HomeMy WebLinkAbout820567.tiff RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A CEMETARY MONUMENT OFFICE AND DISPLAY - MARGARET CRAPPS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 9th day of June, A.D. , 1982, at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Margaret Crapps, 1123 East 16th Street, Greeley, Colorado 80631 for a Use by Special Review for a cemetary monument office and display, on the following described real estate, to-wit: Part of the NE4 of Section 9 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado. WHEREAS , Section 24. 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. The applicant has shown compliance with Section 24. 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan and is consistent with the intent of the Agricultural Zone District in that the use is clearly an accessory to the adjacent cemetary which is a use allowed by right in the "A" District. The use is both compatible with existing agricultural activity and with land use which is contemplated to be mixed land uses in the Greeley Comprehensive Plan. 2 . No overlay districts affect the site. Operation and design standards provide adequate protection of the health, safety and welfare of the neighborhood and the County. 3 . The applicant, Mrs. Crapps was present and answered questions of the Board. She stated that this facility is only for showing and selling of the product. At this location,was once a restaurant until 1965. Mr. Thornton, the lessee, who plans to use the facility, was not present and was out of town. At the present time, Mr. Thornton 's business is located across from Linn Grove cemetery. Mrs. Crapps stated she felt this facility would not be a hazard to the surrounding citizens. Following discussion and there being no one in opposition present, Commissioner N. Carlson made a motion to approve the Use By Special Review for a Cemetery Monument office and display facility for Margaret Crapps. Commissioner Kirby seconded the motion. The motion carried with all Commissioners voting yea, except Commissioner C. Carlson who voted nay. Mr. and Mrs. McNamara, neighbors of Mrs. Crapps, were present and stated they would like to see Mrs. Crapps receive some revenue from this parcel of land. The parcel is 40 acres and too small to be farmable and has been idle since 1957. /T. At least one who signed the petition against this business going into this area lives in the immediate vicinity and that is enough to appear, at this time, that this business is incompatible with the neighborhood even though he felt this office for display and sale of cemetary monuments is appropriate for this area. FRED OTIS No because while he does feel it is compatible with the existing neighborhood; he also feels the staff interpretation of the Zoning Ordinance is incorrect. He does not feel this is a similar use to any of the listed uses, it may be a compatible use, but it is a commercial use and there are no commercial uses listed. The uses permitted on this site shall include an office and sale and display of cemetary monuments as described in the application materials on file in the Weld County Department of Planning Services. Working hours shall be between 8:00 a.m. and 5:00 p.m. Only one office structure with one (1) employee shall be allowed. 2. No plumbing shall be connected to the trailer and a ten (10) pound ABC fire extinguisher shall be installed on the premises. 3. Design Standards for Uses by Special Review, Section 24.5 et. seq. of the Weld County Zoning Ordinance shall be complied with. 4. Operation Standards for Uses by Special Review, Section 24.6 et. seq. of the Weld County Zoning Ordinance shall be complied with. 5. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards stated above and all applica- ble Weld County Regulations.
