RE: APPROVAL OF RECORDED EXEMPTION NO. 494 - JOHNSTOWN FARMS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 6th day of May, 1981 , that the division into two parcels of
land, as shown on the plat known as Recorded Exemption No. 494 ,
being the property of Johnstown Farms, described as part of Sec-
tion 6 , Township 4 North, Range 67 West of the 6th P.M. , Weld
County, Colorado, being more particularly described as follows,
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land, " pursuant to the Board' s
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended:
The Northeast Quarter of Section 6 , Township
4 North, Range 67 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, the Board of County Commissioners of Weld County ,
Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definitions of "subdivision" and "subdivided land" pur-
suant to the Board' s authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended, and Section 2-1A(3) of the Weld County Sub-
division Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Johnstown Farms, be, and hereby is, exempt
from the definition of the terms "subdivision" and "subdivided
land" , pursuant to the Board' s authority under Section 30-28-101
(10) (d) , CRS 1973 , as amended.

and seconded, adopted by the following vote on the 6th day of
May, A.D. , 1981.

Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Johnstown Farms for a recorded exemption. The parcel of land
on which this request has been made is described as the NE1, Section 6,
T4N, R67W of the 6th P.M. , Weld County, Colorado. This property is
located mile northwest of Johnstown. The property contains approximately
155 acres of Class I, II, III and IV irrigated soils. The request is to
split the property into parcels of 5 acres and 150 acres. Johnstown Farms
desires to sell the improvements area as it is no longer needed for housing.
The balance of the farm will remain in production.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services Staff recommends the request be approved
for the following reasons.
1. The request conforms to the intent clause of the Recorded
Exemption Procedure (Section 9-2 of the Weld County Subdivi
sion Regulations) , the intent clause of the Agricultural Zone
District (Section 3.3.A. of the Weld County Zoning Resolu-
tion) , and the Weld County Comprehensive Plan in that the uses
will be compatible with the surrounding agricultural uses.
The request will allow agricultural and related uses to be
the predominant land uses. There will be no reduction in
the amount of land currently being used for agricultural
production.
2. The town of Johnstown has reviewed this request and has no
no objections to it.
3. This request complies with the provision of Section 9-4 A. of
the Weld County Subdivision Regulations.

Honorable Commissioners:
We desire to secure a Recorded Exemption which would permit the sub-
division of the Norhteast Quarter of Section 6, Township 4 North,
Range 67 West of the sixth principal meridian, Weld County, Colorado.
Johnstown Farms is the sole owner in fee of the above described prop-
erty. We propose to sell the home and other buildings now located on
the property because they are no longer needed in conjunction with the
farming of the land. It is our desire to sell the improvements so
that they can be properly maintained and continue to be an asset to
the neighborhood and to Weld County. The area proposed to be subdi-
vided will contain 4.889± acres, the balance of the farm will be used
for crop production, as it has in the past.
The improvements are presently served with water by the Little Thomp-
son Valley Water District, sewage disposal is handled very well through
a septic tank and leach field. Should the need arise to construct an-
other dwelling unit on the balance of the Quarter Section, we would
utilize the same source of water and method of sewage disposal . However,
an additional dwelling unit is not planned because we intend to farm
the property for maximum crop production.
Your favorable consideration of our request for a Recorded Exemption
will be greatly appreciated. If you have any need for additional
information, please contact Thom Rounds at 353-4736. Mr. Rounds is
acting in our behalf in this matter and will make any presentations
required.
