HomeMy WebLinkAbout810687.tiff RESOLUTION RE : APPROVAL OF PRELIMINARY PLAT FOR PURITAN PLACE COMMERCIAL SUBDIVISION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 30th day of December, 1981, the Preliminary Plan for Puritan Place Commercial Subdivision was submitted to the Board of County Commissioners of Weld County, Colorado for approval in accordance with the Subdivision Regulations of Weld County, Colorado, and WHEREAS, the Board of County Commissioners heard all of the testimony and the statements of those present at the hearing on the Preliminary Plan for the following described estate, to-wit: N'NE4, Section 3 , Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS , the petitioner was present, and WHEREAS, the Board of County Commissioners has studied the request as submitted and having been fully informed, is satisfied that the submitted Preliminary Plan conforms in all respects with the requirements of Section 5-4 of the Weld County Subdivision Regulations, and that approval of said Preliminary Plan would be in the best interests of Weld County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado that the Preliminary Plan of Puritan Place Commercial Subdivision located in part of the North half of the Northeast quarter of Section 3, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado be, and hereby is, approved subject to the following conditions of the Weld County Planning Commission recommendation: 1. Plan for Puritan Place Commercial Sub- subject division S-210:81:5 Our only comment concerns sewerage. The percolation tests done only were for a small area in one of the four lots. In addition, the percolation tests were inconsistent, due apparently to variable clay concentrations in the soil. Because of the nature of the proposed uses in the subdivision (motel, restaurant) and due to minimal soil conditions, we recommend that all on-side septic systems be engineered-designed. We feel that Mr. Straughan's assumptions and conclu- sions regarding the lack of subsidence hazard at the site are reasonable. The Empire Labs report on percolation tests at the site indicates that engineered septic systems may be required due to slow percolation rates. We recommend a note stating that septic systems be designed and sited by a qualified engineer be added to the final plat. The soils in this area may have a high shrink-swell potential . We recommend that prior to construction a soils and foundation investigation be completed for each building site. These investigations should recommend specific found- ation design criteria, fill and backfill , and drainage criteria for each building design. This should be noted on the final plat. Side of 52 Weld County 915 Tenth Street DOH FILE 45100 Greeley, Colorado 80631 Dear Mr. Allison: We have reviewed the Preliminary Plat of Puritan Place Commercial Subdivision, and we have no objection to the two access easements shown on the plat. Our position is based upon a provision in the State Highway Access Code which allows for more than one access to a property, if benefits to the safety and operation of the highway can be demonstrated. The applicant's "Traffic and Access" study provides a reasonable justification for the two access easements to State Highway 52. However, we cannot waive the requirements for turn lanes in the Code which apply to this proposed subdivision. The Department of Highways will review the applicant's traffic study in relation to the design standards in the Code. Unless it is determined that changes in the standards are necessary, we have no choice but to apply those standards in the review of an application for access to S.H. 52. If projected traffic volumes for this commercial subdivision meet the warrant criteria for turn lanes, they will be required. We ask that a note be added to the plat to guarantee that each of the two lots served by each of the access easements will have a clear right to full use of the easement. Even though theeasements are 50 feet wide in total , the actual access width of the access approach cannot exceed 35 feet at the property line. If lots are individually sold to different owners, conflicts could occur over the use of the shared easement. A note on the plat itself would ensure that the easements cannot be fenced or obstructed by any future property owner. An Access Approach Permit will be required for the construction of both of the access approaches to S.H. 52. An application for this permit can be obtained from the District IV Office at the address printed above. The application will be reviewed in relation to the standards of the State Highway Access Code. We appreciate the consideration which has been given for an additional 25 feet of highway right of way.
