HomeMy WebLinkAbout830776.tiff RESOLUTION RE: APPROVAL OF TERMINATION OF MEMORANDUM OF UNDERSTANDING BETWEEN NORTH COLORADO MEDICAL CENTER AND WELD COUNTY AND AUTHORIZATION FOR CHAIRMAN TO SIGN WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , on the 25th day of April, 1983 , the Board of County Commissioners of Weld County, Colorado approved a Memo- randum of Understanding between North Colorado Medical Center and Weld County regarding alcoholism treatment programs , and WHEREAS , the Board of County Commissioners will be termi- nating their provision of alcoholism treatment services through the reorganization of the Alcohol Recovery and Rehabilitation Center which will be developing its own legal and organizational structure effective January 1, 1984, and WHEREAS , the Board of County Commissioners has been pre- sented with a Resolution from North Colorado Medical Center con- cerning the termination of the Memorandum of Understanding be- tween North Colorado Medical Center and Weld County, which shall be effective January 1, 1984 , and WHEREAS , after study and review, the Board deems it advis- able to approve said termination. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the termination of the Memorandum of Understanding between North Colorado Medical Cen- ter and Weld County, effective January 1, 1984 , be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said Resolution from North Colorado Medical Center concerning the termination of the Memo- randum of Understanding between North Colorado Medical Center and Weld County. 830776 ✓ .('( ic f�;J;a f-/Boc ) 7 � ! NOW THEREFORE BE IT RESOLVED, that the Board of Trustees of the North Colorado Medical Center and the Board of Weld County Commissioners , hereby dissolve the afore mentioned Memorandum of Understanding effective January 1 , 1984. I would appreciate it if you would convey this Res- olution to the Board of County Commissioners for their concurrence and adoption. Kohan Harold S.Winograd MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding is entered into by the Weld County Board of County Commissioners, hereafter designated as "County" and the North Colorado Medical Center^Board of Trustees, hereafter designated as "Hospital", as an agreement for the operation of both parties' respective alcoholism treatment programs. WHEREAS, the County and Hospital both have a responsibility for providing effective medical services within their respective service areas; and WHEREAS, the County and Hospital have determined through past experience that cooperation between themselves increases the quality of service to the service population and economies in -the cost of the provision of those services; and WHEREAS, the County and Hospital both will be providing alcoholism treatment programs to much the same service population. NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: 1. The County and Hospital will keep each other continuously advised concerning programmatic matter of the alcoholism treatment programs. 2. The County and Hospital will inform each other in advance and consider each other's assessments of proposed major changes to the programs which may affect either program. 3. The Hospital shall not apply for or pursue funding from the State General Fund for their chemical dependency program without prior written approval from the Board of County Commissioners. 4. The Hospital will continue the arrangement of not charging Weld County for County referred medical detox patients for use of emergency room services so long as State of other alternative funding sources continue to be available. If any provision of this Memorandum shall be held invalid by operation of law or by any court of competent jurisdiction, or if compliance with or enforcement of any provision shall be restrained by any tribunal, the remainder of this Memorandum shall not be affected thereby, and the parties r, shall enter into negotiation for the sole purpose of arriving at a mutually satisfactory replacement for such provision. This Memorandum of Understanding shall become effective upon the approval of the Board of Trustees of North Colorado Medical Center and the Weld County Board of Commissioners and shall remain in force and effective until further action by both governing Boards on the matter.
