense of the applicant except as provided below. 6. It is the responsibility of the owner of the property to ensure the use of the access approach to the property is not in violation of the code,permit terms and conditions,or the Act.The terms and conditions of the permit are binding upon all assigns,successors- in-interests and heirs. 7. When a permitted driveway is constructed or used in violation of the code, permit terms and conditions,or the Act,either the issuing authority or the Department or both may obtain a court order enjoining violation of the access code,permit terms and conditions,or the Act.Such access permits may be revoked by the issuing authority if,at any time,the permitted driveway and its use fail to meet the requirements of the Act, the access code, or the terms and conditions of the permit. 8. Reconstruction, relocation, or conformance with this code of any driveway, whether constructed before,on or after June 30, 1979, may be required by the Department with written concurrence of the appropriate local authority either at the property owner's expense if the reconstruction or relocation is necessitated by a change in the use of the property or a change in the type of driveway operation or at the expense of the Department if the reconstruction or relocation is necessitated by changes in road or traffic conditions.The necessity for the relocation or reconstruction shall be determined by reference to the standards set forth in the code. 9. The property owner or representative serviced by a lawful access approach may make a physical improvements to the access approach with the permission of the issuing authority.The applicant shall make his request on standard permit application forms and specify that his request is for improvements per this subsection. Denial of the application for improvements does not constitute revoking the existing access approach authorization. 10. A request for variance from the standards of the access code shall be submitted to the issuing authority with a permit application and shall be considered an attachment to the permit application form.The request for the variance shall include specific and documented reasons for the request. 11. In the consideration of the variance request, the issuing authority shall determine to the best of its ability if the following circumstances are met: (1) there is exceptional and undue hardship on the applicant,(2) a variance would not be detrimental to the public health,welfare and safety,and (3) a variance is reasonably necessary for the convenience and welfare of the public. 12. At any time during the review by the issuing authority of the permit application the applicant may supplement his application with a variance request. 13. After sight distance requirements are met and an access permit issued,a sign structure or parked vehicle shall not be permitted where it will obstruct the required sight distance. 14. In the event it becomes necessary to remove any right-of-way fence,the posts on either side of the entrance shall be securely braced with an approved end post before the fence is cut to prevent any slacking of the remaining fence. All posts and wire removed shall be turned over to the engineering district representative of the Department. 15. Where necessary to remove or relocate a state highway traffic control device for the construction of a permitted access approach, such relocation or removal shall be accomplished by the applicant at his expense and at the direction of the Department.Any damage to the state highway beyond that which is allowed in the permit shall be repaired immediately. 16. A copy of the permit shall be available for review at the construction site. If necessary, minor changes and additions shall be ordered by the Department field inspector to meet unanticipated site conditions. 17. The permit may require the contractor to notify the individual or office specified on the permit at certain phases in construction to allow the field inspector to inspect various aspects of construction such as concrete forms,subbase,and base course compaction. 18.
