RE: APPROVAL OF USE BY SPECIAL _REVIEW FOR A MICROWAVE REPEATER
STATION - BURLINGTON NORTHERN RAILROAD COMPANY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the -4th day of J4ay, 1983, at the hour of 2 : 00 o'clock
pan. in the Chambers of the Board for the purpose of hearing the
application of Burlington Northern Railroad Company, c/o Joseph
McNeal, Rosengarten and Richmond, P.C. , 1700 -Walnut Street,
Suite 500, Philadelphia, PA 19103, for a Use by Special Review
for a Microwave Repeater Station on the following described real
estate, to-wit:
Part of the NE4, Section 15, Township 3 North,
Range 61 West of the 6th P.M. , Weld County,
Colorado.
WHEREAS, Section 24 . 4 .2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendationsof the Weld County -Plan-
ning Commission and all of the exhibits and evidence presented in
this matter, and having been fully informed finds that:
1. The submitted materials are in compliance with the
application requirements of Section 24. 7 of the Weld
County Zoning Ordinance;
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24.4 . 2 of the Weld County -Zoning Ordinance as follows :
a. The proposal is consistent with the Comprehensive
Flan and is consistent with the intent of the
Agricultural -Zone District in that the use does
not constitute an interference with agricultural
activities. The use is both compatible with
existing agricultural activity and with land use
which is contemplated to be agricultural in the
Comprehensive Plan.
b. No overlay districts affect the site. Operation
and design standards provide adequate protection
of the health, safety and welfare of the neighbor—
hood and the County.

c. The proposal is allowed as a Use by Special Review
in the "A" (Agricultural) Zone District.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners that the application for a Use by Special Review for a
Microwave Repeater Station on the hereinabove described parcel of
land be, and hereby is, granted subject to the following con-
ditions :
1. The attached standards for use by special review be
adopted.
2 . The plat for the use by special review permit be placed
on record by the Department of Planning Services staff
prior to any building permits being issued on the site.
The above and foregoing resolution was , on motion duly made
and seconded, adopted by the following vote on the 4th day of
May, A.D. , 1983.

STANDARDS FOR USE BY SPECIAL REVIEW
1. The type of use shall be a microwave repeater station. The station
shall include the following structures:
- a guyed tower with beacon tower light;
- An equipment shelter;
- A six (6) foot cyclone fence shall surround the tower and
building.
2. The proposal shall comply with the design standards for Uses by
Special Review, Section 24.5 et seq. of the Weld County Zoning
Ordinance.
3. The proposal shall comply with the operations Standards for Uses by
Special Review, Section 24.6 et seq. of the Weld County Zoning
Ordinance.
4. The Use by Special Review shall be limited to the plans shown
hereon and governed by the Standards stated above and all applica-
ble Weld County Regulations. Any material deviations from the
plans and/or Standards as shown or stated above shall require the
approval of an amendment of the Permit by the Weld County Planning
Commission and the Board of County Commissioners before such changes
from the plans and/or Standards are permitted. Any other changes
shall be filed in the office of the Department of Planning Services.
5. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Standards.
Noncompliance with any of the above stated Standards may be reason
for revocation of the Permit by the Board of County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice published April 14, 1983 in the La Salle
Leader, a public hearing was conducted for the purpose of considering a Use by
_Special Review, microwave repeater station, for Burlington Northern Railroad
Company. R. Russell Anson, Assistant County Attorney, read the application
into the record. Rod Allison read the favorable recommendations from the Weld
County Planning Commission and the Department of Planning Services into the
record. Mark Wentland, Communications supervisor for the Burlington Northern
Railroad, was present to represent the applicant. Mr. Wentland explained that
his company felt that this repeater station is a necessity for communications
and data information. He said that this system would connect to the system
built out of Alliance, Nebraska and going in three different directions from
that location. Mr. Wentland said that this repeater station is consistent with
the immediate area because there are currently two other microwave sites and
one VHF radio tower adjacent to the land loosed for the station. The Chairman,
• C. Carlson, asked whether this company already had a microwave repeater station
in Weld County. Mr. Wentland said that the other station is not in Weld County,
but just west of Sterling and Merino, being in Logan County. Mr. John Yokum,
Yokum Ranches in Orchard, Colorado, said that this tower will border his ranch
and that there are several other towers in that general vicinity. He said that
within the last two to three weeks there have been reports which have come out
in the news that there is an extremely higher rate of leukemia among the repaiLmen
of the microwave towers and those people who work around the towers. He voiced
his concerns about his cattle and said that more time should be spent in analyzing
the data, because of the amount of microwave bombardment from all of the towers
in this area. He said if this microwave tower has possible health hazards for
the people in the area it should be postponed until more research is done in
this area. Mr. Yokum said that Yokum Ranches would like to announce their ob-
jections at this time. Mr. Wentland said that he was not aware of these reports.
He said that quite a bit of information has been given up to this time and he
was not aware of any leukemia being found in this area that could be attributed
to the microwave towers. Commissioner Johnson moved that the Use by Special
Review for the microwave repeater station for the Burlington Northern Railroad
Company with the recommended conditions be approved. Commissioner Brantner
seconded the motion and it carried unanimously.

Gentl emen:
Burlington Northern Rail road herein applies for a conditional use permit
to -construct a proposed microwave repeater st-ation near Wiggins, CO. In
making this application, we are attaching supporting drawings and
statements which comply with Weld County Planning Commission
requirements for the permit review process. The following documents and
statements are submitted in support of the requested appl i-cati on:
Item la: The proposed microwave site will to consistent with the Weld
County Comprehensive Plan in that the development will occupy
only 0.6% of site area. The remainder of the site that is not
developed will continue to be used for rangeland farming.
Item lb: The proposed development will be consistent with the intent of
the district in that the use as -a communications microwave
repeater station will not conflict with other users in the
immediate vicinity
Item lc: The use of the proposed facility would be as a microwave
repeater station which will be compatible with existing
adjoining land uses. Kansas-Nebraska Natural Gas Company uses
the adjacent 400 ft. x 400 ft. plat as a microwave repeater
station utilizing a 203 ft. tower. This tower is shared by
Public Service Company of Colorado for their use as a
microwave station. Mountain States Telephone Company owns a
10 acre parcel in the SE 1/4 of NE 1/4 Sec. 1-5 for their
microwave repeater stati on. A small radio tower and shelter
is located near the west line of NW 1/4 Secti-on 14. Except
for the right-of—way for Interstate Highway 76 all the
properties adjacent to Burlington Northern's proposed
microwave site are used chiefly for rangel and.
Item ld: The use of the proposed site will be compatible with future
devel opment of the surrounding area in that the existing
zoning is agricultural and the proposed development will not
alter the rangel and characteristics in the immediate area.

Item le: The proposed microwave site is not located within any Overlay
District Area.
Item lf: The proposed facility will be located within the agricultural
district and efforts have and will be made to conserve
agricultural land in the site. Only 0.6% of the site area
will be developed with the remaining left for rangeland.
Areas subject to blowouts will be graveled and rocked and
areas disturbed by construction will be reseeded with grasses
recommended by Weld County Soil Conservation Service.
Item ig: Provisions for the protection of the health, safety and
welfare of the inhabitants of the neighborhood and county will
be incorporated into the design and construction of the
microwave repeater station. The microwave site is located in
relatively remote area with no inhabitants nearby.
The microwave tower is designed and fabricated per Electronic
Industries Association Standard RS-222-C (March 1976) for a 40
PSF windload with 1/2 inch ice applied to tower and all
appurtenances. This corresponds to a 100 MPH wind applied to
tower which covered with 1/2 inch of radial ice. The climbing
facility for the tower will be an inside mounted fixed ladder
designed in accordance to the above RS-222-C standard.
A 6-foot high cyclone type fence will surround the tower and
building preventing unauthorized access to the tower. The
fence, tower, building and all the equipment in the shelter
are grounded to a buried metal grid system which protects the
entire fenced area of the site from the effects of lightning
and induced voltages. The guy anchors will also be fenced and
grounded.
The microwave tower will be obstruction marked and lighted per
FAA Advisory Circular 70/7460-1 Chapters 3, 4, 5 and 9. Per
FAA aeronautical study No. AWM-507-OE the tower structure
would not be a hazard to air navigation. The tower will be.
lighted in accordance to FAA Spec. "A-2" and painted with
alternate bands of aviation surface orange and white.

Item 5: The following is a description of the proposed facility,
construction and operation:
The proposed microwave repeater facility is a vital link in
the Burlington Northern Railroad: Brush to Denver microwave
system which will he a expansion of the present Gillette, WY,
Alliance, NE, and Brush, CO system. The microwave system is
required to handle the Railroad's rapidly increasing need for
communication circuits. Due to the increasing volume of BN
coal and grain traffic, -the additional facilities are
essential in order to furnish voice and data circuits for
Centralized Traffic Control (CTC) along with PBAX circuits
that provide more efficient and safer movement of coal and
freight traffic.
The proposed facility will consist of a guyed 200 ft. tower
with beacon tower light on top and an 8 ft. x 20 ft. x 10 ft.
high equipment shelter near the tower base. The shelter is a
pre-assembled and wired building that will be delivered to the
site and installed on concrete footings. The microwave will
operate in the 2 and 6 GHZ operational-fixed band with a power
output from the transmitters of 1 watt. Operation of the
repeater station is automatic and will require no employees on
a permanent basis. Routine maintenance is normally conducted
once a month by one employee utilizing a one-ton vehicle. The
existing access road leading to the Mountain Bell and Kansas-
Nebraska microwave sites will be used.
Construction is scheduled to begin approximately 30 days after
permit approval and be completed within 60 days. During the
tower construction phase, a maximum of 4 or 5 workers are
utilized. The tower and equipment shelter work are
subcontracted to Advance Industries of Sioux City, IA.
